STAFF REPORT
The purposed project is to upgrade street lighting in the Wilson Housing
Project area to meet the same standards as other street lighting in the
city.
Funding for this project was requested and approved by Community Develop-
ment Commission as outlined in the memorandum of understanding.
Southern California Edison Company has completed a review of the street
lighting in this area and has agreed to upgrade 29 lights to HPSV luminaires,
with new mast arms and related items. The facilities would then be conveyed
to the city by Southern California Edison Company through eminent domain
action.
Operation, maintenance and utility cost would then become the responsibility
of the city. Staff is recommending the adoption of proposed resolution.

2 RESOLUTION OF THE CITY OF SAN BERNARDINO MAKING FINDINGS AND
DETERMINATIONS RELATING TO THE NECESSITY OF ACQUIRING WOODEN
3 POLES, ARMS, BRACKETS, LUMINAIRES AND PHOTO-ELECTRIC CONTROLLERS
FOR OPERATION AND MAINTENANCE BY THE CITY OF SAN BERNARDINO OF A
4 STREET LIGHTING SYSTEM IN THE AREA OF T_ENTH STREET, CONCORD
STREET, TEMPLE STREET AND ALTURAS STREET; WESrO~' CABRERA AVENUE
5 AND .UtiIONSTjH:~:T AN!) MARLE STRF.ET WES'r-eF(WILSON STREET, AND--
AUTHORIZING THE CITY ATTORNEY TO COMMENCE AND PROSECUTE EMINENT
6 DOMAIN PROCEEDINGS.
7 BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:

9 WHEREAS, the City of San Bernardino intends to acquire the
10 hereinafter described property for a public use and improvement,
11 to wit: an electrical street lighting system; and
12 WHEREAS, the acquisition of the hereinafter described
13 property is authorized by the provisions of the Constitution of
14 the State of California, Article I, Section 19, and California
15 Code of Civil Procedure, Sections 1240.110 and 1240.610; and
16 WHEREAS, written notice pursuant to the California Code of
17 Civil Procedure Section 1245.235 has been given by first class
18 mail to each person whose property is to be acquired; and
19 WHEREAS, fifteen days have elapsed since such notice was
20 mailed and thereafter it had been requested by such persons that
21 they have the right to appear and be heard on matters referred to
22 in California Code of Civil Procedure, Section 1245.230; and
23 WHEREAS, the Mayor and Common Council, the legislative body
24 of the City of San Bernardino, has held a hearing on August 5,
25 1985, at which time all persons described were given the right to
26 appear and be heard; and
27 WHEREAS, the Mayor and Common Council has duly heard and
28 determined the matter,

1 NOW THEREFORE BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL
2 OF THE CITY OF SAN BERNARDINO:
3 SECTION 1. It is hereby found and determined that the
4 public interest and necessity require the acquisition by the City
5 of San Bernardino of certain public improvements to wit: the
6 wooden poles, arms, brackets, luminaires and photo-electric
7 controllers which form the street lighting system in the area
8 described on the maps attached hereto as Exhibits "A" and "B" and
9 made a part hereof as though fully set forth at this point. An
10 inventory of said fixtures is currently owned and maintained by
11 Southern California Edison Company. A "Southern California
12 Edison Company Inventory of Street Lighting Facilities Serving
13 the San Bernardino Housing Authority Involved in Proposed
14 Condemnation by the City of San Bernardino" is attached hereto as
15 Exhibit "c" and made a part hereof as though fully set forth at
16 this point.
17 SECTION 2. It is further found and determined that the
18 public interest and necessity require, for the construction and
19 completion of said improvements, the acquisition by the City of
20 San Bernardino of title or interest in said property situated in
21 the City of San Bernardino, County of San Bernardino, State of
22 California, and said acquisition is authorized by the provisions
23 of the State of California Constitution, Article I, Section 19,
24 and Sections 1240.110 and 1240.610 of the Code of Civil
25 Procedure.
26 SECTION 3. It is further found and determined that said
27 public improvement is planned and located in a manner which would
28 be most compatible with the greatest public good and least

1 private injury.
2 SECTION 4. It is further found and determined that the
3 property described in Exhibit "c" is necessary for the proposed
4 project.
5 SECTION 5. The City Attorney of the City of San Bernardino
6 is hereby authorized to bring an action in the Superior Court of
7 the State of California, in and for the County of San Bernardino,
8 in the name of the City of San Bernardino to acquire, by eminent
9 domain proceedings, the property described in Exhibit "C".
10 SECTION 6. The City Clerk shall certify to the adoption of
11 the Resolution by the Mayor and Common Council of the City of San
12 Bernardino and the same shall be in full force and effect upon
13 its adoption.
