STAFF REPORT
The County of San Bernardino has requested that we
participate in the cost of resurfacing Ster1ing Avenue, from
Baseline Street to Highland Avenue. Approximately 13% of
this section is within the corporate limits of the City of
San Bernardino. This portion is the east half, from north
of Rocca Street to Highland Avenue.
The proposed agreement provides, in general, that the
County will act as lead agency and have the resurfacing
performed by contract. The Ci ty wi 11 rei mburse the County
for its proportionate share, estimated at $6,000.00.
The total cost of this project is $260,000. Regional
Federa1-aid and Urban Funds have been approved to finance
about 86% ($223,500) of the total project cast. The 14%
local agency matching share will be financed in the
proportion of area under each agency's juri sdiction --
County -- $30,500, City -- $6,000.
A tentative advertising date of January, 1986 has been
schedu1ed by the County, with construction to start in
April, 1986.
Funds to finance the City's share will be derived from
additional revenue in the Street Construction Fund.
This section of Sterling Avenue is badly in need of
rehabilitation. We recommend the agreement to be approved.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH THE COUNTY OF SAN BERNARDINO
RELATING TO RESURFACING OF STERLING AVENUE, FROM BASELINE
STREET TO HIGHLAND AVENUE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is
hereby authorized and directed to execute, on behalf of said
City, an Agreement with the County of San Bernardino relating
to resurfacing of Sterling Avenue, from Baseline Street to
Highland Avenue, which agreement is attached hereto, mar.ked
Exhibit "A" and incorporated herein by reference as fully as
though set forth at length.
SECTION 2. The agreement shall not take effect until
fully signed and executed by both parties. The City shall not
be obligated hereunder unless and until the agreement is fully
executed and no oral agreement relating thereto shall be
implied or authorized.

(Use space below and additional bond sheets. Set forth service to be rendered, amount to be paid, manner of payment, time
for performance or completion, detennination of satisfactory performance and cause for termination, other terms and
conditions, and atrach plans, specifications, and addenda, if any.)
WHEREAS, COUNTY and CITY desire to cooperate and jointly participate in
a project for the resurfacing of Sterling Avenue from Base Line Avenue to
Highland Avenue hereinafter referred to as PROJECT; and,
WHEREAS, PROJECT is partially in the unincorporated area of the COUNTY
and partially wi thin the incorporated area of the CITY, and will be of
mutual benefit to the COUNTY and CITY; and
WHEREAS, the San Bernardino County Transportation Commission has included
the PROJECT in the East Valley Federal Aid Urban (FAU) highway improvement
program which provides for funding of approximately 86 percent of the con-
struction costs from the FAU program; and
WHEREAS, COUNTY and CITY desire to set forth the responsibilities and
obligations of each as pertains to such participation and to the design,
construction and future maintenance of the proposed improvements.
NOW, THEREFORE, IT IS MUTUALLY AGREED AS FOLLOWS:
1.0 COUNTY SHALL:
1.1 Act as the Lead Agency in the design and construction of the PROJECT.
1.2 Provide plans and specifications and all necessary construction
'engineering for the PROJECT.
1.3 Construct the PROJECT by contract in accordance with the plans and
specifications of COUNTY to the satisfaction of and subject to
concurrence of the CITY.

Comply with all Federal and State procedures necessary to secure
authorization to utilize Federal ,Aid Urban Highway funds in the
construction of the PROJECT.
1.5 Arrange for relocation of all utilities which interfere with
construction of the PROJECT.
1.6 Obtain a no-cost permit from CITY for work within the CITY's right
of way.
1.7 Advertise, award, administer and fund the construction of the PROJECT.
1.8 Require its contractors to maintain Workmen I s Compensation Insurance
on all employees and a Public and Property Damage Liability Insurance
Policy of not less than $1,000,000 combined single limits liability
coverage for bodily injury and/or property damage which shall name
the City of San Bernardino as an insured party.
1.9 Provide adequate inspection of all items of work, performed under
the construction contract and maintain adequate records of inspections
and materials testing for review by City.
1.10 Accept responsibility all preliminary engineering costs and for
its proportionate share of the local matching funds needed for
construction and construction engineering of the PROJECT based on
the COUNTY'S determination of the actual cost of work in the
unincorporated area. COUNTY'S share of the matching funds needed
is 87J and estimated to be $30,500.
1.11 Submit to CITY an itemized accounting of the PROJECT cost and a
statement for CITY'S share of the cost as provided herein.
1.12 After acceptance of the construction contract, maintain those
portions of PROJECT within the unincorporated area of COUNTY.
2.0 CITY SHALL:
2.1 Accept responsibility for it's proportionate share of the local
funds needed to for construction and construction' engineering of
the PROJECT based on the COUNTY'S determination of the actual
costs in the incorporated area of the CITY. CITY'S share of the
matching funds needed is 13J of the total and is estimated to be
$6,000.
2.2 Reimburse COUNTY, within thirty (30) days after receipt of an
itemized statement as set forth in paragraph 1.11 of this agreement
setting forth all cost of PROJECT to be borne by the CITY.
2.3 After acceptance of the construction contract work, maintain those
portions of PROJECT within the incorporated area of the CITY.

3.0 IT IS 'MUTUALLY AGREED BY THE PARTIES HERETO:
3.1 That neither party to the agreement nor officers nor employees
thereof shall be responsible for any damage or liability occurring
by"reason of any thing done or omitted to be done by the other
party to the agreement under or in connection with any wor:k.
authority or jurisdiction delegated to the parties under thi s
agreement. It is also understood and, agreed that pursuant to
Government Code, Section 895.4 each party shall fully indemni fy
and hold all other parties harmless from any liability for injury
(as defined by Government Code, Section 810.8) occurring by reason
of anything done or omitted to be done under or in connection with
any work, authority or jurisdiction under this agreement.
THIS AGREEMENT shall inure to the benefit of and be binding upon the
successors and assigns of the parties involved.
IN WITNESS THEREOF, the parties hereto have caused this agreement to be
executed by their respective officials thereunto duly authorized.

Dear Mr. Hardgrave:
Transmitted herewith for your review and approval is a copy of the
proposed cooperative agreement for the resurfacing project on Sterling
Avenue from Base Line Avenue to Highland Avenue.
As you know, this project was approved for funding under the East Valley
FAU program which provides for approximately 86% of the construction cost.
It is proposed that the remaining local share be proportioned based on the
project area within each jurisdiction. Under this concept the City's share
is estimated to be $6000.
We have tentati vely scheduled the project advertisement for early
January 1986 with construction to follow in April 1986.
Please forward any comments you have on the proposed agreement to us
for further processing.
