STAFF REPORT
On September 24. 1984. this office received a petition from the
developer, of the 7-lot subdivision at the southwest corner of Eureka
Street and Poplar Street, to establish an assessment district for the
maintenance of landscaping. This was a requirement of the subdivision.
and the subdivision was sponsored by the RDA through the San Bernardino
Economic Development Council. On November 8. 1984. this office went to
Council for authorization to proceed. which we received.
In the process of preparing the Engineer's Report. we found that the
subdivider was no longer the only owner as six of the seven homes had
sold. We inspected the area to be maintained. and asked our existing
landscape maintenance contractors to give us an estimate of the cost for
maintaining this area per year. Acting independently, they both came up
with an estimate of $1.200 per year. Using this estimate and a reduced
incidental cost ($100 per year). the assessment for each parcel came to
$185.71 per year. This amount is more than one-half the total tax bill
on each property.
This did not appear to be feasible. so we called a meeting between
Engineering, Parks & Recreation. and RDA who sponsored the tract. It
was mutually agreed that under the circumstances, the district should
not have been a requirement of the subdivision and that the area
involved should have been designed differently so as not to require such
maintenance. We fel t that now that 86% of the area to be assessed is
privately owned and with an assessment of $185.71 per year that the
district would fail at the protest hearing date on the Resolution of
Intention. Parks and Recreation Department suggested that patterned
concrete be installed leaving only the tree wells open and that the City
could then handle the maintenance. The cost of these improvements would
be $2.318.82. The cost to the subdivider (RDA) to up-front the costs
for the assessment proceedings is estimated at from $2.000 to $3,000.
It has been determined that the best arrangement for all concerned was
for the RDA (CDC) to pay the $2.381.82 concrete cost. the City to
maintain. (which is about nil), and to terminate the assessment
district. However, the Community Development Citizen Advisory Committee
denied the recommendation at their meeting in January.
Based on the above. the excessive costs to the owners and the most
assuredly majority protest. it is the recommendation of this office that
the proceedings be terminated and the files in Finance and Public Works
be closed.
