Synopsis of Previous Council action:
April 26, 1985 - Council adopted Resolution No. 85-173 accepting
the covenant of James E. Massey and Carol A.
Massey not to transfer the property located at
872 N. Arrowhead Avenue as commercial property.
Acceptance of the covenant by the City Clerk
was made contingent on:
(1) receipt from the Masseys of a written
agreement to remove the sign from the property
and not to erect another sign;
(2) sign to be removed within 45 days from the
date of Council action.
Recommended motion:
Instruct City Attorney's Office to commence abatement proceedings.

STAFF REPORT
Following the Council action of April 26, 1985, an agreement
was prepared by the City Attorney and forwarded to the Masseys
for their signature. The agreement reflected the requirement,
imposed by the Council, that the sign advertising Massey
Insurance at 872 N. Arrowhead be removed. The agreement was
mailed to the Masseys on June 10, 1985. On July 3, John Wilson,
Deputy City Attorney, spoke with Mrs. Massey by telephone.
She stated that she had filed a request to be heard by the
Mayor and Common Council to ask for relief from this condition.
