taken:
The application for Conditional Use Permit No. 84-78 was approved based upon findings
of fact contained in the staff report dated June 4, 1985 and subject to the conditions
and standard requirements listed therein and as modified by the Planning Commission.
The Negative Declaration for Environmental Review was approved.
The Planning Commission unanimously approved Conditional Use Permit No. 84-78.

Dear Members of the City Council:
On behalf of the San Bernardino City Unified School
District ("District"), we hereby appeal the approval of the
Negative Declaration for Conditional Use Permit 84-78
("Project") by the Planning Commission of the City of San
Bernardino on June 4, 1985. The project is a 580 unit apart-
ment complex located on the south side of Kendall Drive
approximately 1000 feet east of Little Mountain Drive.
This appeal is requested because the adverse impact of
increased enrollment on the Project has not been mitigated to
insignificance by the approved mitigated Negative Declaration,
The California Environmental Quality Act ("CEQA") requires
that the significant effects of a project and the cumulative
effects of past, present, and probable future projects be
considered in the environmental review process and that the
significant effects of a project be mitigated. El Dorado

According to the current student generation factor, this
Project will yield 296 elementary school students, 64 inter-
mediate school students and 52 high school students. These
students will attend Newmark Elementary School, Shandin Hills
Intermediate School and Cajon High School. Newmark Elementary
School has a capacity for 519 students, a current enrollment
of 448 students and 550 additional students expected from
current development which has received one or more discretion-
ary approvals from the City or County of San Bernardino.
Shandin Hills Intermediate has a capacity for 950 students, an
enrollment of 908 students and an additional 673 students
expected from approved development. Cajon High School has a
capacity of 2476 students, an enrollment of 1943 students and
an additional 707 students expected from approved develop-
ment.
Clearly, this Project will have a significant adverse
effect on District schools. The Project's adverse impact is
further compounded by the cumulative effects of other past,
present and probable future projects. The Project must not be
approved without mitigation of its adverse impact on
District.
In its letter of June 4, the District requested that a
condition in mitigation be imposed. The requested condition
is set out in full in the letter. The condition as requested
by the District was not imposed and the approved mitigated
Negative Declaration does not mitigate the adverse impact of
the Project.
The legislative review committee of the City Council at
its meeting held on June 6, 1985, dLi recommend to the City
Council that a mitigation fee be imposed based on the
District's mitigation fee of $1827 for each single-family
residential upit and $1663 for each multi-family residential
unit. The imposition of that fee by the City Council will
mitigate the impact on the schools of the District, It is
requested that the City Council approve the imposition of the

Dear Members of the Commission:
On your agenda for June 4, 1985, for approval is a
Negative Declaration for Conditional Use Permit 84-78. The
project woUld create a 580 unit apartment complex on 29.5
acres on the south side of Kendall Drive approximately 1000
feet east of Little Houtain Drive.
San Bernardino City Unified School District has
instructed us to inform you that the intended residential use
of this site is expected to generate 412 school-age children
who will attend District I s school s. This will further burden
District facilities and will add to a condition of overcrowd-
ing which now exists within the District in many of District's
school s. The District has informed both the City and County
of San Bernardino of the situation by a Declaration of
Impaction.
The District has determined that 944 single-family units
and 1003 multi-family units are currently ready for occupancy
wi.thin the District. There are approximately 2938 additional
units under construction and another 5876 units which have
received tentative tract approvals, This would generate an
expected 7419 students for District facilities.

proposed residential development without requiring mitigation
measures to address the problem of increased enrollment
generated by the development. In holding that an increase in

student enrollment is cognizable under the California
Environmental Quality Act, the Court of Appeal stated:
"The EIR should contain sufficient information to
enable public agencies to make decisions that
consider environmental consequences. (Guidelines
~15150.) The EIR here falls woefully short of that
standard. Although the Drsft recognized an increase
in student enrollment, neither report said anything
about the effects of such an increase in the student
population, and suggested no mitigation measures to
deal with such an impact, required by the Guidelines.
(~15143, subds. (a), (c) and (g),) Nor is there any
discussion of the cumulative impact of projects such
as Whispering Pines on District, which CEQA expressly
requires. ( ~21083; Guidelines, ~~ 15023,5, 15143,
subd. (a).) Finally, District had advised the City
in February 1980 the special impact fee it had
imposed would not fully meet its needs. On this
record, we cannot assume City made any evaluation of
the impact of the project, much less the kind of
detailed evaluation CEQA contemplates under these
circumstances." (Emp. in orig.) rd. at 132-133, 485.
Environmental assessment of this project must consider the
cumulative impact of residential development on the District.
A project may have a significant effect on the environment'
when viewed in connection with the effects of past projects,
other current projects and probable future proJects. Public
Resources Code section 21083.
The conclusion that the cumulative impact of residential
development in the District will have a significant impact on
District schools is inescapable, It is the District's position
that all project proponents must share equally in the responsi-
bility for ensuring availability of adequate school
facll ities. >

CEQA requires that ,the significant effects of a project be
mitigated. Public Resources Code ~~ 21002, 21002.1. Mitiga-
tion is defined by Title 14 of the California Administrative
Code ~ 15370, to include:

Avoiding the impact altogether by not taking a cer-
tain action or parts of an action,
Minimizing impacts by limiting the degree or magni-
tude of the action and its implementation.

Rectifying the impact by repairing, rehabilitat-
ing, or restoring the impacted environment.
Reducing or eliminating the impact over time by
preservation and maintenance operations during
the life of the action.
Compensating for the impact by replacing or
providing substitute resources or environments."
It is not the desire of San Bernardino City Unified School
District to impede development. Accordingly, the District
requests that a condition be imposed on this project that prior
to issuance of building permits authorizing residential
construction, the project proponent shall provide certification
from the District that they have agreed to arrangements to
mitigate the impact of this project on school enrollment. The
following language is suggested:

City Unified School District that the project
proponent(s) have paid the impaction fees of $1827 for
each single-family residential unit and $1663 for each

an agreement has been reached with the project
proponent(s) whereby it is assured that adequate
school facil ities will be available to accommodate
students expected to reside in the residential units
which project proponent(s) will construct."

Action
The City Attorney was directed to prepare a resolution on school
impaction fees for adoption by the Couricil on July I, 1985.
The Planning Director and City A&ninistrator,were directed to work
,with the San Bernardino Unified School District to prepare an
evaluation report on estimated revenue and costs for the next
five to ten years based on the dollar amourits, so the City can '
analyze what the fees are providing for and what the needs are.

1. The applicant is proposing to establish a 540-unit apartment complex
located on the southerly side of Kendall Drive between Fourth Street
and Western Avenue, on approximately 29.5 acres in the PRD-30 Zone.
2. The site ,p 1 an submitted i ndi cates th at there will be approxi mate 1y
1,600 feet of frontage onto Kendall Drive. Within this 1,600 feet will
be a 5-foot high slumpstone wall at the front property line. At
, varying lengths of wall (from 35 to 150 feet) there will be as-foot
offset into the lot with the wall rising to six feet in height. The
offsetting wall plan and varying lengths is offset wall and one foot
change in height of the wall will delete the appearance of 1,600 foot
wall all on one plan.
3. Two driveway approaches are planned. One at the northern most portion
of the project site, the second placed approximately in the middle of
the lot. Both driveways with two directional approaches and wi 11 have
a landscaped median in the approach.

4. The interior driveway system will be private and will provide a looping
drive system throughout the development. The driveway system will pro-
vide access to 1,100 parking spaces, 543 of which will be covered. The
parking requi rement for apartments would requi re ,1,008 spaces, 540 of
which are required to be covered. The applicant exceeds the parking
required by 92 spaces (9%).
5. There will be five floor plans being offered for the project. The
description of each floor plan is broken down as follows:

7. The overall development will have approximately 589,500 square feet
(13.53 acres) or 45.87% of open space throughout the project site.
This calculation does not include the natural 9rade along the western
flank of the project site. This grade exceeds 8% and cannot be used in
the open space calculation. Within the project site there are seven
areas of group recreational amenities. These amenities are comprised
of a chi1drens playground (3), swimming pools (2), spas (3). volleyball
court (1). There are recreational activity rooms/laundry areas are
distributed in the project. Walkways are used extensively throughout
the project to guide the'resident throughout the project in landscaped
open spaces.
8. Due to the unbui1dab1e slope that enters the project site from the
south, the net buildable area for the project site is 27.32 acres
rather than the total 29.5 acres for the overall site.
9. Twenty foot wide fire access lanes are provided from the main drive
aisles to a minimum distance prescribed by the Uniform Fire Code in the
event of emergencies. These twenty-foot fire access lanes will be of
decorative stamped material and will give a court-like appearance
rather than for its real use.
10. The elevations which accompanied the development plan indicate a stucco
and wood siding for the buildings. The type of roofing material would
be required to meet the specifications of the City's Fire Marshall.
The only modification we would recommend is a minor change in the roof
overhang on all exterior overhangs.
11. A six-foot high slumpstone wall is proposed along the westerly and
easterly property lines. No wall is proposed along the southern por-
tion of the project being that there is the existing hill Which acts as
a natural buffer.
12. The zoning designation for the site is that of Planned Residential
Development at 30 units per net acre max. This density cap would allow
a development of 820 units. The applicant is proposing 540 units, 280
units less than what the zoning permits and is proposing a net density
of 19.77 units per acre, 66% of what is allowed as a maximum density
for the site.
13. At their regularly scheduled meeting of May 16, 1985" the Environmental
Review Committee issued a Negative Declaration for the project.
14. The submitted site plan does not depict the locations ot the trash
enclosures for the respective project. A revised site plan showing
locations, as approved by the Refuse Division, shall be submitted to
the department prior to the issuance of building permits.

1. The proposed development meets the minimum requirements of the Planned
Residential ,Development Zone.
2. The density of 19.77 does not exceed the 30 units per acre permitted as
a density cap of this PRD Zone.
3. The site is sufficient in size, shape and area to accommodate the pro-
posed 540 unit apartment project.
4. The development exceeds the number of parking spaces required by 9%.
5. Access to the site and the traffic circulation pattern throughout the
si te should have no negative impact to the health, safety, and welfare
to the residents of the project or the community as a whole.

1. A wall as indicated on the approved site plan shall be constructed
along the north, east and west property lines.
2. A landscape maintenance district shall be established for the main-
tenance of the landscaping in the right-of-way and within the 5-foot
offsets adjacent to the Kendall Drive right-of-way.
3. The development shall adhere to the standards and requirements
established by the City of San Bernardino Water Department at the time
of development.
4. A revised plan 'showing locations as observed in Observation No. 14
shall be submitted to the Planning Department prior to issuance of
building permits.
RECOMMENOATl ON
Based on the observations and findings of fact, Staff recommends acceptance
of the negative declaration by the Environmental Review Committee and
approval of the proposed 540-unit apartment project known as Conditional
Use Permit No. 84-78.

STANDARD REQUIREMENTS
RESIDENTIAL DEVELOPMENT
-L CUP No. 84-78' shall be in effect for a period of 12 months from the
date of approval by the Planning Commission and/or Planning Department.
However, if no development has been initiated at the end of the 12 -month
time period the approval shall expire. Additional time may be approved
by the Planning Commission upon request of the applicant prior to expira-
tion of the 12 -month time period. Expiration Date: June 4. 1986.
COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed
and approved by the Planning Department prior to final approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.
b. No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
available features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services, Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
c. Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwe l1i ng unit or lot, ei ther (1) an undi vi ded interest in the com-
mon areas and facilities, or (2) a share in the cqrporation, or voting
membership in an association, owning the common areas and facilities.
d. Maintenance for all landscaped and open areas, including parkways,
shall be provided for in the CC&R's.
e. The CC&R's shall contain wording prohibiting the storage or parking
of trailers, boats, campers, motor homes, and similar vehicles outside
of the specified common areas.

a. This development shall be required to maintain a minimum of/_ parking

b. All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty, provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line. Said wall

All parking areas and vehicle storage areas shall be lighted during h~urs
of darkness for security and protection.
Recreational vehicle storage areas shall be screened by at least a six-foot
high decorative wall with screened gates.
There shall be provided for each unit, within the garage or carport, or
other specifically designated area, a 10ft or other usable storage area
with a minimum of 150 cubic feet in addition to standard utility storage.

Traffic bumps provided on the interior private roads shall be subject to
the City Traffic Engineer's approval.

Prior to issuance of any building permit, access rights shall be granted to
the City for the purpose of allowing access over the private drives within
the project for all necessary City vehicles including fire, police, and
refuse disposal vehicles, and any other emergency vehicles. The documents
covering this matter shall be prepared by the owner and approved by the
Planning Department.
7 All refuse storage areas are to be enclosed with a decorative wall.
Location, size, type and design of wall are subject to the approval of the

The developer shall obtain Planning Department approval of the visual or
engineering design of the proposed wall.
When graded slopes occur within or between individual lots, the slope face
shall be a part of the downhill lot. Exceptions to this requirement must
be approved by the City Engineer.
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Any clubhouse, swimming pool, spa, putting green, picnic areas or other
amenities shall be installed in the manner indicated on the approved site
plan.
During construction the City Engineer may require a fence around all or a
portion of the periphery of the tract site to minimize wind and debris
damage to adjacent properties. The type of fencing shall be approved by
the City Engineer to assure adequate project site maintenance, clean-up and
dust control.
No roof-mounted equipment shall be placed on any building unless screened
as specifically approved by the Planning Department (except for solar
collection panels).
Within 75 feet of any single-family residential district, the maximum
height of any building shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features,
such restrictive height is not practical.
All utility lines shall be installed underground subject to exceptions
approved by the Planning Department and the City Engineer.
No certificate of occupancy shall be issued prior to compliance with these
Standard Requirements as wen as all provisions of the San Bernardino
Muni ci pal Code.

POLICE DEPARTMENT REQUIREMENTS
SECURITY LIGHTING
Lighting levels on the exterior of building is to provide a minimum of one
(1) foot cand1 e of "mai ntai ned" ill umi nati on on the parki ng surface from
dusk until the termination of business each operating day.
All exterior doors to building shall be equipped with an illumination
device capable of providing a minimum of one (1) foot candle of maintained
illumination at ground level during hours of darkness.
All exterior lighting devices are to be inaccessible to common reach or
climbing shall be protected by weather and vandalism-resistant and be
va1dal resistant. All exterior lighting shall be projected so as not to
cast light onto adjoining properties.
All roof openings giving access to the building shall be secured with
either iron bars, metal gates, stamped metal or shall be alarmed and meet
with approval of the Police Department.
Interior night lighting shall be maintained in those areas that are visible
from the street (ground floor only).
DOORS, LOCKS, AND WINDOWS
Swinging exterior glass doors, wood or metal doors with glass panels, solid
wood or metal doors shall be constructed or protected as follows:
x a. Wood doors shall be of solid core construction with a minimum thickness
of 1 3/4 inches.

b. Hollow metal doors shall be constructed of a minimum equivalent to six-
teen U. S. guage steel and have sufficient reenforcement to maintain
the designed thickness of the door when any locking device is installed
such as reenforcement being able to restrict collapsing of the door
around the locking device.
c. Except When double cylinder dead bolts are utilized, any glazing uti-
lized within 40' of any door locking mechanism shall be constructed or
protected as follows: Fully tempered glass or rated burglary resistant
gl azi ng or iron or steel gri 11 s of at 1 east 1/8" me~a 1 with the maxi mum
2" mesh secured on the inside of the glazing may be utilized or the

x a. A single or double door shall be equipped with a double or single
cylinder dead bolt. The bolt shall have a minimum projection of I" and
be constructed so as to repel cutting tool attack.
x b. The dead bolt shall have an embedment of at least 3/4" into the strike
receiving the projected bolt. The Cylinder shall have a cylinder
guard, a minimum of five pin tumblers and shall be connected to the
inner porti on of the lock by connecti ng screws of at 1 east 1/4" in
diameter. The recommendation does not apply when panic hardware is
required or an equivalent device is approved by the Building Code.
Double doors shall be equipped as follows:
a. The active leaf of double doors shall be equipped with metal flush
bo lts havi ng a mi ni mum embedment of 5/8" into the head and threshho1 d
of the door frame. Double doors shall have an astragal constructed of
stee 1, a mi ni mum of .125" thi ck whi ch wi 11 cover the openi ng between
the doors. This astraga1 shall be a minimum of 2" wide and extended a
minimum of 1" beyond the edge of the door to which it is attached. The
astragal shall be attached to the outside of the active door by means
of welding or with nonremovable bolts spaced apart on not more than 10"
centers. Hinges for outswinging doors shall be equipped with nonremo-
vable hinge pins or a mechanical inner lock to preclude removal of the
door from the exterior by removing the hinge pins. Strike plates shall
be a mi ni mum of 3i" in 1 ength and secured to the jamb wi th screws a
minimum of U" in length.

b. Where sliding or accordion doors are utilized, they shall be equipped
with guide tracks which shall be designed so that the door cannot be
removed from the track when in the closed and locked position.
c. Doors that exceed sixteen (16) feet in width shall have two (2) lock
receiving points; or, if the door does not exceed nineteen (19) feet, a
single bolt may be used if placed in the center of the door with the
locking point located either in the floor or door frame header.
d. Overhead doors shall be equipped with slide bolts which shall be
capable of utilizing padlocks with a minimum nine-thirty-seconds (9/32)
inch shackle.
(1) Slide bolt assemblies shall have a frame a minimum of .120 inches
in thickness, a bolt diameter a minimum of one-half (i) inch and
protrude at least one and one-half (Ii) inches into the receiving
guide. A bolt diameter of three-eights (3/8) inch may be used in a
residential building.
(2) Slide bolt assemblies shall be attached to the door with bolts
which are nonremovable from the exterior. Rivets shall not be used
to attach such assemblies.
e. Padlocks used with exterior mounted slide bolts shall have a hardened
steel shackle a minimum of nine-thirty-seconds (9/32) inch in diameter
with heel and toe locking and a minimum five (5) pin tumbler operation.
The key shall be nonremovab1e when in an unlocked operation.
f. Doors utilizing a cylinder lock shall have a minimum five (5) pin
tumbler operation with the bolt or locking bar extending into the
recei vi ng gui de a mi ni mum of one inch.

An access control override device shall be provided for use by Police
Department personnel to gain immediate access;
Common walls shall be as sound proof as possible.
Lockable cold beverage (beer) cases shall be locked at 2:00 a.m.
A pre-set gas monitoring system that allows for prepayment of gasoline
shall be installed to reduce petty theft attempts.
A photo-electric beam across entry door which will audibly notify or ring

GENERAL
~ An grading shall be done in compliance with Title IS of the Municipal Code
and the requirements of the City Engineer. The site/plot/grading plan sub-
mitted for a building permit shall contain sufficient ground elevations

A handicap ramp shall be constructed at the intersection(s) and the
necessary right-of-way dedicated to accommodate the ramp as required by
the City Engineer.
All required dedications shall be completed prior to the issuance of a
building permit. The developer shall consult with the Engineering
Division concerning the processing of dedications.
For the streets listed below, dedication of adequate street right-of-
way to provide the distance from street centerline to property line and
placement of the curb line in relation to the street centerline shall
