Clk OF SAN BERNARD~ - REQU," FOR COUNCIL ACtiON STAFF REPORT -- On October 7, 1985, the Commission/Council approved several resolutions relating to local incentives provided within the boundaries of the Enterprise Zone. Those resolutions included the allocation of a portion of housing, beautification, and job linkage funds to the Enterprise Zone, the designation of the Deputy City Administrator as the coordinator of City departments' activities in the Enterprise Zone, and the authorization for Agency Staff to develop a plan for a data base of information on the Enterprise Zone and an incubator project. Resolution "A" (attached), though voted on at the October 7 meeting, because of the absent council members, did not receive enough votes to pass. It is, therefore, resubmitted for approval. In addition, the Council continued action on an Ordinance which would have amended Title 19 of the Municipal Code to provide for "mixed use" developments in the Zone. After conferring with City Planning Department and the State Office of Planning and Research, staff has determined that the attached Resolution "CO will replace the ordinance. ,- ~ Resolution "B" instructs the Planning Department to develop a new code designation known as "Mixed Residential Commercial (MRC)" and to provide for a relief of parking requirements within the Zone. This action is necessary to prevent any violation of CEQA requirements. By adopting the ordinance without following the CEQA guidelines, the City opens itself to possible litigation. It is the opinion of the Office of Planning and Research (OPR) that this possibility of litigation would seriously impair our application. OPR also felt that this Resolution would be as strong a commitment as the Ordinance. . Also at that meeting, the Commission continued an item relating to the establishment of a "Zone Management Office". Resolution "C" (attached) authorizes the Executive Director to assign certain staff members to the "Zone Management Office". Resolution "D" directs staff, in conjunction with EDC and the Chamber of Commerce, to develop a marketing strategy which would determine which industries are best suited to the Enterprise Zone, how best to attract those industries, and which specific companies the Agency should target. Staff would also develop a detailed marketing strategy. Resolution "E" directs staff, in conjunction with EDC and the Chamber of Commerce, to develop a technical assistance program for those local companies which export products out of the country. It would also assist local companies in learning how to export, and provide an incentive to new companies moving to the area in need of expanding their export programs. RESOLUTION OF THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO ESTABLISHING A ZONE MANAGEMENT OFFICE TO FACILITATE PROCESSING OF DEVELOPMENT PROJECTS WITHIN THE ENTERPRISE ZONE. 4 BE IT RESOLVED BY THE COMMUNITY DEVELOPMENT COMMISSION OF THE CITY OF SAN BERNARDINO AS FOLLOWS: 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 SECTION 1. The Community Development Commission of the City of San Bernardino hereby establishes a Zone Management Office within the Redevelopment Agency of the City of San Bernardino to facilitate the processing of development projects within the Enterprise Zone of the City of San Bernardino. The Executive Director of the Redevelopment Agency is hereby authorized and directed to appoint designated staff members to fully familiarize themselves with all aspects of project development within the city structure of the City of San Bernardino, which employees shall be charged with responsibilities as follows: A. To develop an information brochure on -one-stop processing- of development plans. B. To accept filings for all forms of commercial, industrial and residential development within the Enterprise Zone, and to act as the one-stop contact for any proponent of such a project. C. To act as liaison between any such developer or project proponent and each and every City department involved in the processing of industrial, commercial or residential development 25 projects, with a view to expediting the review and processing of 26 27 such plans without unnecessary delay. "'"" 6 7 SECTION 1. Recitals. 8 A. The City of San Bernardino desires to institute 9 within the commercial area of the Enterprise Zone, particularly 10 along the so-called "Mt. Vernon corridor" on Mt. Vernon Avenue 11 between Rialto Avenue and Highland Avenue, zoning requirements 12 and provisions which would permit mixed commercial and 13 residential uses on the same parcels of property, to assure 14 maximization of opportunity to develop the commercial and 15 residential potentials of the Mt. Vernon corridor, and still 16 remain within the intent of and consistent with the general plan 17 of the City of San Bernardino and the redevelopment pIan for the 18 Northwest Redevelopment Project. 19 B. The City of San Bernardino has committed itself to 20 modify the parking and set-back requirements within the 21 commercial area of the Enterprise Zone to remove impediments to 22 development, and desires to implement an ordinance effecting such 23 changes in the San Bernardino Municipal Code at the earliest 24 practicable time. 25 C. The Community Development Commission of the City of 8 San Bernardino recognizes that the effective marketing of the 9 Enterprise Zone of the City of San Bernardino will require utmost 10 cooperation between the San Bernardino Economic Development 11 Council, the San Bernardino Area Chamber of Commerce, and the 12 staff of the Redevelopment Agency of the City of San Bernardino, 13 in order to develop and implement a marketing strategy to 14 determine which industries are best suited to the Enterprise 15 Zone, how best to attract those industries, and which specific 16 companies should be approached concerning the possibility of 17 establishing a business activity within the Enterprise Zone. 18 Such cooperation will also be needed to implement such strategy, 19 contact such companies, and, in general, to carry out the 20 promotion and marketing of the Enterprise Zone of the City of San 21 Bernardino to maximize the benefits to the community. 22 B. The staff of the Redevelopment Agency has already 23 been working with the staff of the San Bernardino Economic 24 Development Council and with the San Bernardino Area Chamber of 25 Commerce in this matter, and all three entities are prepared to 26 quickly move for the establishment of such a marketing strategy. 27 SECTION 2. Implementation. The Redevelopment Agency staff is further directed to develop a detailed marketing strategy, in cooperation 10 with the San Bernardino Economic Development Council and the San 11 Bernardino Area Chamber of Commerce, and to report back to the 12 Community Development Commission of the City of San Bernardino 13 with the recommendations for the adoption of such a formal c:: 14 program. The program to be adopted shall provide for the 15 implementation of the marketing strategy as devised. The staff of the Redevelopment Agency of the City '- 21 of San Bernardino, the San Bernardino Economic Development 22 Council, and the San Bernardino Area Chamber of Commerce have 23 already done extensive work in studying the possibility of 24 providing technical assistance to proposed exporters of local 25 products, and are in a good position to rapidly develop a system 26 of technical assistance to existing companies and to new 27 companies moving to the area in the expansion of their export 28 programs. The staff of the Redevelopment 2 Agency of the City of San Bernardino is hereby authorized and 3 directed to forthwith develop, in cooperation with the San 4 Bernardino Economic Development Council and the San Bernardino 5 Area Chamber of Commerce, a policy for the providing of technical 6 assistance to local companies and to new companies moving into 7 the Enterprise Zone to offer assistance, training and education 8 in how to export products, in identifying products which are best 9 suited for export, and in developing methods of marketing 10 possible exports. ORDINANCE OF THE CITY OF SAN BERNARDINO ESTABLISHING INCENTIVES TO BE GRANTED CERTAIN BUSINESSES AND CERTAIN RESIDENTIAL CONSTRUCTION WITHIN THE ENTERPRISE ZONE. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO 4 DO ORDAIN AS FOLLOWS: 5 SECTION 1. Chapter 3.18 is hereby added to the San 6 Bernardino Municipal Code to read: 7 .CHAPTER 3.18 8 ENTERPRISE ZONE INCENTIVES 9 3.18.010 Incentives. 10 Each new business and each expanding business within the 11 Enterprise Zone established by resolution of the City of San 12 Bernardino pursuant to Assembly Bill 40, Chapter 45 of the 13 Statutes of 1984, shall qualify for the tax rebates and fee 14 exemptions provided for herein, to the extent and for the period 15 specified herein. 16 17 18 19 20 21 22 23 24 25 26 27 28 3.18.020 Purpose. The incentives set forth in this chapter are granted pursuant to Chapter 45 of the Statutes of 1984, and are established for the purposes authorized by Chapter 45 of the Statutes of 1984, and are established for the purposes authorized by Chapter 12.8 of the Government Code of the State of California, being Government Code Sections 7070 through 7077, inclusive. 3.18.030 Definitions. A. 'Industrial area' as used in this chapter is the industrial area established within the Enterprise Zone as described in a resolution of the City of San Bernardino. C. 'New business' as used in this chapter is any business which is start-up in nature or an existing business which has been relocated to San Bernardino from another area. A business which has been sold, resulting in a change of ownership, will not be considered a new business. D. 'Expanding business' as used in this chapter is any business which meets the criterion of paragraph 3 below, as well as the criteria in either paragraph 1 or 2. 1. A physical move of an existing business into a new location within the designated commercial area that results in at least fifty percent increase of permanent, full-time employees or an increase of two permanent, full-time employees, whichever is larger, within three years from the date of the move. 2. A physical expansion of existing facilities which results in at least a fifty percent increase of permanent, full- time employees or an increase of two permanent, full-time employees, whichever is larger, within three years from date of completion of expansion. 3. Employees filling the positions added in paragraphs 1 or 2 above must be residents of the City of San Bernardino and have been on the job for at least nine months. E. 'Housing rehabilitation' as used in this chapter refers to construction involving home improvement through remodeling involving actual structural repairs and rehabilitation or through 28 physical addition of rooms onto structures presently in existence 2 ('- ,.. c - '- . ... - c '''' " ~. '......I I 2 3 4 5 6 7 8 9 10 II 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 within the Enterprise Zone of the City, when such structures are used for single-family or multi-family residential purposes; such construction shall fall within the scope of this definition only if the portion of the structure actually being rehabilitated or expanded is brought substantially into compliance with all applicable codes and ordinances. F. 'In-fill housing' as used in this chapter is single- family home construction built on vacant lots in neighborhoods existing at the time of adoption of this chapter, or built on lots where existing structures are demolished or removed for the construction of single-family homes. 3.18.040 Rebates - Commercial area. During the first three years of the life of the Enterprise Zone, City shall rebate to qualifying new or expanding businesses located within the Commercial Area of the Enterprise Zone, upon application, the following: A. One hundred percent rebate of utility service users taxes collected by City from the business enterprise during that period for service used during that period under the provisions of Chapter 3.44 of the San Bernardino Municipal Code as applied to users of telephone, electricity, natural gas and cable television service. B. One hundred percent rebate of the business license tax imposed during that period upon the business enterprise under Chapter 5.04 of the San Bernardino Municipal Code. C. For new businesses only, twenty-five percent of the total water bill collected by the San Bernardino Board of Water 28 Commissioners from the new business during that period. Notwithstanding the provisions of Subsections A and B above, the rebate to be granted to any expanding business shall be based on the stated percentage of the increase of such tax over and above a base amount, which base amount shall be the total amount of each such tax paid by that business during the twelve-month period immediately preceding such expansion. 3.18.050 Fee exemptions - Commercial area. During the first three years of the life of the Enterprise Zone, new businesses and expanding business in the designated Commercial Area shall be exempt from all engineering fees, planning fees, building permit fees and mechanical fees imposed by the City. Storm drain and sewer capacity fee charges are expressly not exempted. 3.18.060 Rebates - industrial area. During the first year of operation of any new industrial business located within the industrial area of the Enterprise Zone, City shall rebate to qualifying new businesses, upon application, the following: A. Twenty-five percent of the utility service users' taxes paid by such business under Chapter 3.44 of the San Bernardino Municipal Code, relating to telephone, electricity, natural gas and cable television use during that period. The City committed itself to provide a data base of available 1 and , and to work with the community college and university to provide technical training programs. By a resolution directing Agency staff to negotiate with two groups at the university and an institute at Valley College for a needs assessment study relating to data base and technical training programs, the City will provide sufficient evidence to forward with the final Enterprise Zone application that the City is proceeding with those two incentives. The City has committed itself to creation of an incubator project for new commercial and industrial businesses within the Enterprise Zone. By a resolution directing Agency staff to negotiate with the San Bernardino Area Chamber of Commerce and the Economic Development Council to develop such a project, the City evidences that it is going ahead with that pIan in an orderly manner, and we are assured by the consultants that this evidence should be sufficient as to this particular incentive. The City has committed itself to beautification and the job linkage program, and is now requested to commit itself to specific dol1ar amounts. It is our understanding that the Ways & Means Committee specified that for beautification, at least 251 of the $50,000 targeted for beautification for the current year wil1 be earmarked for the Enterprise Zone, and that this same amount and percentage will continue, and be reviewed and reinstated at least every five years during the life of the Enterprise Zone. For the job linkage program, we understand that the Ways and Means Committee specified that 501 of the $100,000 presently targeted for the job linkage program would be earmarked for the Enterprise Zone, with the commitment for a similar amount through the first five years, with periodic review and reinstatement each five years. A resolution designating those portions of the beautification fund and job linkage funds for the current year, and committing the City to those percentages and dollar amounts for the future, has been prepared to evidence the City's commitment and implementation of those particular programs for Enterprise Zone incentives. The City's preliminary application also committed the City to an infill housing program, housing rehabilitation program, demolition program. and housing development financing as incentives within the Enterprise Zone. Each of these four incentive items are covered within the one resolution approving the infill housing program, al10cating housing, rehabilitation and demolition funds, and directing the targeting of housing . . - ~ - r ~~ / .~ development financing efforts toward improvements within the Enterprise Zone. Under this resolution, the City approves the infill housing program, targets the area bounded by Fifth Street, 1-215, Ht. Vernon Avenue, and 9th Street as the initial targeted area for the infill program, and directs development and implementation of a comprehensive housing infill program along the lines of the concept paper previously approved by the Hayor and Common Council. The resolution also directs that staff negotiate with one or more contractors to develop such a housing program, and to establish and promote an infill housing program available for public use not necessarily depending upon use of any particular contractor. The City commits itself to use not less than $2,000,000 of the $36,000,000 available for financing single-family homes under the single-family mortgage revenue bond issue presently being floated by the City of San Bernardino. The resolution also directs that Agency staff prepare the housing program in final form for subsequent adoption, and acknowledges that after the initial $2,000,000 of single-family mortgage revenue bond proceeds have been utilized for infill housing within the Enterprise Zone, the Hayor and Common Council will expand the program to include other areas of the City but keep a special emphasis upon the Enterprise Zone. (The infill housing and rehabilitation programs are also included in the fee exemption provisions of the ordinance, as discussed below). The same resolution designates not less than 351 of the housing rehabilitation funds designated in the Community Development block grant program for use within the Enterprise Zone, which is $350,000 of the $1,000,000 al1ocation. The City under the resolution commits itself for future years that not less than 351 of the funds earmarked for housing rehab within the City will be designated for use within the Enterprise Zone with the amount to be reviewed and reinstituted at least every five years. This, we understand, was recommended by the Ways & Heans Committee. Similarly, in accordance with the recommendation of the Ways & Heans Committee, 351 of the $50,000 targeted fordemolition under the CDBG program wil1 be used within the Enterprise Zone, and the City will commit itself that not less than 351 of each year's future al10cation of CDBG funds for demolition will likewise be earmarked for the Enterprise Zone, subject to review after five years. The resolution also acknowledges that $50,000 of the CDBG funds set aside for housing in-fill could be available to assist with the demolition project. The resolution goes on to acknowledge that financing of both single-family and multi-family housing within the Enterprise Zone is a matter of great concern to the City, and directs that Agency staff and City employees give high priority to funding such developments. We believe this resolution will constitute sufficient City action to evidence the City's implementation of these four incentives. Another incentive referred to in the preliminary application was a streamlining program for processing of development plans. Two resolutions have been prepared to establish evidence that the City has already implemented that part of the incentive program. The first is a resolution of the Community Development Commission ? ~ \. ' . . -- - - ~ " "- .I establishing a zone management office within the Redevelopment Agency, directing appointment of certain staff members to become fully familiar with all aspects of project development and the City structure, and designating that those employees will be charged with implementing a so-cal1ed "one-stop processing" of development plans. This commission resolution also mentions that the zone management office will work closely with the Deputy City Administrator to remove any and all roadblocks standing in the way of prompt processing of development plans. Tied in with that is a City resolution designating the Deputy City Administrator as the person responsible for assuring full cooperation by City staff with the zone management office, and directing cooperation of al1 affected City employees. These two resolutions, together, should provide adequate evidence that the City means business about a one-stop process, and meets the obligation of the City for that particular incentive. The Capital Improvement incentive is addressed in a resolution by which the City commits itself to appropriate at least one million dollars annually to street improvements. This is not expressly targeted for the Enterprise Zone; if that is Council's intent, we should revise the resolution to so specify. Central to all of this, and probably the most controversial, is an ordinance implementing the tax rebate and fee exemption provisions specified in the preliminary application, and confirmed by the Ways & Heans Committee. Fee exemption is granted for in-fill housing and housing rehabilitation, under this proposed ordinance, but storm drain fees and sewer capacity charges are not exempted. The proposed ordinance also includes what could be a very controversial provision for allowing some specific residential uses within commercial zones. This is particularly important along the Ht. Vernon corridor, because of the seeming conflict between existing zoning and provisions of the general plan and the redevelopment pIan. As drafted, this ordinance permits limited "mixed uses", in the form of planned residential developments, under careful development standards, within specified commercial zones in the Enterprise Zone. This mixed use concept, we are advised by the consultants, is very important to showing intent to encourage development. Gary Van Osdel advises us that this manner of dealing with the problem will help immeasurably in advancing the City's application through the final review process. Such a "mixed use" poI icy has been used with great success in a number of municipalities. It may be worthy of note that this mixed used concept could also help on the "retail food market" incentive, since at least one developer (Spirit) would find its proposed development considerably easier with this change in effect. Also included within the same ordinance is a method of addressing the obligation undertaken to grant parking relief and relief from setback requirements. The parking relief is in the form of providing that where existing uses on neighboring land fal1 substantially below meeting current parking requirements, the same percentage by which the existing uses meet such parking 3 .. . - .. ,....' ....' ,.; - requirements shal1 apply to establish the parking requirements for new uses. The setback requirements within the Enterprise Zone will be, under the proposed ordinance, consistent with the setback of other property in the same block. Each of these proposed code changes for the Enterprise Zone will eliminate the objection of the state reviewers to having parking relief and setback requirement relief based on a case by case basis. Our consultants advise that a case by case resolution is not satisfactory, and that we are obligated to set forth specific standards. We believe that the proposed ordinance does that. The proposal for mixed use which will permit the combining of residential and commercial uses within the same area, and the modification of setback requirements and parking requirements have not been coordinated with the Planning Department. The City Attorney's office recommends that the ordinance receive its first reading and then be referred to the Planning Department and any appropriate committees for further review but that it still be scheduled for final reading at the earliest possible time, if the provisions of the ordinance are consistent with the Council's desires and intentions. RESOLUTION OF THE CITY OF SAN BERNARDINO APPROVING INPILL HOOSING PROGRAM, ALLOCATING HOOSING REHABILITATION FONDS AND DEMOLITION FONDS, AND DIRECTING TARGETING OF HOOSING DEVELOPMENT FINANCING EFFORTS TOWARD IMPROVEMENTS WITHIN ERTBRPRISE ZONE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNAlmINO AS FOLLOWS: SECTION 1. The City of San Bernardino hereby establishes an infill housing program, initially targeted within the Enterprise Zone of the City of San Bernardino, with the initial emphasis to be upon the development of new single-family homes on vacant lots in established neighborhoods within the Enterprise Zone of the City of San Bernardino. The initial targeted area shall be pinpointed within that area bounded on the south by Fifth Street, bounded on the east by Interstate Freeway 1-215, bounded on the west by Mt. Vernon Avenue, and bounded on the north by Ninth Street. The staff of the Community Development Division of the Redevelopment Agency is directed to forthwith commence development and implementation of a comprehensive housing infill program, along the lines of the concept paper heretofore approved by the Mayor and Common Council. SECTION 2. Staff shall negotiate with one or more licensed contractors to develop such infill housing, and to establish and promote an infill housing program available for public use not dependent upon use of any particular contractor. The City of San Bernardino hereby designates not less than 35' of the Community Development Block Grant funds appropriated as housing rehabilitation funds for the current fiscal year for use within the Enterprise Zone. One million dollars of Community Development Block Grant funds have been earmarked for rehabilitation funds throughout the City of San Bernardino, and not less than 35' of those funds ($350,000) shall be utilized within the Bnterprise Zone during the current fiscal year. SECTION 4. Such Needs Assessment Study shall specifically review the purposes to be served and the means of best accumulating and utilizing certain data bases, and the benefits of a data base of both available land and demographics, the study shall also review the need and advisability of developing a technical assistance capability utilizing the resources of the local University and College staffs, and a study of what may be done to attract commercial development, industrial development, and higher level (-upscale-) housing developments to the City of San Bernardino. SECTION 3. 'The Executive Director and staff of the Redevelopment Agency of the City of San Bernardino are hereby authorized and directed to negotiate with the San Bernardino Area Chamber of Commerce and the San Bernardino Bconomic Development Council to develop an incubator project for the creation of new commercial and industrial businesses within the Enterprise Zone of the City of San Bernardino. SECTION 2. The Executive Director shall supervise all such negotiations, and attempt to develop a project for utilization of existing vacant buildings within the Enterprise Zone of the City of San Bernardino. Such negotiations contemplate having the Agency acquire or provide assistance to a public or private entity in acquiring the use of vacant buildings within the Enterprise Zone, in cooperation with the San Bernardino Area Chamber of Commerce and the San Bernardino Economic Development Council. SECTION 3. Staff shall develop a plan for the management of such building or buildings, for financial and technical assistance to small businesses or persons proposing to establish small businesses of an industrial or commercial nature within any such building, and for incentives for the initial start up of such business activities. The project shall utilize the many City and Agency programs available to assist businesses, plus any federal, state or locally assisted programs of every kind which may be of assistance, to assure that any business participating in such an incubator project shall have the maximum available assistance and guidance from public and private agencies. The primary goal of such project shall be to help assure the success of each such new enterprise within the Enterprise Zone. SECTION 4. The Bxecutive Director shall provide a report to the Community Development Commission together with recommendations for the implementation of the incubator project, as an agenda item for the Community Development Commission of the City of San Bernardino not later than July 1, 1986. ORDINANCE OF THE CITY OF SAN BERNARDINO ESTABLISHING INCENTIVES TO BE GRANTED CERTAIN BUSINESSES AND CERTAIN RESIDENTIAL CONSTRUCTION WITHIN THE ENTERPRISE ZONE, AND AMENDING TITLE 19 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE FOR THE APPROVAL OF PLANNED RESIDENTIAL DEVELOPMENT DISTRICTS WITHIN COMMERCIAL ZONES IN ENTERPRISE ZONES, AND TO MODIFY SETBACK AND PARKING REQUIREMENTS IN ENTERPRISE ZONES. Chapter 3.18 is hereby added to the San Bernardino Municipal Code to read: .CHAPTBR 3.18 ENTERPRISE ZONE INCENTIVES 3.18.010 Incentives. Bach new business and each expanding business within the Enterprise Zone established by resolution of the City of San Bernardino pursuant to Assembly Bill 40, Chapter 45 of the Statutes of 1984, shall qualify for the tax exemptions, fee exemptions, and relaxations of the building codes, zoning laws, and general development restriotions provided for herein, to the extent and for the period specified herein. 3.18.020 Purpose. The incentives set forth in this chapter are granted pursuant to Chapter 45 of the Statutes of 1984, and are established for the purposes authorized by Chapter 45 of the Statutes of 1984, and are established for the purposes authorized by Chapter 12.8 of the Government Code of the State of California, being Government Code Sections 7070 through 7077, inclusive. 3.18.030 Definitions. 1 l# ,~ ~/ , . A. 'Commercial area' as used in this chapter is the 1 2 commercial area established within the Enterprise Zone as 3 described in a resolution of the City of San Bernardino. B. 'Industrial area' as used in this chapter is the 4 industrial area established within the Enterprise Zone as 5 described in a resolution of the City of San Bernardino. 6 C. 'New business' as used in this chapter is any business 7 which is start-up in nature or an existing business which has 8 been relocated to San Bernardino from another area. A business 9 10 which has been sold, resulting in a change of ownership, will not be considered a new business. 11 12 D. 'Expanding business' as used in this chapter is any 13 business which meets the criterion of paragraph 3 below, as well 14 as the criteria in either paragraph 1 or 2. 15 1. A physical move of an existing business into a new 16 location within the designated commercial area that results in at 17 least fifty percent increase of permanent, full-time employees or 18 an increase of two permanent, !ull-time employees, whichever is 19 larger, within three years from the date of the move. 20 2. A physical expansion of existing facilities which 21 results in at least a fifty percent increase of permanent, full- 22 time employees or an increase of two permanent, full-time 23 employees, whichever is larger, within three years from date of 24 completion of expansion. 25 3. 'Housing rehabilitation' as used in this chapter refers to construction involving home improvement through remodeling involving actual structural repairs and rehabilitation or through physical addition of rooms onto structures presently in existence within the Enterprise Zone of the City, when sDch structures are used for single-family or multi-family residential purposes, such construction shall fall within the scope of this definition only if the portion of the structure actually being rehabilitated or expanded is brought substantially into compliance with all applicable codes and ordinances. r. 'In-fill housing' as used in this chapter is single- family home construction built on vacant lots in neighborhoods existing at the time of adoption of this chapter, or built on lots where existing structures are demolished or removed for the construction of single-family homes. 3.18.040 Rebates - Commercial area. During the first three years of the life of the Enterprise Zone, City shall rebate to qualifying new or expanding businesses located within the Commercial Area of the Enterprise Zone, upon application, the following: A. One hundred percent rebate of utility service users taxes collected by City from the business enterprise during that period for service used during that period under the provisions of Chapter 3.44 of the San Bernardino Municipal Code as applied to users of telephone, electricity, natural gas and cable television service. B. For new businesses only, twenty-five percent of the total water bill collected by the San Bernardino Board of Water Commissioners from the new business during that period. Only the water portion of such bill shall be considered for such rebate. D. Notwithstanding the provisions of Subsections A and B above, the rebate to be granted to any expanding business shall be based on the stated percentage of the increase of such tax over and above a base amount, which base amount shall be the total amount of each such tax paid by that business during the twelve-month period immediately preceding such expansion. 3.18.050 Fee exemptions - Commercial area. During the first three years of the life of the Enterprise Zone, new businesses and expanding business in the designated Commercial Area shall be exempt from all engineering fees, planning fees, building permit fees and mechanical fees imposed by the City. Storm drain and sewer capacity fee charges are expressly not exempted. 3.18.060 Rebates - industrial area. During the first year of operation of any new industrial business located within the industrial area of the Enterprise Zone, City shall rebate to qualifying new businesses, upon application, the following: A. TWenty-five percent of the utility service users' taxes paid by such business under Chapter 3.44 of the San Bernardino Municipal Code, relating to telephone, electricity, natural gas and cable television use during that period. B. TWenty-five percent of the business license tax paid by such business for the period under the provisions of Chapter 5.04 of the San Bernardino Municipal Code.- 4 c 13 ,',--. Storm drain and sewer capacity fee charges are expressly not exempt. SBCTION 2. Section 19.18.020 of the San Bernardino Municipal Code is amended to read: -19.18.020 Creation. There is created the PRO planned residential development district. Wbenever placed on the land use zoning map as the 11 primary district, PRO shall be indicated as the district 12 designation of the area over which it is placed, and the provisions of said PRO district shall apply. Alternatively, PRO may be used in conjunction with other residential or commercial districts as an overlay district to control common areas, to establish standards for lot maintenance, or to establish suitable development standards as provided herein.- SBCTION 3. Section 19.26.025 is added to the San Bernardino Municipal Code to read: -19.26.025 Additional uses permitted. Section 19.28.025 is added to the San Bernardino Municipal Code to read: -19.28.025 Additional uses permitted. In addition to the uses permitted within C-] general commercial districts as specified in Section 19.28.020, PRO planned residential development districts as overlay districts shall be permitted in C-3 general commercial districts when the area proposed for such PRO use is within an Enterprise Zone established by the City.- SECTION 5. Section 19.54.080 is added to the San Bernardino Municipal Code to read: -19.54.080 Lots or parcels in enterprise zone. In each block in the Enterprise Zone where fifty percent or more of the frontage on a side of a given street is already built up on the effective date of this section, the average distance from the building front to the property line of existing buildings shall be determined to be the setback line. If less than fifty percent of such frontage is built up, the average distance from the building front to the property lines of the two nearest buildings on the same side of the street shall be determined to be the setback line. If no such buildings exist within 500 feet of the subject property, the setback line shall be as established in Section 19.54.010.- SECTION 6. Subsection B is added to Section 19.56.040 to read: -B.
