The application for Conditional Use Permit No. 85-29 was approved
based upon findings of fact contained in the staff report dated
June 18, 1985 and subject to the conditions and standard require-
ments listed therein. The Negative Declaration for environmental
review was also approved.

An appeal to Mayor Wilcox and City council men~ers of the c~ty
of San Bernardino of conditions imposed on Conditional Use Permit *85-29
I wish to appeal the conditions imposed on my project approved by the
planning Commission on June 18, 1985. The conditions and grounds of
my appeal are stated on the following waiver request letter submitted
to the planning Dept. and Commissioners prior to the 6/18 meeting.
In addition to these waiver requests, I am requesting a waiver of the
condition to tear down a four-foot fence along the rear property line
and replacing it with a six-foot blockwall fence. This is not according
to city ordinance, and the existing fence has been inspected and approved
by the state preschoQl licensing agency.
I also request a waiver of the recommended two-way traffic in the semi-
circular driveway. I propose a one-way drive-through for safety reasons,
directing traffic away from a front play yard.
In the staff report it is suggested that parking be in the rear of the
structure, which is not possible since the rear of the structure is a
play yard. My plans reflect parking on the side, and there has never
been mentioned the fact that this is not acceptable.
I have been advised to mention in this appeal the street improvement
requirement. Mr. Hargrave of City Engineering has recommended that this
requirement be deferred.

The application for Conditional Use Permit No. 85-29, to
permit a preschool for 30 children within a single-family
dwelling in the C-3A Limited General Commercial zone on
approximately .30 acre having a frontage of approximately 147
feet on the south side of Pumalo Street and being located
approximately 205 feet east of the centerline of Del Rosa
Avenue and further described as 1643 Pumalo Street, was
approved based upon findings of fact contained in the staff
report dated June 18, 1985 and subject to the conditions and
standard requirements listed therein.

OBSERVATIONS

I, The applicant requests approval to permit a preschool for 30 children within
a single-family dwelling located on the south side of Pumalo, approximately
205 feet east of the centerline of Del Rosa Avenue at 1643 Pumalo Street.
2. The site is zoned C-3A, Limited General Commercial which makes the dwelling
legal existing non-conforming. The applicant proposes to convert the single-
family dwelling to a use that is commercial in nature. A conditional use
permit is required for the operation of a day care center as well as the con-
version of a single-family dwelling to a commercial use.
Section 19.78 specifies day care centers as a permitted use within converted
single-family dwellings subject to the following conditions.
a) Structure shall conform to all provisions of the Uniform
Building Code.
b) Structure shall conform to all provisions of the Uniform
Fire Code.
c) The exterior of the structure shall be altered so as to
no longer have the appearance of a residential structure.
Staff contends that to modify the exterior of the structure would create a
more sterile environment than to leave the structure as is, for a more homey
environment.
d) The original setback areas of the residential sturcture
shall be maintained and landscaped,
e) All parking shall be provided to the rear of the structure
and shall include a minimum of a 20 foot wide, two-way ve-
hicular access to a public street except as approved by the
Planning Commission.

The surrounding land use and zoning consists of commercial development zoned
C-3A to the north and south, apartments zoned R-3-1200 to the east and Commer-
cial and an existing non-conforming single-family residence to the west.

A telephone discussion with the applicant (Sonna Elliot) on May 29 revealed
that the preschool will operate Monday through Friday from 6:30 a.m. to
6:00 p.m. Drop-off and pick-up will occur approximately 1~ hours after opening
and before closing. Approximately thirty (30) children from the ages of 2
years to 6 years will be supervised by three teachers.
Three playgrounds have been identified on the submitted site plan. Two are
located to the rear of the structure and one to the front and east of the
structure. The applicant has indicated that swings, sandboxes, climbing bars
and bicycles will be provided for the children to play with. Prior to the

issuance of a Certificate of Occupancy, the equipment must be installed. A
condition is included.
5.
The dwelling is approximately 1,500 square feet in area with a two-car garage.
The submitted site plan indicates that two of the required parking spaces
will be provided within the garage for the staff. Three additional parking
spaces along the west property line are indicated on the submitted site plan.
Eight standard off-street parking spaces are required for the proposed use.
Five spaces have been proposed and the applicant is requesting a waiver of
three of the required parking spaces. A 10 foot wide semi-circular driveway
will be utilized for drop-off and pick-up of the children. A waiver of the
minimum 15 foot one-way driveway has been requested.

Staff contends that children from the ages of two to six will not be just
"dropped-off" but rather, the parents will park the car in the driveway and
take the children inside. Since the driveway is only 10 feet wide, cars can-
not go around the parked vehicle. There may not even be a place to park and
go inside of a parking waiver is granted. This may cause an undesirable and
unsafe traffic problem. There is adequate area to accomodate the required
number of parking spaces and a waiver of the requirement cannot be justified.
Also indicated are 6" x 6" wooden wheel stops with the back-up area as grass.
The San Bernardino Municipal Code requires that the wheel stops be concrete
and that the drive aisles be paved with 2 inches A/C. A condition to that
effect has been included.
6. A field inspection conducted on June 6, 1985 revealed that a flood control
channel abuts the east property line with an apartment project directly east
of the flood control channel.
Whenever a commercial zone abuts a residential zone, a 6 foot high decorative
block wall is required.
Currently a four foot high chain link fence exists along the east property
line. There is approximately a 15 to 20 foot drop to the bottom of the flood
control channel. Children would have no problem climbing a four foot chain-
link fence.
An existing non-conforming single-family residence is located along the south-
western portion of the site. The chain link fence separating the playground
from said residence is approximately three feet in height. If children were
to get out of the playground, they would have direct access to Del Rosa Avenue,
an arterial street.
Staff contends that to protect the safety of the children a six foot high dec-
orative block wall is required along the east, southwest (to the existing Com-
mercial Building) and south property lines. The applicant has requested a

7. Currently there is no curb, gutter or sidewalk along the frontage of Pumalo.
The Engineering department is requireng full improvement and dedication of
thirteen feet to bring Pumalo to it's ultimate right-of-way width of 66 feet,
33 feet from the centerline.
8. The submitted site plan does not indicate the location of a refuse enclosure.
It is a standard requirement that all commercial developments provide a stan-
dard refuse enclosure, exact size and location .to be approved by the Refuse
Department and Planning Department.
9. At the Environmental Review Committee Meeting on May 16, 1985, a negative
declaration was recommended with the observation that the site is located in
a flood zone "B" and adjacent to an unimproved flood control channel.
The Flood Control District indicated that there would be no requirements from
their department since the structures are already existing.

FINDINGS of FACT
~
1. The proposed Day Care Center is a type of Commercial Use and would be consis-
tent with the City's General Plan designation of General Commercial.
2. The proposed Day Care Center will not adversely affect the adjoining land uses
and the growth and development of the area in which it is proposed to be loca-
ted subject to compliance with the conditions of approval.
3. The .35 acre rectangular site is adequate to accomodate the use in a manner
not detrimental to the particular area nor to the peace, helath, safety and
general welfare subject to the attached conditions and standard requirements.
4. The traffic generated by the Day Care Center will not impose an undue burden
upon Pumalo in that Pumalo will be improved to it's ultimate right-of-way and
adequate parking will be provided subject to the attached conditions.
5. The granting of the conditional use permit under the conditions imposed, will
not be detrimental to the peace, health, safety and general welfare of the
citizens of the City of San Bernardino.

1. All wheelstops shall be concrete and all driveways shall be a minimum width
of 15 feet for one-way and 24 feet for two-way traffic.
2. A minimum of 8 standard parking spaces is required with a minimum distance
of 24 feet clear backup. One of said spaces is to be handicapped.
3. A six foot high solid decorative wall shall be required along the south and
southwest (to the existing Commercial building located along the northwest
property line) property lines.
4. The applicant shall provide standard playground equipment such as swings,
sandbox, climbing bars and bicycles prior to the issuance of a Certificate
of Occupancy.
5. The area behind the proposed three parking spaces along the west property
line shall be paved with 2 inches A/C.
6. Subject to the rules and regulations of the Building and Safety and Fire
Departments.

7. If approved as recommended, a revised site plan indicating those modifica-
tions shall be submitted for review and approval to the Planning Department.
RECOMMENDATION:
Based upon the observations and findings of fact and subject to the conditions and
standard requirements contained herein, Staff recommends adoption of the negative
declaration and approval of Conditional Use Permit No. 85-29.

Condo Use Permit No. 85-29 shall be in effect for a period of 12 months
from the date of approval. However, if no development has been initiated at
the end of the l2-month period, the application shall expire. Additional
time may be approved upon request of the applicant prior to expiration of
the l2-month period. Expiration Date: June 18, 1986.
PARKING:

a. This development shall be required to maintain a minimum of ~ stan-
dard off-street parking spaces.
b. All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wall, fence, property line, or walkway.
c. Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line.
d. Whenever an off-street parking area is located across the street from
property zoned for residential uses, a solid decorative wall or equiva-
lent landscape berm not less than three feet in height shall be erected
and maintained along the street side of the lot not closer to the
street than the required depth of the yard in the adjoining residential
area. No fence or wall located in the front setback shall obscure the
required front setback landscaping.
REFUSE ENCLOSURES:
Whenever refuse bins are located within or adjacent to a parking area used
by the public, they shall be enclosed by a decorative wall six feet in
height along the rear and sides and screened gate(s) six feet in height
along the front. The enclosure shall not be placed within the required
front or street side yard setback area. Exact location and size of refuse
enclosures are to be determined by the Planning Department and Division of
Public Services Superintendent.

LANDSCAPI NG:
The intent and purpose of this section is to prevent trees and other
landscaping from damaging public improvements.
a. Street trees must be installed at a minimum of 30 feet on center.
Varieties and exact location shall be determined by the Director of
Park and Recreation.
b. All required setbacks abutting a public right-of-way shall be
landscaped (except for walks and driveways which bisect or encroach
upon the required landscape area).
c. Three copies of a landscape plan (including plant material
specifications) shall be submitted to the Planning Department and Park
and Recreation Department for review and approval.
d. All required landscaping shall be protected from parking areas and
shall be provided with automatic sprinkler facilities which shall be
maintained in an operative condition.
e. Interior planting shall be required and maintained equal to at least
five percent of the open surfaced parking area excluding the area of
landscaping strip required by subsection "b" and shall include at least
one tree for every five spaces or major fraction thereof. Measurements
shall be computed from the inside of perimeter walls or setback lines.
f. The required setback(s) from the north , south , east ,
west_____ property line shall be densery-Tandscaped with mature trees,
shrubs, and groundcover. A -foot landscaped earthen berm shall be
erected and maintained within the setback along the above indicated
property line.

MECHANICAL EQUIPMENT:
a. Air conditioning and vent ducts shall be directed away from any adja-
cent residential uses.
b. All mechanical equipment located on the roof shall be screened and
located away from adjoining residential uses. Screening design shall
be approved by the Planning Department.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
During construction, the City Engineer may require a fence around all or a
portion of the periphery of the site to minimize wind and debris damage to
adjacent properties. The type of fencing shall be approved by the City
Engineer to assure adequate project site maintenance, clean-up and dust
control.
Within 75 feet of any Single-family residential district, the maximum
height of any building shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features,
such restrictive height is not practical.
All utility lines shall be installed underground subject to exceptions
approved by the Planning Department and the City Engineer.
No Certificate of Occupancy shall be issued prior to compliance with these
Standard Requirements as well as all provisions of the San Bernardino
Municipal Code.
SIGNS:
All signs shall be in conformance with San Bernardino Municipal Code
Section 19.60. Three copies of a plot plan and elevation of the sign drawn
to scale shall be submitted to the Planning Department for review and
approval prior to issuance of the sign permit from the Building and Safety
Department.
a. Monument-type signs shall not be located within the required setback
for the zoning district in which the sign is located. The monument
sign shall be located a minimum of 5 feet from the property line. If
the monument sign is located within the setback, it shall not exceed
an overall height of 3 feet.
b. All freestanding signs must have 8 feet of clearance between average
ground level and the bottom of the sign.

Additional requirements may be added based upon occupancy and/or construc-
tion as deemed necessary by the Fire Chief.
Public fire hydrants shall be provided along streets at 300-foot intervals
for commercial areas. Installations shall conform to City specifications.

BUILOING:
Identify each gas and electric meter with the number of the unit which it
services.
~ Fire extinguishers must be installed prior to the building being occupied.
The minimum rating for any fire extinguisher is 2A10B/C. Minimum distribu-
tion of fire extinguishers must be such that no interior part of the
building is over 75-feet travel distance from a fire extinguisher.
Submit plans for the fire protection system to the Fire Department prior to
beginning construction on the system. Work is not to commence on systems
without approved plans.
Each stairway shall be identified by signs according to the Uniform Fire
Code Stairway Numbering System, Uniform Fire Code 12, 106f and Appendix H
(applies to buildings four or more stories in height).
Standardized signs shall be installed on each landing in each stairway to
inform the user which stair landing he is on and the upper and lower ter-
mination of the stairway (Uniform Fire Code Appendix H).
Install spark arrestors on chimneys of all fireplaces. Spark arrestor
shall be constructed of metal, 19 guage minimum, with 3/B-inch to 1/2-inch
opening, and shall be entirely visible from the ground.
An approved standpipe system shall be provided as required by the Uniform

GENERAL
All grading shall be done in compliance with Title 15 of the Municipal Code
and the requirements of the City Engineer. The site/plot/grading plan sub-
mitted for a building permit shall contain sufficient ground elevations
(both existing and proposed), building pad and finished floor elevations,
graded slopes, and gradients to define the amount of grading to be done and
the means of draining the site.
All drainage from the development shall be directed to a public dedicated
street, alley, or drainage facility. If this is not feasible, proper
drainage facilities and easements shall be prQvided to the satisfaction of
the City Engineer.
Proper flood protection measures shall be provided to the satisfaction of
the City Engineer. All plans necessary to accomplish this requirement
shall be completed by the developer's engineer and approved by the City
Engineer prior to the issuance of a building permit.
The development is located within 200 feet of an existing sewer main,
therefore, it shall be connected to the sewer system and shall be so shown
on the plans prior to issuance of a building permit.
The project is not located within 200 feet of an existing sewer main,
therefore a septic system shall be provided to the satisfaction of the
Building and Safety Superintendent and shall be shown on the plans prior to
the issuance of a building permit.
STREET IMPROVEMENTS AND DEDICATIONS:

All public streets within or adjacent to the development shall be
improved and dedicated to their ultimate dimensions as required by the
Municipal Code and the City Engineer.
Improvement plans shall be completed by the developer's engineer and
approved by the City Engineer prior to the issuance of a building per-
mi t.

Any work to be done within City right-of-way shall be done in accor-
dance with City Standards or as approved by the City Engineer and shall

3. Parking spaces required.
The off-street parking space requirement for preschools is one per staff member
and one for every six students. I will have a maximwr of three staff and 30

I am proposing to have five parking spaces and use the large existing semi-

The city ordinance staten that in a C-3A zone, a hlock wall fence is required if
the property line abuts an n zone. Mine does not. The east side of my property
