Change Order No.6 authorizes Berry Construction to remove a portion of the concrete deck for the 3 outside terraces in order to achieve proper drainage, and installation of a fiberglass waterproofing membrane. Berry Construction was directed by our Construction Manager to remove a portion of the concrete decks. These decks were poured by the concrete contractor, Maveric Construction, but they did not correct the problem in a timely manner. The cost of this corrective work is $3,671.57, which will be deducted from the final payment to Maveric Construction. A dimensional discrepancy was discovered in the plans during con- struction. This discrepancy necessitated the installation of a fiberglass membrane, as detailed in the attached letter of 9-12-B5 from W. F. Doran. The cost of this membrane is $2,400.00. Attached is a copy of the memorandum dated 6-2B-B5, from Bill Doran, recommending that Change Order No.6 be approved. We concur with this recommendation. "D" Street San Bernardino, California 92418 RE: San Bernardino Central Library BP #13 & BP #3 - Concrete removal at Terraces Dear Roger: Change order number 6 to Berry Construction includes $2,400.00 for the installation of a fiberglass membrane under the quarry tile on the three terraces. As we have noted before, there is some question as to whether or not this cost should be charged against the BP 3 contractor. To understand why this is the case, refer first to the BP 13 specif- ication section for the quarry tile to be used on the terraces. In paragraph 2.01 (A) the thickness of the tile is specified as 11/16". To this tile thickness add the following for each of the items required to complete the installation: ITEr1 SPEC. SECT./PARA. Bed 9330/3.02 (D) (8) Waterproof Memb. 711012.01 (A) (1) Protection Board 7110/2.01 (A) (4) Total Thickness of Tile Installation THICKNESS 11/16" 1"+/-1/4" 1/8" 1/8" 2"+/-1/4" This 2" dimension arrived at above is the same as that shown at detail 28 on sheet A-35 of the architectural drawings. This ~Ias the detail used by the BP 3 contractor. c G o , j . ,- '--' Compounding this problem, (the existence of the drawing discrepency was not recognized until later as is noted below) the BP 3 contractor left the terrace deck with a tamped finish (instead of that specified) which was too rough to accept the specified waterproofing. To allow the deck to be waterproofed, a topping finish was applied which reduced the depression provided for the tile by approximately 1/4". This left 1/4" for the mortar setting bed, 112" less than the minimum dimension required by the specification. When the tile installation began. the drawing discrepancy noted above was found and, additionally, it was discovered that the BP 3 contractor had failed to slope the terrace decks to drain. It was at this time that the decision was made to remove the high concrete at the terraces. At the conclusion of the removal work, a cost analysis (see attached from Berry Construction) was made of two possible methods to use for the waterproofing of the terraces, with the fiberglass membrane being the most economical (method B on attached). This is the method that was used. c The larger problem of drainage aside, and barring a different method of installing the tile that did not require a mortar bed, it is probable that approximately 1/2" would have to have been removed from the terraces in order to provide the proper thickness for the setting bed. If this removal work had been done it would have left a rough surface over which the specified membrane could not be applied and resort would have to be made to the fiberglass membrane, as demonstrated above. We feel that the use of the fiberglass membrane in lieu of that specified was the result of the discrepancy between the architectural and structural drawings and that to hold the BP 3 contractor responsible for this dimensional error would be unfair. We, therefore, recommend that the $2,400.00 provided for the installation of this membrane not be charged to the BP 3 contractor but be considered as one of those unayoidable expenses which accompany every project of this magnitude.
