Lair variance 84-16 Honorable Mayor wilcox and Members of the San Bernardino City Common Council: On June 26, 1985, my offices were retained by Mr. and Mrs. Gerald M. Lair for the purposes of legal representation concerning the above-entitled matter. According to the letter, dated June 19, 1985, from city Clerk, Shauna Clark, to Mr. John Fisher, Attorney, said matter has been continued to Monday, July 15, 1985 at 9:00 a.m. in the Council Chambers of City Hall. Unfortunately, I will be unable to attend at that time for the reasons outlined herein. My wife, Elizabeth, who recently completed her first year of law school at Citrus Belt in Riverside, California, is a native of the Palau Islands in Micronesia. My wife has not been home to visit her family for approximately seven years and for the past several months we have made reservations and plans to take a vacation commencing July 3, 1985 and ending on or about August 5, 1985. In light of these facts, it is absolutely impossible for me to appear and represent my clients' best interests. I therefore, would like to appeal to your kind mercies in granting my request that this matter be tabled until your regular meeting to be held on August 19, 19B5. The file in this matter is rather voluminous and extensive and as a result thereof, it is absolutely essential that I be adequately 9 . . . . . I held a teleconference with Deputy City Attorney John Wilson, on June 26, 1985, and was informed that a tentative ten year proposal has been offered to my clients. If in fact, upon a thorough review of this matter with my clients, it is possible that the matter may reach a quick decision. However, I do not want to make such a representation when in fact I am not adequately apprised of all of the facts and circumstances. Motion to grant variance adopted. 6-3-85 Action taken on 5-28-85 determined to be invalid. Appeal continued to June 17, 1985. 6-17-85 Council adopted Resolution No. 85-203 authorizing the Mayor to execute an agreement with the Lairs which permits continuance of the non-conforming use for ten years.
