Agency and the Local Development Company (LDC) entered into a Reciprocal Easement Agreement (REA) for the maintenance of the cOlDlllOn areas within Central City West. In 1980 the LDC was the developer for the complex. The LDC sold and developed a number of the sites. The balance of the eites were transferred from the LDC to the Economic Development Council. The covenants under the REA extend to successors and assigns of the property. The duration of the REA was five years with rights to extend. The five years has thus expired (February 1985) and should be extended to assure continual maintenance of the areas. The extension proposed is for 50 years. The following is a brief review of the provisions of the agreement: 1) Public Areas are for free public parking use, pedestrian and vehicular traffic and unloading operations. 2) The City is designated as the responsible party for maintenance and repair of the public area (The City is the property owner of the public areas). All other parties shall maintain their individual sites. 3) Provisions/Regulations are set forth for construction, alterations, signs, easements, design and insurance coverage.
