Synopsis of Previous Council action:
At the meeting of the Planning Commission on June 18, 1985, the following action was
taken:
The application for Conditional Use Permit No. 85-30 was approved based upon findings
of fact contained in the staff report dated June 18, 1985 and subject to the conditions
and standard requirements listed therin and as modified by the Planning Commission.
The Negative Declaration for environmental Review was approved,
The Planning Commission unanimously approved Conditional Use Permit No. 85-30.
Recommended motion:
To approve the responses to comments and to adopt the Negative Declaration for r.nvi-
ronmental Review.
To approve, modify or reject the findings and the recommendation of the Planning
Commission.

My clients hereby appeal the conditions of approval for Cond1tional Use Pe~t N~ 85-30.
The proposed use is a vehicle towing. storage. and impound yard with supporrting ~pair
and incidental ornamental iron fabrication. The subject property is 2.1 acres i~size
and is generally located on the south side of Walnut Street. approximately 726 feet
west of Artesia Street (APN 274-031-01).

Dear Honorable Mayor and City Council:
Tri-City Towing has been operating at their current location on the south side of 9th
Street between "E" and "0" Streets for approximately eight years. During that time
they have conducted business under license from the city. However, they were recently
notified that their use is not permitted in the existing C-3 zone and ordered to stop
operation.
Tri-City Towing is making every effort to comply with the city's request; hO\1eVer,
finding a suitable property at a reasonable cost with existing facilities was
difficult at best. Because of the cost of property, imp<rovements, and relocation,
we require the assistance of the Mayor and City Council to make this move affordable
and feasible.
The owners of Tri-City Towing are proposing the following improvements at the Walnut
Street property:
1. Remove dismantled vehicles, parts and other junk from the previous business
owned by others.
2. Remove weeds. debri~.:llnd two old metal sheds.
3. Repair existing house which will be utilized as an office and dispatch center.
4. Install decorative iron fence and landscaping in front portion of the site.
5. Repair existing chain link fence and install high quality vinyl coated
aluminum slats. . .
6. Repave existing driveway and expand paved parking area.
7. Utilize the existing industrial building <fo~ ornamental iron work, supportive
automotive repair and secured vehicle storage.
8. Sterilize soil in impound yard and cover with slag and gravel.

We respectively request the following changes to the conditions of approval:
Condition No.1: Allow the use of the existing chain link fence with vinyl coated
slats and dense landscaped hedge per revised development plan. A six foot wrought
iron fence shall be errected along the front, east and west property lines to
impound yard area.
Reason for Change: Chain link fence with slats have been used effectively for
similar uses. It is easily repaired. The subject property is adjacent to
'existing M-l property which will ultimately be developed with industrial uses.
There is amajor'utility corridor' and railroad line operation which buffers
views from the south. The parking layout and landscaping adequately buffers
the mobile home park on the north side of Walnut. Section 19.62.070 of the
zoning code allows six foot fences to be installed along the front property
lines. In addition, Section 19.36.080 required block walls when M-l types
of uses abuts a residential district. Section 19.36.030 allows the use of
chain link fence. Tri-City Towing is unable to afford $50,000.00 of block
wall improvements.
Condition No.3: Delete condition.
Reason: Two houses are utilized in an auto dismantling yard located across the
street from subject property. Proposed landscaping will help screen the office.
Condition No.4: Approve landscaping as shown on revised plan.
Reason: Proposed landscaping adequately complies with existing city openspace
standards.
Condition No.5: Delete condition.
Reason: Existing house is five feet from the property line. Fence would set
against the exterior wall of the house. The five feet front setback will be
landscaped per revised plan. The revised plan now specifies wrought iron fence
which can be located at the property line (Section 19.62.070).
Condition No.6: Delete condition.
Reason: Revised plan have been submitted for City Council review.
Standard Requirement No. 3: Approve location of refuse bins per revised plan.
Reason: Refuse bin is adequately screened from public view and is easily
accessible.

Standard Requirement No.4: Amend condition to read - landscaping shall be installed
per revised development plan.
Reason: Revised plan adequately provides for landscaping.

Standard Condition No.9: ,Delete condition
Reason: Electrical service is currently provided.
Standard Condition No. 10: Delete condition and allow immediate occupancy of property.
Reason: This will allow Tri-City Towing to vacate current property and eliminate
the alleged zoning violation. Tri-City Towing will no longer have to pay double
rents so more money will be available to improve the property. It will be easier
to make the necessary improvements while operating from the facilities currently
on the property.
Standard Condition No. 11: Approve sign location on fence per revised plan.
Reason: Sign is logically located at the entrance.
Staff has stated that Tri-City Towing is requesting that slag or gravel be utilized in
lieu of the "required two inch AC paving requirement within the impound/storage area.
We feel that the code (Section 19.56.370) does not require paving in such areas. The
impound area is not a "parking" area in the true sense of the word. ,Jr
The use of AC paving is not practical in impound yards. Wrecked and impounded vehicles
frequently leak fluids that cause rapid deterioration of the paving. Factored with the
length of time lien sale vehicles are required to be held, paving would be literally
destroyed. Frequent and expensive repairs would be required. A combination of soil
sterilization and slag/gravel will act as an effective weed, dust. and erosion control
measure. In addition, slaglgrave1 will minimize fire hazards.
The paving of approximately two acres of land is cost prohibitive. Based upon this and
the above stated reasons, we request the use of slag and/or gravel in the impound area.
In order to begin operation at the subject property and allow for the necessary funds
to be earned to complete the improvements, we request the following considerations:
1. Wave paving requirement for six months.
2. Allow one year for installation of landscaping.
3. Allow two years for the repair of the chain link fence and installation of
the slats.
4. Allow six months to install wrought iron fence.
We feel this project will be an asset and an improvement for the area and will be
compatible with surrounding uses. .
Tri-City Towing wishes to convey to the Mayor and City Council that they have approached
their business in an open and honest manner. They have obtained all licenses as requir~d
by the Franchise Board and have had on-site inspections by the City. City licenses have
also been issued. Tri-City Towing wishes to continue providing a service to the communit

as well as locate in an area the city feels compatible. '
Because of the City's effort to remove abandoned vehicles from the streets and the
extended lien hold times now required by the State. additional impound space is required.
Abandoned vehicles is not profitable because it costs more to handle the vehicles than
they receive from the scrap value. but this is a traditional part of the business and
a service to the community. '
The conditions of approval make it economically prohibitive to move. If Tri-City Towing
is forced out of business by high costs. out-of-town companies will ,.fill the demand. The
services will be provided by outside interests and not a locally owned and operated
business. Money that would have otherwise been spent in the community will be spent
elsewhere. Further. the level of service will probably be decreased by a lack of local
commitment.

1. The applicant requests approval to permit an automobile towing
impound yard, auto repair and incidental ornamental iron fabrica-
tion in the M-1, Light Industrial Zone at a site having a fron-
tage of 143 feet on the south si de of Walnut Street and bei ng .
located approximately 726 feet west of the centerline of Artesian
Street and further described as 1661 Walnut Street.
2. An automobile impound yard is a permitted use, in the M-1 Zone
with approval of a conditional use permit. A conditional use per-
mit is requi red to insure that the use wi 11 be compati ble wi th the
surrounding properties through the implementation of adequate
screening of the storage areas.
Through the conditional use permit process, the applicant may
request waivers of specific standards and the commission may grant
a waiver when such waiver is found to be not contrary to the fin-
dings of fact required for granting said conditional use permit.
The applicant is requesting a waiver of the pavement requirement
for six months, allow the use of slag or gravel in the vehicle
storagelimpound area in lieu of pavement, utilize the existing
chainlink fence and to allow the existing non-conforming single-
family residence to be converted to an office and security
quarters. (See attached letter dated May g, 1985)
3. The applicant has indicated that currently Tri-City Automobile
Towing Impound Yard exists in the C-3, General Commercial Zone
located on the south side of 9th Street Between "0" and liE"
Streets. They were notified that the use is not permitted in the
C-3 Zone and are attempting to comply with the City of San
Bernardino Zoning Ordinance by relocating to an appropriate zoning
district, specifically an M-1, Light Industrial Zone.
4. The site and surrounding properties are zoned M-1, Light
Industrial with the exception of the property to the north which is
zoned M-2, General Industrial, M-1, and R-3-1200,. Multiple-Family
Residential. The City of San Bernardino General Plan designates
the site and surrounding properties for General Industrial land
uses. Surrounding land uses consist of an automobi~e dismantling
and storage facility, legal existing non-conforming single-family
dwelling and a mobile home park to the north, a vacant SCE utility
corridor to the south, vacant property and legal existing non-
conforming single-family residences to the east and vacant pro-
perty and the continuation of the SCE utility corridor to the west.

5. The subject neighborhood is in the early stages of transition from
single-family residential to industrial.
Impound yards are typically associated with large numbers of auto-
mobiles, trucks and motorcycles in various stages of operability.
In the M-1 Zone any use is required to install a five foot high
chain link fence or block wall around the entire site.
The submitted site plan indicates that a six foot high block and
wrought iron fence will be located on the front property line,
with a five to six foot high chain link fence on the south, east
and west property lines.
The existing single-family dwelling currently exists five feet
back from the property line. In the M-I Zone a six foot setback
is requi red, however, si nce the house is exi sti ng, thi s requi re-
ment does not apply to the dwelling. The proposed block and
wrought iron fence however is required to be set back, at least
to the exi sti ng structure wi th that fi ve foot area in front
suitably landscaped. A condition is included.
To insure compatibility with the surrounding properties and future
deve 1 opment wi thi n the area and to a 11 evi ate the possi bi 1 ity of a
negative impact upon adjacent property values, staff is recom-
mending a 6 foot high wrought iron fence along the east and west
property lines form the proposed front fence to the existing
Oleanders and a six foot high block wall enclosing the entire
southern portion of the site, and extending accross the parcel to
the south of the existing Oleander bushes, to separate the
impoundlstorage yard and ornamental iron fabrication from the
officelsecurity quarters and parking lot. A condition is
included.
6. The proposed incidental ornamental iron fabrication and automobile
repai r wi 11 be conducted enti rely withi n an exi sti ng 2,400 square
foot metal building. A 24 foot wide paved area is proposed to the
east of said building to provide access to the building and to the
storage and impound area. The applicant is requesting that the
impound and storage area be permitted to utilized siag or gravel
in leiu of the 2 inch AC pavement requirement.

Typically, slag becomes worn and thin in certain places, espically
wi th 1 arge tow trucks and cars dri vi rig and parki ng on it. ~Ieeds
begin to grow through, creating an even more unsightly condition
than that l<It1ich would be normally associated with an impound and
storage yard. Staff contends that to waive the paving requirement
may be detrimental upon adjacent and surrounding property values.
The submitted site plan indicates that a paved parking area acco-
modating sixteen (16) vehicles, ten (10) of which are oversized to
accomodate tow trucks, the applicant is requesting a waiver of the
pavement requirement of said parking lot an previously mentioned
24 foot wi de stri p to the east of the exi sti ng metal bui 1 di ng for
six (6) months.
7. The San Bernardino Municipal Parking Ordinance does not specifi-
cally address the number of parking spaces required for an automo-
bilelimpound storage yard. The architect has indicatd that the
type of business is unique in that the majority of the employees
are on-call and do not drive their personal vehicles to the site.
The tow-truck dri vers are at thei r home wi th the tow-truck. A
dispatcher calls them at their home, they drive to the site,
pick-up the impared vehicle and drop it off at the subject site.
The tow-truck dri ver then returns home wi th the truck. . The archi-
tect also indicated that there may be a maximum of four tow-trucks
at the site at anyone time. In the office there may be one to
two employees with one to two employees occasionally working in
the auto repair section. He also indicated that the auto repair
is incidental, and is intended for the vehicles that are,towed to
the site. The architect estimated that approximately one-fourth
of the building would consist of auto repair, one-fourth for occa-
sional ornamental iron fabrication and one-half of the buildihng
will be used for secured auto storage When the Police Department
Requests it.
Based upon the limited number of employees, the nature of the
business and the total number of tow trucks on-site at anyone
time, staff contends that the proposed sixteen parking spaces is
adequate.
8. The submitted site plan indicates that the existing'single-family
dwe 11 i ng wi 11 be converted to an offi ce and security quarters. In
conversations with the architect it was revealed that approxima-
tely half of said structure will be utilized as an office con-
si sti ng of a front counter wi th a lounge, an area to store thei r
computers and an area for the radio dispatch equipment for AAA.

The architect indicated that the kitchen and two restrooms will
remain to provide the drivers and dispatcher with minimal ameni-
ties. There ~ll be someone on the premises at all times,
however, the structure ~1l not be utilized as a residence. When
one employee's shift is over, another will come on.

Photos submitted to the Planning Department indicate that the
exterior of the structure has not been finished. The applicant
has proposed to color-coat the structure in a color similar to the
slump stone wall in the front.
The M-1 Zone does not specifically address the conversion of a
single-family dwelling to an office building, however, staff is
recommending that the exterior of the structure be modified so as
to not resemble a single-family dwelling. A condition is

9. In the M-1 Zone a six-foot wide landscaped setback is required.
when the property is not abutting an arterial street. The
existing single-family dwelling is located five feet from the
front property line, therefore that area can remain as five feet.
The remaining frontage must maintain a minimum of a six foot wide
landscaped setback which the site plan does reflect.
The site plan also indicates that there are large areas on the
east and west sides of the parking lot that will be left open.
Those areas are required to be fully landscaped including berms.
A condition is included.
10. At the Environmental Review Committee Meeting on May 30, 1985 the
project was recommended to be issued a negative declaration with
the observation that the site is located within the Alquist Priolo
Special Study Zone. The project was not required to prepare a
geology report because the single-family residential structure is
existing and because there will be a limited number of occupants
on site.

1. The proposed impound yard with incidental auto repair and ornamental iron
fabrication will conform to the City's General Plan designation of'General
Industrial upon approval of a conditional use permit.
2. The proposed use will not adversely affect the adjoining land uses and the
growth and development of the area in which it is proposed to be located
subject to the attached conditions.
3. The two acre irregularly-shaped lot is adequate to allow the full develop-
ment of the proposed use in a manner not detrimental to the particular area
nor to the health, safety or general welfare, subject to the attached con-
ditions.
4. The traffic generated by the impound yard will not have a negative impact
upon Walnut Street and adequate parking has been provided.
5. The granting of Conditional Use Permit No. 85-30, under the conditions
imposed, will not be detrimental to the peace, health, safety and general
welfare of the citizens of the City of San Bernardino.
6. At the Environmental Review Committee meeting on May 30, 1985 a negative
declaration was recommended.

STANDARD REQUIREMENTS

__L- Condo Use Permit No. 85-30 shall be in effect for a period of 12 months
from the date of approval. However, if no development has been initiated at
the end of the l2-month period, the application shall expire. Additional
time may be approved upon request of the applicant prior to expiration of
the l2-month period. Expiration Date: June 18 1986

.~ PARKING:
a. This development shall be required to maintain a minimum of l&- stan-
dard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line.
d. Whenever an off-street parking area is located across the street from
property zoned for residential uses, a solid decorative wall or equiva-
lent landscape berm not less than three feet in height shall be erected
and maintained along the street side of the lot not closer to the
street than the required depth of the yard in the adjoining residential
area. No fence or wall located in the front setback shall obscure the
required front setback landscaping.

REFUSE ENCLOSURES:
Whenever refuse bins are located within or adjacent to a parking area used
by the public, they shall be enclosed by a decorative wall six feet in
height along the rear and sides and screened gate(s)' six feet in height
along the front. The enclosure shall not be placed within the required
front or street side yard setback area. Exact locatio~ and size of refuse
enclosures are to be determined by the Planning Department and Division of
Public Services Superintendent.

LANDSCAPI NG:
The intent and purpose of this section is to prevent trees and other
landscaping from damaging public improvements.
a. Street trees must be installed at a minimum of 30 feet on center.
Varieties and exact location shall be determined by the Director of
Park and Recreation.
b. All required setbacks abutting a public right-of-way shall be
landscaped (except for walks and driveways which bisect or encroach
upon the required landscape area).
c. Three copies of a landscape plan (including plant material
specifications) shall be submitted to the Planning Department and Park
and Recreation Department for review and approval.
d. All required landscaping shall be protected from parking areas and
shall be provided with automatic sprinkler facilities which shall be
maintained in an operative condition.
e. Interior planting shall be required and maintained equal to at least
five percent of the open surfaced parking area excluding the area of
landscaping strip required by subsection "b" and shall include at least
one tree for every five spaces or major fraction thereof. Measurements
shall be c9mputed from the inside of perimeter walls or setback lines.
f. The required setback(s} from the north , south X , east X ,
west X property line shall be densely landscaped with mature trees,
shrubs, and groundcover. A 3-foot landscaped earthen berm shall be
erected and maintained within the setback along the above indicated
property line. ,

MECHANICAL EQUIPMENT:
a. Air conditioning and vent ducts shall be directed away from any adja-
cent residential uses.
b. All mechanical equipment located on the roof shall be screened and
located away from adjoining residential uses. Screening design shall
be approved by the Planning Department.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
During construction, the City Engineer may require a fence around all or a
portion of the periphery of the site to minimize wind and debris damage to
adjacent properti es. The type of fenci ng shall be approved by the City
Engineer to assure adequate project site maintenance, clean-up and dust
control.
Within 75 feet of any single-family residential district, the maximum
height of any building shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features,
such restrictive height is not practical.
All utility lines shall be installed underground subject to exceptions
approved by the Planning Department and the City Engineer.
No Certificate of Occupancy shall be issued prior to compliance with these
Standard Requirements as well as all provisions of the San Bernardino
Municipal Code.
SI GNS:
All signs shal\ be in conformance with San Bernardino Municipal Code
Section 19.60. Three copies of a plot plan and elevation of the sign drawn
to scale shall be submitted to the Planning Department for review and
approval prior to issuance of the sign permit from the Building and Safety
Department. .
a. Monument-type signs shall not be located within th~ required setback
for the zoning district in which the sign is located. The monument
sign shall be located a minimum of 5 feet from the property line. If
the monument sign is located within the setback, it shall not exceed
an overall height of 3 feet.
b. All freestanding signs must have 8 feet of clearance between average
ground level and the bottom of the sign.

Identify each gas and electric meter with the number of the unit which it
services.
Fire extinguishers must be installed prior to the building being occupied.
The minimum rating for any fire extinguisher is 2A10B/C. Minimum distribu-
tion of fire extinguishers must be such that no interior part of the
building is over 75-feet travel distance from a fire extinguisher.
Submit plans for the fire protection system to the Fire Department prior to
beginning construction on the system. Work is not to commence on systems
without approved plans.
Each stairway shall be identified by signs according to the Uniform Fire
Code Stairway Numbering System, Uniform Fire Code 12, 106f and Appendix H
(applies to buildings four or more stories in height).
Standardized signs shall be installed on each landing in each stairway to
inform the user which stair landing he is on and the upper and lower ter-
mination of the stairway (Uniform Fire Code Appendix H).
Install spark arrestors on chimneys of all fireplaces. Spark arrestor
shall be constructed of metal, 19 guage minimum, with 3/8-inch to 1/2-inch
opening, and shall be entirely visible from the ground.
An approved standpipe system shall be provided as required by the Uniform
8uilding Code. System shal~ conform to National Fire Protection
Association Standard 14.
Provide an approved fire alarm system. The system must provide a minimum
sound level of 10 decibles above ambient in all parts of the building.
Plans shall be submitted for approval prior to installation.
The direction of swing of the exit door at location shall be with the flow
of traffic.
Fire Department connection to (sprinkler systemlstandpipe system) shall be
required at curb line.

Provide fire protection during the construction of the building. This pro-
tection shall be serviceable prior to the time the building reaches 50 feet
in height. Minimum fire protection shall consist of one temporary Class I
standpipe with one 2i-inch valve outlet for Fire Department use. The

Dear Honorable Planning Commission:
My clients respectfully request your consideration in establishing the proposed
use of vehicle towing, storage, impound and supporting repair, and incidental
ornamental iron fabrication, on their property located at 1661 Walnut
(APN 274-031-01). The existing zoning is M-l.
Their establishment is currently located on the south side of 9th Street between
"E" and "D" Streets in a commercial zone. They were notified that the present
use is not permitted in the C-3 zone after approximately eight years in business
at that location.
We are making every effort to comply with the city's 'request to move the
operation. However, finding a suitable property at a reasonable value with
existing facilities was difficult at best. Because of the cost of property,
improvements, and relocation, we require the assistance of the Planning
Commission to make this move affordable and feasible.
The proposed site has an existing industrial building and a residential structure
as well as several sheds, paving, chain link fencing and landscaping. The
property is currently used for auto repair, auto body repair and auto storage.
To make the move financially feasible we request the following:
1. Allo'iithe existing house to be used as an officel security quarters.
2. Waive the paving requirement for six months.
3. Allow the use of slag or gravel in the vehicle storagelimpound area
instead of paving.
4. Utilize the existing chain link fence for the fencing requirement.
To provide compatibility with adjoining uses, the following mitigation measures
are proposed.
1. Install a block and ornamental iron fence along the front property line.
Install trees within the front setback area.

2. Utilize the front portion of the site for parking of the service
vehicles.
3. Establish an open space area adjacent to the office.
4. Store vehicles behind the existing landscaped fence.

5. Color coat the proposed office/security quarters in a color similar
to the slump stone wall.
The existing landscaping, the orientation of the buildings, the fence along the
front property and the open space should soften the street view. The adjoining
property in the rear portion of the site is utilized by an Edison Company
utility corridor and railroad line operation.
We feel the proposed use will be an improvement for the area and will be com-
patible with surrounding uses.

The approval of Conditional Use Permit No. 85-30 is also
subject to the attached Engineering Division conditions,
dated June 18, 1985.
According to the San Bernardino Municipal Code, Section
19.78.070., the following applies to the filing of a condi-
tional use permit:
-The decision of the Commission shall be final unless appeal-
ed in writing to the Mayor and Common Council. The written
appeal shall be submitted to the office of the City Clerk
within ten days from the date of the Commission's decision.
The Cornmon Council, after receipt of the appeal, shall
conduct a public hearing and may either approve, modify or
reject the decision of the Planning Commission."
If no appeal is filed pursuant to the above provisions of the
San Bernardino Municipal Code, the action of the Commission
shall be final.

RE: Appeal of the granting of conditional use permit with
conditions
PURPOSE OF APPEAL: To request a change in the conditions
imposed on the conditional use permit.
BACKGROUND:
WILLIAM and CAROL CLARKE have purchased a parcel of
real property located at 1661 Walnut Avenue, San Bernardino,
California.
The CLARKES desire to locate on the property a
business known as TRI-CITY TOWING, which is now operating on
9th Street in the City of San Bernardino. The business will
include the storage of vehicles which have been impounded.
The CLARKES submitted their application for a
Conditional Use Permit to the City of San Bernardino, which,
subject to various conditions, was approved by the Planning
Commission on June 18, 1985.
The CLARKES have appealed the decision of the Planning
Commission as several of the conditions make it too
expensive to move the business.
Attached hereto as Exhibit -A- are the Conditions and
Standard Conditions imposed by the Planning Commission and
the CLARKES request that the Conditional Use Permit be
granted subject to the conditions imposed by the Planning

Commission with the following changes:
(1) That the block wall required in Paragraph 1 be
changed to allow an engineered wall to be installed
which will be a solid decorative wall of concrete and -H-
beam construction six foot in height. That the wall shall
enclose the area actually used as an impound/storage area at
any given time.
The CLARKES request that only that portion of the area
being used as an impound storage area be required to be
completely walled and that as the impound area is expanded,
the wall will be expanded accordingly. The unused area of
the lot will be cleaned and maintained.
Reason: This will reduce the overall cost to the
CLARKES and allow the installation of the wall over time as
it is needed and at the same time, except during
construction, fully enclose the storage yard actually being
used.
(2) Standard Condition No.2. Standard Condition
No. 2 be amended to allow installation of slag or gravel, after
a soil sterilization, in the impound yard instead of asphalt.
Reason: The condition now requires that asphalt be
installed in all parking areas. As indicated on the
enclosed map a large portion of these premises will be
utilized for storage and impound area and the CLARKES
request that the City allow the installation of gravel or
slag in the impound and storage areas. In the experience of
the CLARKES, the installation of asphalt is impractical and
not cost effective in that many of the vehicles which are
impounded and have to be stored for a lengthy period of
time, causes a fast deterioration of asphalt. The damaged
asphalt cannot be economically repaired. The gravel or
slag, however, does not have the same characteristic and new
gravel or slag can be added where needed.
(3) Standard Condition No.9. The CLARKES request
deletion of this condition in that the electrical is
currently installed on the premises and no changes are
anticipated at this time.
(4) Standard Condition No. 10. The CLARKES request
that a Certificate of Occupancy be granted immediately
subject to them commencing construction of the engineered
wall, wrought iron wall and landscaping within 30 days of
occupancy. The CLARKES request a period of six (6) months
after occupancy to complete all conditions.

Reason: The City has requested that TRI-CITY TOWING
move the business from its current location on Ninth Street
and this would allow them to move the business immediately,
to apply rents which are being paid at the Ninth street
property toward the improvements on the new location, as the
TRI-CITY TOWING does not have sufficient funds to do all of
the improvements prior to moving in to the new location.

dated June 18, 1985.
According to the San Bernardino Municipal Code, Section
19.78.070., the following applies to the filing of a condi-
tional use permit:
-The decision of the Commission<shall be final unless appeal-
ed in writing to the Mayor and Common Council. The written
appeal shall be submitted to the office of the City Clerk
within ten days from the date of the Commission's decision.
The Common Council, after receipt of the appeal, shall
conduct a pUblic hearing and may either approve, modify or
reject the decision of the planning Commission."
If no appeal is filed pursuant to the above provisions of the
San Bernardino Municipal Code, the action of the Commission
shall be final.

--1-- Condo Use Permit No. 85-30 shall be in effect for a period of 12 months
from the date of approval. However, if no development has been initiated at
the end of the l2-month period, the application shall expire. Additional
time may be approved upon request of the applicant prior to expiration of
the 12-month period. Expiration Date: June 18, 1986

a. This development shall be required to maintain a minimum of M.. stan-
dard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wal" fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line.
d. Whenever an off-street parking area is located across the street from
property zoned for residential uses, a solid decorative wall or equiva-
lent landscape berm not less than three feet in height shall be erected
and maintained along the street side of the lot not closer to the
street than the required depth of the yard in the adjoining residential
area. No fence or wall located in the front setback shall obscure the
required front setback landscaping.

REFUSE ENCLOSURES:
Whenever refuse bins are located within or adjacent to a parking area used
by the public, they shall be enclosed by a decorative wall six feet in
height along the rear and sides and screened gate(s) six feet in height
along the front. The enclosure shall not be placed within the required
front or street side yard setback area. Exact location and size of refuse
enclosures are to be determined by the Planning Department and Division of
Public Services Superintendent.

shall be provided with automatic sprinkler facilities which shall be

one tree for every five spaces or major fraction thereof. Measurements
shall be computed from the inside of perimeter walls or setback lines.

west X property line shall be densely landscaped with mature trees,
shrubs, and groundcover. A 3-foot landscaped earthen berm shall be
erected and maintained within the setback along the above indicated

cent residential uses.
b. All mechanical equipment located on the roof shall be screened and
located away from adjoining residential uses. Screening design shall
be approved by the Planning Department.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
During construction, the City Engineer may require a fence around all or a
porti on of the peri phery of the si te to mi ni mi ze wi nd and debri s damage to
adjacent properties. The type of fencing shall be approved by the City
. Engineer to assure adequate project site maintenance, clean-up and dust

for the zoning district in which the sign is located. The monument

Additional requirements may be added based upon occupancy and/or construc-
tion as deemed necessary by the Fire Chief.
Public fire hydrants shall be provided along streets at 300-foot intervals
for commercial areas. Installations shall conform to City specifications.

Identify each gas and electric meter with the number of the unit which it
services.
~ Fire extinguishers must be installed prior to the building being occupied.
The minimum rating for any fire extinguisher is 2AI0B/C. Minimum distribu-
tion of fire extinguishers must be such that no interior part of the
building is over 75-feet travel distance from a fire extinguisher.
Submit plans for the fire protection system to the Fire Department prior to
beginning construction on the system. Work is not to commence on systems
without approved plans.

Code Stairway Numbering System, Uniform Fire Code 12, 106f and Appendix H

Provide fire protection during the construction of the building. This pro-
tection shall be serviceable prior to the time the building reaches 50 feet
in hei ght. Mi ni mum fi re protecti on shall consist of one temporary Class I
standpipe with one 2i-inch valve outlet for Fire Department use. The
construction-phase fire protection system shall be approved by the Fire
Department prior to installation.
Prior to the building being occupied or opened to the public, the following
permits must be obtai ned from the Fi re Department: Article 34 IIFC .
The address of the structure shall be installed on the building or in other
approved location in such a manner as to be visible from the street. The
color of the numbers shall contrast with color of the background.
