Dear City Clerk:
In response to request for clarification of the reason
for appeal in the matter of denial by the Planning
Commission of Sign Permit Nos. 61024 and 61025 for the
construction of a new painted bulletin at 215 East
Redlands Blvd., and the demolition of one billboard
located at 455 West Fifth Street, I offer the following:
A. All permits were issued by the Planning Director in
the belief that compli~nce with relocation require-
ments of the San Bernardino Municipal Code.
B. Planning Commission was informed of circumstances
surrounding the permits, both by Planning Director
and applicant. Deputy City Attorney was present
with City Attorney opinion that presumed Planning
Department action was in conflict with the
San Bernardino Municipal Code.
C. In order to clarify the issue, Planning Commission
denied the permit application so that an appeal
could be made to Mayor and City Couricil for discussion
and interpretation by administrative ruling.
I trust that the foregoing is sufficient for your purposes;
and if not, please contact me for additional discussion.

The appeal of Sign Permit Nos. 61024 and 61025, for the
construction of a new painted bulletin at 512 East Redlands
~oulevard and the demolition of one billboard located at 455
West Fifth Street, was denied.
The decision of the Planning Commission is final unless
appealed within ten days to the Mayor and Council through the
City Clerk's office.

"Off premi se si gns, as defi ned in Secti on 19 .60. 20, may be premitted in the
City of San Bernardino subject to the following restrictions:"
"A. Specific standards:
1. Zones permitted: Off-premise signs shall only be permitted in
the fo 11 owi ng zones provi ded a bufl di ng permit has been
obtained: C-3, C-3A, C-M, M-l, and M-2.
2. Sign area: Maximum of three hundred square feet per face with
a maxi mum of two faces. '
3. Height: Maximum of thirty-two feet.
4. Setback: No portion of an off-premise sign may be closer than
ten feet to the public right-of-way.
5. Spacing: Minimum of four hundred feet in any straight line
between off-premise signs.
6. No off-premise sign shall be located so that its side edge is
less than one hundred feet in any straight line between off-
premise signs.
7. An off-premise sign shall not be allowed within five hundred
feet of any park, school, cemetery or church, regardless of
zoning.
8. An off premi se si gn shall not be permi tted withi n six hundred
sixty feet from the right-of-way line of a freeway, when the
advertising face of an off-premise sign is visible from any
point on said right-of-way line.
9. Off-premise signs shall not be allowed on any building roof.
B. Any company owning an off-premise sign may replace it in any
other approved zoning district within the City upon issuance of a
permit. Replacement of such signs shall be on a one-to-one basis
and shall not require a conditional use permit. The new sign
shall conform to all other conditions relating to off-premise
signs and shall require plot plan review by the Planning Depart-
ment.
C. A new sign which would result in an increase in the number of
off-premise signs owned by any company may be permitted subject
to approval of a conditional use permit."

On April 19, 1985, in conformance with the provlslon stated in paragraph "B" of
the above, a permit was is~ued to Gannett for the removal of a painted bulletin
(670 square feet) located at 455 West 5th Street and the construction of a
painted bulletin (670 square feet) at 512 East Redlands Boulevard. In issuing
said permits it was and still is my interpretation that the provisions of
paragraph "A" of Secti on 19.62 are not app 1 i cab 1 e to the repl acement of si gns
removed by an outdoor advertising company when working in cooperation with the
City. No work, at both locations, has been started by Gannett.
On June 28, 1985, Gannett was informed by the Building and Safety Department
that the permits had been revoked on the instruction of the City Attorney's
Office. It is the opinion of the attorney's office that the provisions as
stated in paragraph "A" are app Ii cabl e for replacement si gns as well as all new
billboards. We have requested an interpretation but have not recieved an opin-
ion in writing.
The applicant is now appealing the revocation of this permit as specified in
Section 19.60.270.0

and is requesting that the Planning Commission make an intrepretation as pro-
vided in Section 19.60.270.B

Statement of facts concerning cancellation of permits #61008, 61007,
61006, 61024 and 61025.
1. June 26, 1985 a.m. I was instructed to cancel the above permits
by John Wilson, City Attorney's office.
'2. June 26, 1985 p.m. I discussed matter with City Administrater. He
suggested I wait until a meeting could be held with City Attorney
and Planning Director.
3. June 27, 1985 a.m. meeting confirmed City Attorney's instructions.
June 27, 1985 p.m. notified permittee by registered mail of
cancellation.

Dear Mr. Worley:
I am responding to your letter of June 28, 1985 in regard to
cancellation of permits (demolition at 455 W. 5th Street and
construction at 512 E. Redla~ds Blvd.) and would request a
hearing on the matters as soon as possible.
The permits were processed in good faith, relying on numerous
discussions with Planning Department staff and review of the
existing ordinance provisions with respect to relocation
requirements. It is the position of Gannett Outdoor that we are
in compliance, both in the letter of the law and in its
legislative intent. It was also in the spirit of cooperation
that Gannett Outdoor was acting to remove signs from a sensitive
area within the City to assist the City in its overall goals
without incurring financial compensation as per State law.
The arbitrary cancellation of the permits, without hearing or
consultation, has placed us in tenuous positions with our lessors:
and there have been financial conside~ations incurred with
respect to engineering costs and structural fabrication that need
to be addressed.
