NOTICE 01" PUBLIC HEARING
RE: CITY ENTERPRISE ZONE

The Mayor and City Council of the City of San Bernardino ~
holding a public hearing for the purpose of receiving
comments on the proposal to offer a list of local incentives
to attract new and/or expanding businesses into the proposed
Enterprise Zone (see map for boundaries). Examples of
incentives may include utility tax rebates, and fee waivers
of- various fees. These incentives are proposed to be
implemented prior to the State taking action on approving the
Enter~rise Zone.
The public hearing will be held at the regularly scheduled
Council Meeting on October 7, 1985 at 2:00 p.m. in the City
Council Chambers. Please share with us your concerns regard-
ing this proposal. .

STAFF REPORT
To provide evidence that the City is actually implementing
various of the incentives for which the City has committed itself
in the Enterprise Zone preliminary application, Agency staff and
Agency counsel have developed a series of resolutions and one
proposed ordinance to cover most of the incentives for which the
City has committed itself.
The City committed itself to provide a data base of available
land, and to work with the community college and university to
provide technical training programs. By a resolution directing
Agency staff to negotiate with two groups at the university and
an institute at Valley College for a needs assessment study
relating to data base and technical training programs, the City
will provide sufficient evidence to forward with the final
Enterprise Zone application that the City is proceeding with
those two incentives.

The City has committed itself to creation of an incubator project
for new commercial and industrial businesses within the
Enterprise Zone. By a resolution directing Agency staff to
negotiate with the San Bernardino Area Chamber of Commerce and
the Economic Development Council to develop such a project, the
City evidences that it is going ahead with that plan in an
orderly manner, and we are assured by the consultants that this
evidence should be sufficient as to this particular incentive.
The City has committed itself to beautification and the job
linkage program, and is now requested to commit itself to
specific dollar amounts. It is our understanding that the Ways &
Means Committee specified that for beautification, at least 25%
of the $50,000 targeted for beautification for the current year
will be earmarked for the Enterprise Zone, and that this same
amount and percentage will continue, and be reviewed and
reinstated at least every five years during the life of the
Enterprise Zone. For the job linkage program, we understand that
the Ways and Means Committee specified that 50% of the $100,000
presently targeted for the job linkage program would be earmarked
for the Enterprise Zone, with the commitment for a similar amount
through the first five years, with periodic review and
reinstatement each five years. A resolution designating those
portions of the beautification fund and job linkage funds for the
current year, and committing the City to those percentages and
dollar amounts for the future, has been prepared to evidence the
City's commitment and implementation of those particular programs
for Enterprise Zone incentives.
The City's preliminary application also committed the City to an
infill housing program, housing rehabilitation program,

~ incentives within the Enterprise Zone. Each of these four
incentive items are covered within the one resolution approving
the infill housing program, allocating housing, rehabilitation
and demolition funds, and directing the targeting of housing

development financing efforts toward improvements within the
Enterprise Zone. Under this resolution, the City approves the
infil1 housing program, targets the area bounded by Fifth Street,
1-215, Mt. Vernon Avenue, and 9th Street as the initial targeted
area for the infill program, and directs development and
implementation of a comprehensive housing infill program along
the lines of the concept paper previously approved by the Mayor
and Common Council. The resolution also directs that staff
negotiate with one or more contractors to develop such a housing
program, and to establish and promote an infill housing program
available for public use not necessarily depending upon use of
any particular contractor. The City commits itself to use not
less than $2,000,000 of the $36,000,000 available for financing
single-family homes under the single-family mortgage revenue bond
issue presently being floated by the City of San Bernardino. The
resolution also directs that Agency staff prepare the housing
program in final form for subsequent adoption, and acknowledges
that after the initial $2,000,000 of single-family mortgage
revenue bond proceeds have been utilized for infil1 housing
within the Enterprise Zone, the Mayor and Common Council will
expand the program to include other areas of the City but keep a
special emphasis upon the Enterprise Zone. (The infill housing
and rehabilitation programs are also included in the fee
exemption provisions of the ordinance, as discussed below).
The same resolution designates not less than 35% of the housing
rehabilitation funds designated in the Community Development
block grant program for use within the Enterprise Zone, which is
$350,000 of the $1,000,000 allocation. The City under the
resolution commits itself for future years that not less than 35%
of the funds earmarked for housing rehab within the City will be
designated for use within the Enterprise Zone with the amount to
be reviewed and reinstituted at least every five years. This,
we understand, was recommended by the Ways & Means Committee.
Similarly, in accordance with the recommendation of the Ways &
Means Committee, 35% of the $50,000 targeted for demolition under
the CDBG program will be used within the Enterprise Zone, and the
City will commit itself that not less than 35% of each year's
future allocation of CDBG funds for demolition will likewise be
earmarked for the Enterprise Zone, subject to review after five
years. The resolution also acknowledges that $50,000 of the CDBG
funds set aside for housing in-fill could be available to assist
with the demolition project.
The resolution goes on to acknowledge that financing of both
single-family and multi-family housing within the Enterprise Zone
is a matter of great concern to the City, and directs that Agency
staff and City employees give high priority to funding such
developments. We believe this resolution will constitute
sufficient City action to evidence the City's implementation of
these four incentives.
Another incentive referred to in the preliminary application
was a streamlining program for processing of development plans.
Two resolutions have been prepared to establish evidence that the
City has already implemented that part of the incentive program.

establishing a zone management office within the Redevelopment
Agency, directing appointment of certain staff members to become
fully familiar with all aspects of project development and the
City structure, and designating that those employees will be
charged with implementing a so-called "one-stop processing" of
development plans. This commission resolution also mentions that
the zone management office will work closely with the Deputy City
Administrator to remove any and all roadblocks standing in the
way of prompt processing of development plans. Tied in with that
is a City resolution designating the Deputy City Administrator as
the person responsible for assuring full cooperation by City
staff with the zone management office, and directing cooperation
of all affected City employees. These two resolutions, together,
should provide adequate evidence that the City means business
about a one-stop process, and meets the obligation of the City
for that particular incentive.
The Capital Improvement incentive is addressed in a resolution by
which the City commits itself to appropriate at least one million
dollars annually to street improvements. This is not expressly
targeted for the Enterprise Zone; if that is Council's intent, we
should revise the resolution to so specify.
Central to all of this, and probably the most controversial, is
an ordinance implementing the tax rebate and fee
exemption provisions specified in the preliminary application,
and confirmed by the Ways & Means Committee. Fee exemption is
granted for in-fill housing and housing rehabilitation, under
this proposed ordinance, but storm drain fees and sewer capacity
charges are not exempted. The proposed ordinance also includes
what could be a very controversial provision for allowing some
specific residential uses within commercial zones. This is
particularly important along the Mt. Vernon corridor, because of
the seeming conflict between existing zoning and provisions of
the general plan and the redevelopment plan. As drafted, this
ordinance permits limited "mixed uses", in the form of planned
residential developments, under careful development standards,
within specified commercial zones in the Enterprise Zone. This
mixed use concept, we are advised by the consultants, is very
important to showing intent to encourage development. Gary Van
Osdel advises us that this manner of dealing with the problem
will help immeasurably in advancing the City's application
through the final review process. Such a "mixed use" policy has
been used with great success in a number of municipalities. It
may be worthy of note that this mixed used concept could also
help on the "retail food market" incentive, since at least one
developer <Spirit) would find its proposed development
considerably easier with this change in effect.
Also included within the same ordinance is a method of addressing
the obligation undertaken to grant parking relief and relief from
setback requirements. The parking relief is in the form of
providing that where existing uses on neighboring land fall
substantially below meeting current parking requirements, the
same percentage by which the existing uses meet such parking

requirements shall apply to establish the parking requirements
for new uses. The setback requirements within the Enterprise
.~ Zone will be, under the proposed ordinance, consistent with the
~ setback of other property in the same block. Each of these
proposed code changes for the Enterprise Zone will eliminate the
objection of the state reviewers to having parking relief and
setback requirement relief based on a case by case basis. Our
consultants advise that a case by case resolution is not
satisfactory, and that we are obligated to set forth specific
standards. We believe that the proposed ordinance does that.
The proposal for mixed use which will permit the combining of
residential and commercial uses within the same area, and the
modification of setback requirements and parking requirements
have not been coordinated with the Planning Department.
The City Attorney's office recommends that the ordinance
receive its first reading and then be referred to the Planning
Department and any appropriate committees for further review but
that it still be scheduled for final reading at the earliest
possible time, if the provisions of the ordinance are consistent
with the Council's desires and intentions. If at all possible,
it should be implemented at the October 21 meeting, but if
revisions are necessary, the revised ordinance could receive
first reading then and final reading on November 4.

FINANCING EpFORTS TOWARD IMPROVEMENTS WITHIN ENTERPRISE ZONE.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS pOLLOWS:
SECTION 1. The City of San Bernardino hereby establishes an
infill housing program, initially targeted within the Enterprise
Zone of the City of San Bernardino, with the initial emphasis to
be upon the development of new single-family homes on vacant lots
in established neighborhoods within the Enterprise Zone of the
City of San Bernardino. The initial targeted area shall be
pinpointed within that area bounded on the south by Fifth Street;
bounded on the east by Interstate preeway 1-215; bounded on the
west by Mt. Vernon Avenue; and bounded on the north by Ninth
Street.
The staff of the Community Development Division of the
Redevelopment Agency is directed to forthwith commence
development and implementation of a comprehensive housing infill
program, along the lines of the concept paper heretofore approved
by the Mayor and Common Council.
SECTION 2. Staff shall negotiate with one or more licensed
contractors to develop such infill housing, and to establish and
promote an infill housing program available for public use not
dependent upon use of any particular contractor.
The program to
be devised shall include permanent financing for the first phase
of infill housing, and shall utilize not less than $2 million of
the $36 million available for financing single-family homes under
the single-family mortgage revenue bond issue presently being
floated by the City of San Bernardino.

SECTION 3. The staff of Community Development Division of
the Redevelopment Agency is further directed to report back to
the Mayor and Common Council on the proposed infill housing
program, when such program is in form for final adoption, but is
authorized to proceed immediately to assure that infill housing
be given major emphasis within the Enterprise Zone.
SECTION 4. After the initial $2 million of single-family
mortgage revenue bond proceeds have been utilized for infill
housing within the Enterprise Zone, the Mayor and Common Council
will expand the infill housing program to include other areas of
the City, but special emphasis shall continue in this program
within the Enterprise Zone.
SECTION 5. The City of San Bernardino hereby designates not
less than 35% of the Community Development Block Grant funds
appropriated as housing rehabilitation funds for the current
fiscal year for use within the Enterprise Zone.
One million
dollars of Community Development Block Grant funds have been
earmarked for rehabilitation funds throughout the City of San
Bernardino, and not less than 35% of those funds ($350,000> shall
be utilized within the Enterprise Zone during the current fiscal
year.
The City of San Bernardino commits itself for future years
that not less than 35% of the funds earmarked for housing
rehabilitation within the City shall be designated for use within
the Enterprise Zone during the life of the Enterprise Zone, with
the amount to be reviewed and reinstituted at least every five
years through the life of the Enterprise Zone.

SECTION 6. The City of San Bernardino hereby designates and
sets aside 35% of the $50,000 targeted for demolition under
Community Development Block Grant funds heretofore appropriated,
to be used within the Enterprise Zone. Such funds shall be
utilized in conjunction with the infill housing program and in
conjunction with commercial, industrial or residential
development in promoting activities within the Enterprise Zone.
The City of San Bernardino commits that not less than 35% of each
year's future allocation of Community Development Block Grant
funds for demolition will be earmarked for the Enterprise Zone,
with the amount of funds to be reviewed each five years, and the
amount subject to increase depending upon demand and upon
inflation. In addition to the Community Development Block Grant
funds specifically set aside for demolition within the Enterprise
Zone, the $50,000 heretofore appropriated from Community
Development Block Grant funds for housing infill shall also be
available to assist with demolition projects, within the
Enterprise Zone.
SECTION 4. The Mayor and Common Council of the City of San
Bernardino hereby acknowledge that the financing of single-family
and multi-family housing within the Enterprise Zone is a matter

of immediate concern to the City of San Bernardino, and the Mayor
and Common Council hereby direct that all employees of the City,
and those employees of the Redevelopment Agency of the City of
San Bernardino working in or connected with the processing of
housing issues and mortgage revenue bonds, shall giVe~ri~
28 emphasis to housing developments in the Enterprise Zone. Any

single-family housing project, multi-family housing project, or
infill housing project for which mortgage revenue bond proceeds
or other City-provided programs can provide assistance, shall be
given~riority by City and Agency staff, when such proposed
project involves development within the Enterprise Zone of the
City of San Bernardino. The Council hereby directs that the
staff of the Redevelopment Agency of the City of San Bernardino
working as agents of the City of San Bernardino shall promote and
market, through a concerted effort, development of housing within
10 the Enterprise Zone of the City of San Bernardino. All such
11 employees shall make known to all possible developers the
12 availability of financial, technical and other assistance in the

the Enterprise Zone of the City of San Bernardino, on a
continuing basis.

BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS POLLOWS:
SECTION l. The City of San Bernardino has designated
$50,000 in the current fiscal year for beautification within
certain areas of the City of San Bernardino; of that $50,000, the
City of San Bernardino hereby designates not less than 25%, being
an amount not less than $12,500, to be utilized solely within the
Enterprise Zone of the City of San Bernardino. The City further
commits itself to appropriate not less than 25% of the total
12 beautification funds annually, and not less than $12,500
13 annually, during each of the remaining first five years of the
14 Enterprise Zone, as the amount to be designated and available for
15 use within the Enterprise Zone for beautification. The amount

for use within the Enterprise Zone to be subject to adjustment

SECTION l. The Mayor and Common Council of the City of San
Bernardino hereby designates the Deputy City Administrator of the
City of San Bernardino as the designated official to work in
close liaison with the Zone Management Office of the
Redevelopment Agency of the City of San Bernardino in processing
of commercial, industrial and residential development plans for
developments within the Enterprise Zone of the Cit~of San

19 Agency. The Deputy City Administrator is authorized, for and on
20 behalf of the Mayor and Common Council of the City of San
Bernardino, to deal directly with each and every City agency

22 playing any role whatsoever in the processing of development
23 plans, to ensure that no unnecessary delay may be encountered in

the processing of plans for developments within the Enterprise
Zone, and, to this end, the Deputy City Administrator shall
cooperate fully with the Zone Management Office of the
27 Redevelopment Agency. Each City employee whose duty it may be to
28 review any such development plans shall cooperate to the utmost

SECTION 2. Such Needs Assessment Study shall specifically
review the purposes to be served and the means of best
accumulating and utilizing certain data bases, and the benefits
of a data base of both available land and demographics; the study
shall also review the need and advisability of developing a
technical assistance capability utilizing the resources of the
local University and College staffs, and a study of what may be
done to attract commercial development, industrial development,
and higher level (RupscaleR) housing developments to the City of
San Bernardino.
SECTION 3. The proposed Needs Assessment Study shall
recognize that the Data Gathering Center is a self-supporting

organization within the California State University, San
Bernardino complex, and that the Institute for Social and Public
Policy Research has its own expertise and regularly utilizes the
availability expertise within the many diverse disciplines within
the University community, and the capacity for providing some
funding for faculty travel and release time, for public interest
projects, and that the Institute on occasion can make small
grants to get projects of a public nature under way.
SECTION 4. Staff and Agency Counsel are directed to
negotiate a contract for such study, and to report back to the
Community Development Commission with a proposed contract not
later than March 15, 1986.

SECTION 1. The Community Development Commission of the City
of San Bernardino hereby establishes a Zone Management Office
within the Redevelopment Agency of the City of San Bernardino to
facilitate the processing of development projects within the
Enterprise Zone of the City of San Bernardino.
The Executive
Director of the Redevelopment Agency is hereby authorized and
directed to appoint designated staff members to fully familiarize
themselves with all aspects of project development within the
city structure of the City of San Bernardino, which employees
shall be charged with responsibilities as follows:
A. To develop an information brochure on .one-stop
processing. of development plans.
B. To accept filings for all forms of commercial,
industrial and residential development within the Enterprise
Zone, and to act as the one-stop contact for any proponent of
such a project.
C. To act as liaison between any such developer or project

processing of industrial, commercial or residential development
projects, with a view to expediting the review and processing of
such plans without unnecessary delay.

D. To work closely with the Deputy City Administrator of

which may arise from delays in processing of plans, and to ensure
that all plans for development within the Enterprise Zone are
processed in the most timely and expeditious manner possible
consistent with sound government.
The Executive Director is charged with the responsibility of
ensuring that the Zone Management Office hereby provided for
shall function smoothly to assure that developers proposing
developments within the Enterprise Zone of the City of San
Bernardino will receive the most expeditious processing feasible,
and shall have the opportunity to deal with a person
knowledgeable and helpful in all aspects of processing the

THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION l. The Executive Director and staff of the
Redevelopment Agency of the City of San Bernardino are hereby
authorized and directed to negotiate with the San Bernardino Area
Chamber of Commerce and the San Bernardino Economic Development
Council to develop an incubator project for the creation of new
commercial and industrial businesses within the Enterprise Zone
of the City of San Bernardino.
SECTION 2. The Executive Director shall supervise all such
negotiations, and attempt to develop a project for utilization of
existing vacant buildings within the Enterprise Zone of the City
of San Bernardino.
Such negotiations contemplate having the
Agency acquire or provide assistance to a public or private
entity in acquiring the use of vacant buildings within the
Enterprise Zone, in cooperation with the San Bernardino Area
Chamber of Commerce and the San Bernardino Economic Development
Council.
SECTION 3. Staff shall develop a plan for the management of
such building or buildings, for financial and technical
assistance to small businesses or persons proposing to establish
small businesses of an industrial or commercial nature within any
such building, and for incentives for the initial start up of
such business activities.

include the marshalling of the existing expertise of the Chamber
of Commerce, the Economic Development Council, the Redevelopment
Agency staff, and the staff of various City departments. The
project shall utilize the many City and Agency programs available
to assist businesses, plus any federal, state or locally assisted
programs of every kind which may be of assistance, to assure that
any business participating in such an incubator project shall
have the maximum available assistance and guidance from public
and private agencies. The primary goal of such project shall be
to help assure the success of each such new enterprise within the
Enterprise Zone.
SECTION 4. The Executive Director shall provide a report to
the Community Development Commission together with
recommendations for the implementation of the incubator project,
as an agenda item for the Community Development Commission of the
City of San Bernardino not later than July 1, 1986.

Each new business and each expanding business within the
Enterprise Zone established by resolution of the City of San
Bernardino pursuant to Assembly Bill 40, Chapter 45 of the
Statutes of 1984, shall qualify for the tax exemptions, fee
exemptions, and relaxations of the building codes, zoning laws,
and general development restrictions provided for herein, to the
extent and for the period specified herein.
3.18.020 Purpose.
The incentives set forth in this chapter are granted
pursuant to Chapter 45 of the Statutes of 1984, and are
established for the purposes authorized by Chapter 45 of the
Statutes of 1984, and are established for the purposes authorized
by Chapter 12.8 of the Government Code of the State of
California, being Government Code Sections 7070 through 7077,
inclusive.

A. 'Commercial area' as used in this chapter is the

C. 'New business' as used in this chapter is any business
which is start-up in nature or an existing business which has
been relocated to San Bernardino from another area. A business
be considered a new business.
D. 'Expanding business' as used in this chapter is any
business which meets the criterion of paragraph 3 below, as well
as the criteria in either paragraph 1 or 2.
1. A physical move of an existing business into a new
location within the designated commercial area that results in at
least fifty percent increase of permanent, full-time employees or
an increase of two permanent, full-time employees, whichever is
larger, within three years from the date of the move.
2. A physical expansion of existing facilities which
results in at least a fifty percent increase of permanent, full-
time employees or an increase of two permanent, full-time
employees, whichever is larger, within three years from date of
completion of expansion.
3. Employees filling the positions added in paragraphs
1 or 2 above must be residents of the City of San Bernardino and
have been on the job for at least nine months.

E. 'Housing rehabilitation' as used in this chapter refers
to construction involving home improvement through remodeling
involving actual structural repairs and rehabilitation or through
physical addition of rooms onto structures presently in existence
within the Enterprise Zone of the City, when such structures are
used for single-family or multi-family residential purposes; such
construction shall fall within the scope of this definition only
if the portion of the structure actually being rehabilitated or
expanded is brought substantially into compliance with all
applicable codes and ordinances.
p. 'In-fill housing' as used in this chapter is single-
family home construction built on vacant lots in neighborhoods
existing at the time of adoption of this chapter, or built on
lots where existing structures are demolished or removed for the
construction of single-family homes.
3.18.040 Rebates - Commercial area.
During the first three years of the life of the Enterprise
Zone, City shall rebate to qualifying new or expanding businesses
located within the Commercial Area of the Enterprise Zone, upon
application, the following:
A. One hundred percent rebate of utility service users
taxes collected by City from the business enterprise during that
period for service used during that period under the provisions
of Chapter 3.44 of the San Bernardino Municipal Code as applied
to users of telephone, electricity, natural gas and cable
television service.
B. One hundred percent rebate of the business license tax
imposed during that period upon the business enterprise under
Chapter 5.04 of the San Bernardino Municipal Code.

C. Por new businesses only, twenty-five percent of the
total water bill collected by the San Bernardino Board of Water
Commissioners from the new business during that period.
Only the
water portion of such bill shall be considered for such rebate.
D. Notwithstanding the provisions of Subsections A and B
above, the rebate to be granted to any expanding business shall
be based on the stated percentage of the increase of such tax
over and above a base amount, which base amount shall be the
total amount of each such tax paid by that business during the
twelve-month period immediately preceding such expansion.
3.18.050 Fee exemptions - Commercial area.
During the first three years of the life of the Enterprise
Zone, new businesses and expanding business in the designated
Commercial Area shall be exempt from all engineering fees,
planning fees, building permit fees and mechanical fees imposed
by the City.
Storm drain and sewer capacity fee charges are
expressly not exempted.
3.18.060 Rebates - industrial area.
During the first year of operation of any new industrial
business located within the industrial area of the Enterprise
Zone, City shall rebate to qualifying new businesses, upon
application, the following:
A. Twenty-five percent of the utility service users' taxes
paid by such business under Chapter 3.44 of the San Bernardino
Municipal Code, relating to telephone, electricity, natural gas
and cable television use during that period.
B. Twenty-five percent of the business license tax paid by
28 such business for the period under the provisions of Chapter 5.04
of the San Bernardino Municipal Code.-

Municipal Code is amended to read:

There is created the PRO planned residential development
district. Whenever placed on the land use zoning map as the
primary district, PRO shall be indicated as the district

Alternatively, PRO
may be used in conjunction with other residential or commercial
districts as an overlay district to control common areas, to
establish standards for lot maintenance, or to establish suitable
development standards as provided herein.w
SECTION 3. Section 19.26.025 is added to the San Bernardino

SECTION 4. Section 19.28.025 is added to the San Bernardino
Municipal Code to read:

In addition to the uses permitted within C-3 general
commercial districts as specified in Section 19.28.020, PRO
planned residential development districts as overlay districts
shall be permitted in C-3 general commercial districts when the
area proposed for such PRO use is within an Enterprise Zone
established by the City.8
SECTION 5. Section 19.54.080 is added to the San Bernardino
Municipal Code to read:
819.54.080 Lots or parcels in enterprise zone.
In each block in the Enterprise Zone where fifty percent or
more of the frontage on a side of a given street is already built
up on the effective date of this section, the average distance
from the building front to the property line of existing
buildings shall be determined to be the setback line. If less
than fifty percent of such frontage is built up, the average
distance from the building front to the property lines of the two
nearest buildings on the same side of the street shall be
determined to be the setback line. If no such buildings exist
within 500 feet of the subject property, the setback line shall
be as established in Section 19.54.010."
SECTION 6. Subsection B is added to Section 19.56.040 to
read:
