Synopsis of Previous Council action:
The City Attorney was directed to prepare an amendment to Chapter
2.17 of the San Bernardino Municipal Code to provide that members
of specific boards, bureaus and commissions shall serve at the
pleasure of the nominating Council member or the Mayor at the
August 22, 1985 Legislative Review Committee.
Recommended motion:
Waive further first reading of ordinance and layover for final
adoption.

ORDINANCE OF THE CITY OF SAN BERNARDINO AMENDING CHAPTER
2.17 OF THE SAN BERNARDINO MUNICIPAL CODE TO PROVIDE THAT MEMBERS
OF SPECIFIC BOARDS, BUREAUS AND COMMISSIONS SHALL SERVE AT
PLEASURE AND SUCH MEMBERS MAY BE REPLACED AT ANY TIME BY
NOMINATION, APPOINTMENT AND CONFIRMATION.
THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO
DO ORDAIN AS FOLLOWS:
6 SECTION 1. Section 2.17.030 of the San Bernardino Municipal

-2.17.030 Nomination - Replacement.
Each Council member shall nominate one member of each such
board, bureau and commission, who, following appointment and
confirmation as specified in Section 2.17.040, shall serve at the
pleasure of the Mayor and may be removed by the Mayor upon the
recommendation of the appointing Council member or successor
Council member.
The Mayor shall nominate two members to each
such board, bureau and commission, who shall serve at the
pleasure of the Mayor, subject to appointment and confirmation
procedures as specified in Section 2.17.040.
The Mayor or
nominating Council member may nominate a candidate to replace any
member of a board, bureau or commission at any time.
Nomination
of the replacement member at any time by the Mayor or the
nominating Council member or successor member and appointment by
the Mayor, and confirmation as set -forth herein, shall terminate
the appointment of any member so replaced, without any need for
formal removal action.-
SECTION 2. Section 2.17.040 of the San Bernardino Municipal
Code is amended to read as follows:

Each member of such board, bureau or commission, after
having been nominated, may be appointed by the Mayor, with the
approval of the Common Council. Thereafter, the City Clerk shall
issue a certificate of appointment with the oath of office
attached.
Each appointed member shall be and remain a registered
voter within the City and each member of such board, bureau or
commission nominated by ~ Council member shall be and remain a
resident of the ward of su~h Council member or successor member.
Members shall serve, without compensation, at the pleasure of the
Mayor.
Any member no longer possessing the qualifications
required for appointment shall cease to serve as a member, and
such member's office shall be deemed vacant, except that if a
ward boundary change results in the member no longer residing in
the nominating Council member's ward, such member may continue to
serve until a replacement member is nominated and appointed. Any
vacancy shall be filled and appointment shall be made in the
manner hereinbefore set forth as for an original appointment.-
I HEREBY CERTIFY that the foregoing ordinance was duly
