Protest Hearing and Resolution Ordering

Synopsis of Previous Council action:
7-1-85 - Continued the Protest Hearing.
Recommended motion:
1. That the protests be overruled, the hearing be closed, and find and determine
that the public convenience and necessity require the proposed maintenance of
landscaping in the Carnegie Orive area, and that the Special Assessment,
Investigation and Limitation Act of 1931 shall not apply. (6/7 roll call vote
required)
2. Adopt the Resolution
3. That Assessor's Parcel No's. 281-351-03, 04 and 05 be NIL assessed unless the
agreement executed between the City and the present owner is not fulfilled.

STAFF REPORT
The hearing of protests on this proposed assessment district was continued from
the July 1, 1985 meeting, and the City Attorney was directed to prepare an
agreement with Ms. Evelyn Brier relative to the maintenance of landscaping in
front of her properties which front on Brier Drive.
The terms of the agreement are such that if the landscaping in question is not
properly maintained, then the City will maintain and assess accordingly.
To best facilitate this arrangement, it is recommended that the boundaries of
the district remain the same and adopt motions 1, 2 and 3. This will provide
the owner with a NIL (no) assessment as long as the landscaping is properly
maintained and will provide the City an in-place vehicle to assess if we should
take over the maintenance. Motion 3 becomes an in-house directive that can be
utilized at any time without the necessity of further proceedings should the
need arise.
