',STAFF REPORT
The original annexation. consisting of 73 acres, was expanded to
approximately 325 acres by L.A.F.C.
Prior to the hearing whi~_ the City must have as the conducting
authority, 2 resolutions;;;"'ouetermining the amount of property tax
revenue to be exchanged between the City and County resulting from
the jurisdictional change decribed by L.A.F.C., must be passed.

annexation; however, with the boundary change by L.A.F.C., another
resolution must be passed which would include the additional area.
We recommend that the resolution be adopted. (See attached.)
URGENCY CLAUSE:
The City of San Bernardino must pass a resolution within
15 days after the passage of a resolution by the County
Board of Supervisors in regard to the juriSdictional
changes affecting taxes. The County Board of Supervisors
will pass their resolution on July 15. 1985.
Also before the hearing of protest for this proposed
annexation. this resolution must be passed. The hearing
is set for August 19. 1985.

RESOLUTION NO,
RESOLUTION OF THE CITY OF SAN BERNARDINO DETERMINING
THE AMOUNT OF PROPERTY TAX REVENUES TO BE EXCHANGED BETWEEN THE
CITY OF SAN BERNARDINO AND THE COUNTY OF SAN BERNARDINO
RESULTING FRO~l THE JURISDICTIONAL CHANGE DESCRIBED BY LAFC NO.
2323 AND REPEALING RESOLUTION NO. 85-148.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE
CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. Reci tal s. The Mayor and Common Counci 1 of
the City of San Bernardino hereby find and determine that:
A. Pursuant to Section 99 of the Revenue and Taxation
Code, prior to the issuance of a certificate of filing by the
Local Agency Formation Executive Officer, the governing bodies
of all local agencies whose service area or service responsi-
bilities will be altered by a proposed juriSdictional change
will negotiate and determine by resolution the amount of
property tax revenues to be exchanged between and among such

B. Except as provided in Section 99.1 of the Revenue
and Taxation Code, in the event that a jurisdictional change
would affect the service area or service responsibility of one
or more special districts, the Board of Supervisors of the
County of San Bernardino shall, on behalf of the district or
districts, negotiate any exchange of property tax revenues.
C. The Mayor and Common Council of the City of San
Bernardino and the Board of Supervisors of the County of San
Bernardino have determined the amount of property tax revenues
to be exchanged as a result of the juriSdictional change des-

cribed by LAFC No. 2323 which was expanded by the Local Agency
Formation Commission.
SECTION 2. Implementation.
A. The negotiated exchange of property tax revenues
between the City of San Bernardino and the County of San
Bernardino attached hereto as Exhibit "An and incorporated
herei n by reference. resul ti ng from the above descri bed
jurisdictional change, is hereby approved and accepted. The
column entitled "Estimated Current Tax Revenue" shall represent
the amount of property tax revenues for the current year to be
paid to the County of San Bernardino and its affected agencies.
B. The annual tax increment generated in the area
subject to the jurisdictional change and attributable to the
Local Agencies whose service area or service responsibilities
will be altered by the proposed jurisdictional change shall be
allocated in the future'years pursuant to the provisions of
Section 98 of the Revenue and Taxation Code.
SECTION 3. The boundaries of L.A.F.C. 2323 have been
expanded; therefore Resolution No. 85-14B is hereby repealed.
SECTION 4.
The City Clerk of the City of San
Bernardino is hereby directed to certify to the passage of this
resolution and to cause a certified copy to be sent to the
Executive Officer of the Local Agency Formation Commission of
the County of San Bernardino.
