Previous Planning Commission action:
At the meeting of the Planning Commission on August 20, 1985, the
following recommendation was made:
The application for Change of Zone No. 85-14 was recommended for
approval of PRD-5U Planned Residential Development zoning at five
units per acre. The Negative Declaration for environmental review
was also recommended for approval.
Vote: 5-0, 2 abstentions, 2 absent.
Recommen<:led motion:
To approve the responses to comments and to adopt the Negative
Declaration for environmental review which has been reviewed
and considered,
To approve, modify or reject the findings and the recommendation
of the Planning Commission and to direct the City Attorney to
prepare the necessary amendments to the Zoning Ordinance.

This item was continued from the July 16, 1985 Planning Commission meeting in
order for a community meeting to be held. On July 31, 1985 the community
meeting was held and as a result of that meeting the applicant requested by
letter (attached) to amend his request from the original R-3-3000 (14 units per
acre) to that of PRD-5 (Planned Residential Development at units per acre).
This amendment would reduce the yield from 345 maximum number of units to that
of 119 units, for a total reduction of 226 units.

1, The proposal is to change the land use zoning district fraIl "0", Flood
Control to R-3-3000, multiple family residential. The subject property
is an irregularly shaped parcel of land consisting of approximately
23,74 acres located between 5th Street and 7th Street and being located
approximately 165 feet west of the centerline of Flores Street,
2, The current "0", Flood Control, zoning designation was established upon
armexation of the subject property to the city in 1982. At the t~ of
Annexation the site was owned by the County Flood Control District and
was viewed as part of the Lytle Creek wash area with potential for
flooding. In a rnerrorandum dated February 21, 1985 fraIl The County
Flood District in \,mich it is stated that as a result of channel im-
provemmts to the East Branch of Lytle Creek, which includes IIDdification
to the spillway and the construction of a concrete channel section
downstream fraIl the spillway that the property is IlCM considered
reasonably free of serious flOOd hazard and therefore surplus to the
needs of the District, The Flood Control District has therefore re-
quested that the property be rezoned to R-3-3000 for resale marketing
purposes,
3, The San Bernardino General Plan designates the site for Flood Control
Residential 8-14 units per acre and general cOlllllercial adjacent to 5th
Street, Surrounding properties to the north across 7th Street are
zoned R-1-7200 single family residential and R-2 two family residential
and consist of vacant property and single family residences, property
located to the south across 5th Street is zoned "0" and is currently
vacant, property to the west is also zoned "0" and is developed with
a concrete spillway for the East Branch of Lytle Creek, The property
abutting the site to the east is zoned "0", R-2, and C-3A which are
developed with a Duplex, single family residences and ccmnercial uses.
The parcel designated "0" is privately owned and is not part of the
requested change of zone,
4, The 23,7 acre parcel has frontage upon 5th, 6th and 7th Street,
however potential access onto 5th Street is limited to right turn
nDVBlEnt only, given its existing aligt1Irent. Primary access would be
from 7th Street or an extension of 6th Street. Additional traffic
analysis will be required upon submittal of a development plan.
The westerly portion of the site is bisected by a 100 foot wide Cali-
fornia Aqueduct right-of-way, The water main is located underground.
Structures would be prohibited within the right-of-way, however it
may be utilized for parking and/or landscaped open space within a
proposed development, Actual restrictions for use of said right-of-way
are subject to permission fraIl the State of California.

The southwesterly one-third of the site is located within the State
designated Geologic special study zone due to the S;m Jacinto fault
which generally extends along the Lytle Creek Wash area. A Geologic
Report will be required through the DeveloplIEI1t Review process in order
to locate any traces of the San Jacinto fault and to establish approp-
priate structural setbacks,
As previously indicated the primary portion of the site is within the
General Plan designation of Residential 8-14 units per acre to which
the requested change of zone is in confonnance. The westerly portion
of the site, currently desi']13ted for Flood Control is no longer con-
sidered applicable per the clearance rramrand:..llIl from the Cotmty Flood
Control District, The c~cial designation located along the sou-
therly portion of the site would not be considered applicable given the
parcel orientation and limited access onto 5th Street.
RECCM1ENDATION:
Based upon the preceeding observations relative to the current general plan
designation and the resolution of any flooding potential the Planning
Department recarmmds approval of the request Change of Zone and adoption
of the Negative Declaration.

Dear Mr. Schum a:
The San Bernardino County Flood Control District requests that its zone change be amended
from R-3-3000 to PRD-5. As you know, we had agreed to meet and discuss the zone change
proposal with the community at the July 16, 1985 Planning Commission Hearing. As a result of
the July 31, 1985 Community meeting it was decided to amend our request. The Flood Control
District recognizes the neighborhood's concerns to keep the single family character of the area
and desires to be responsive to the community.
The PRD-5 zone appears to be an equitable solution to the neighborhood concerns while
accounting for the characteristics and opportunities of the site in question. The PRD-5 zone
would provide the single family (R-l) density (5 units per acre) and appearance while promoting
superior design. Flexible lot patterns would allow for proper utilization of the site and provide
greater opportunities to improve capability with adjoining uses.
This property is better situated than the existing residential uses located northerly of the
subject site. It is well buffered by the existing concrete channel from the access road used by
Fourth Street Rock on property owned by the Flood Control District. It is also well removed
from and is substantially further away than existing residential uses, to the reclamation areas
north of the zone change area. We are pleased to have been informed by a representative of
Fourth Street Rock at the community meeting that their Company uses state of the art dust
control measures and they do not have a significant nuisance problem.
