C~Y OF SAN BERNARdi\.O - REQaQT FOR COUNCIL AalON STAFF REPORT Page 1 of 2 The Engineering Services Agreement with C M Engineering Associates stipulated not to exceed fees for Phase I - Preliminary Engineering, Phase II - Design Engineering, and Phase IV - Supplemental Services. Phase III is for Construction Services, Escalation provisions were included in the Agree- ment for these fees to be adjusted to account for increased costs due to inflation, Amendment No, 1 authorized an increase of $105,953 in the maximum fee in order to reimburse C MEngineering Associates for the preparation of plans and specifications for an alternate bid for reinforced box girders, C M Engineering Assot.iates has requested, by letter dated 5-2-85, adjustments in the maximum fees to compensate them for additional services not covered in the original Agreement. These adjustments would constitute Amendment No, 2 to the Engineering Services Agreement, The summary attached to C M Engineering's letter shows the maximum fees for Phase I to be reduced from $l60,744,33 to $141,355,53, and for Phase II to be increased from $181,549,90 to $2l2,046,84, in order to reflect actual costs incurred. The fees for Phase IV will be reduced to 0, since neither an Environmental Impact Statement or public hearing was required, It should be noted that the net increase of $8,993.21 is less than the fee of $lO,265.07 for design of the City Water Line relocation, which was directed by the City as a right-of-way obligation. Listed below is the latest estimate of cost for preliminary engi- neering and right-of-way acquisition. BE IT RESOLVED 8Y THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION l, The Mayor is hereby authorized and directed to execute, on behalf of the City, the letter agreement which constitutes Amendment No. 2 to the Engineering Services Agreement for the improvement of Tippecanoe Avenue Bridge, entered into the 2nd day of September, 1980, by and between the City of San Bernardino and C M Engineering Associates, A copy of the letter agreement constituting Amendment No, 2 is attached hereto and incorporated herein by reference. Certain additional services were provided that would be classified as Supplemental Services (Paragraph D4 Phase IV) or Extra Work (Paragraph D5 Changes in Work Scope). These additional services included: l. Coordination with County of San Bernardino and review of right-of way acquisitions (B2). 2. Preparation work Environmental Impact Statement (D4). 3. Preparation work public hearings and meetings (D4). 4. Relocation, design and specifications for 16-inch City water line, completed at City request. 5. Coordination with Southern California Edison Company on location and protection of 115 KV Transmission Lines 350 feet downstream from project limits. 6. Additional coordination and negotiation with Gage Canal Company and City of Riverside for right-of-way approval and design plan requirements. The majority of the extra work was for the relocation design, and speci- fications for the City's l6-inch water line. HARDGRAVE t1ay 2, 1985 Page Two An early attempt to set up a separate account for the water line relocation (item #4) resulted in your request to include costs as part of Design Engineering (C M Work Order No. 03-78-11-02). The result of discussions was that maintaining separate costs for additional extra work items was difficult and subsequent discussions with Cal-Trans concluded that when project work was completed, any overages would be ar- ranged for payment. Please confirm that the entire contract cost for services can be handled as one total sum instead of separate or different increments or sections of the contract. Adjustments are to be made for individual sections with this letter and Amendment No.2. Attached is a summary of status of compensation and requests for payment. The local office of the California Department of Transportation has con- firmed that this type of letter would suffice if the City was in agreement with the changes requested. If the above meets with your approval, please feel free to either have the necessary City signature approval on this let- ter or forward a separate letter of approval and authorization.
