STAFF REPORT
The East Valley Medical.Clinic has given the city notice that
their practice will be closing in the near future. The last
day that City pre-employment exams will be performed via the
East Valley Medical Clinic is June 20, 1985.
A Request for Proposal for the provision of pre-emploiyment
examinations was released to approximately twenty (20)
physicians/clinics in the San Bernardino area on June 7,
1985. The proposals have a due date of July 5, 1985 and will
be evaluated by a Proposal Review Committee during the month
of July. The Committee's recommendation for an exam provider
is anticipated to appear on the Council agenda of August 5,
1985, or at the latest, August 19, 1985.
During the interim period of June 20, 1985 through August 5
or 19, the Emergency Services/Risk Management Director
recommends that Arnold M. Stein, M.D., provide pre-employment
physical examinations for the City. The Personnel Director
concurs with this recommendation. Dr. Stein has agreed to
maintain the same price structure as the East Valley Medical
Clinic for the interim period. Thus there will be no in-
creased costs to the City as a result of this agreement.

RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING
THE EXECUTION OF AN AGREEMENT WITH ARNOLD M. STEIN, M.D.
FOR A PERIOD OF TIME NOT TO EXCEED 90 DAYS RELATING TO
PHYSICAL EXAMINATIONS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF
THE CITY OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino
is hereby authorized and directed to execute on behalf of
said City an Agreeroent with Dr. Arnold M. Stein for a
period of tiroe not to exceed 90 days relating to physi~al
exaroinations, a copy of .which is attached hereto, roarked
Exhibit "A" and incorporated herein by reference as fully
as though set forth at length.

Bernardino, California, this

198~, by and between the CITY OF SAN BERNARDINO, a
rounicipal corporation, hereinafter called "City., and
Arnold M. Stein, M.D. hereafter called "Doctor".
WIT N E SSE T H:
The parties hereto agree as follows:
1. Upon request and referral by City, Doctor shall
conduct pre-eroployment physicals and evaluations for
City.
Such services shall include, but not be liroited
to, the following:
(a) providing central coordination of medical data
and inforroation related to pre-employroent physicals and
evaluations for City;
Cb) conducting urinalyses, physicals and obtaining
.. the medical history of persons referred by City;
(c) upon specific request of City, take back x-rays
and provide City an evaluation thereof by a physician;
and
(d) providing City a physician's suromary and eval~
uation in regard to exams conducted hereunder.
2. City

between the parties hereto that x-rays will be taken as
part of the physical examination only upon request of
City.

Examinations as required by various departments in the
amount of twenty-eight dollars ($28.00). DMVexam in
conjunction with physical exam, fifteen dollars ($15.00),
in addition to regular physical exam fee.
3. A written report and recommendation on each
physical examination hereunder shall be prepared by
the Doctor on a form approved by City's Director ..of
Personnel and shall be fowarded to City within three days
of completion of the examination.
4. Doctor shall bill the City monthly and said
statement shall include the names of the persons examined

5. City
and Doctor shall have the right
to
terminate this agreement at any time by the giving of two
.weeks (14 days) advance written notice.
6. All notices hereunder shall be by first class
mail, postage pre-paid, addressed as follows:

boards,
comll1issions,
officers, agents and ell1ployees harmless from any liabi-
lity for damage or claims for damage for personal
injury, including death, as well as for claims for
property damage which may arise from Doctor's operations
and activities under this agreement, whether such opera-
tions and activities by the Doctor or by anyone or more
persons directly or indirectly employed by or acting as
agent for him/her.
Doctor agrees to and shall defend
City and its elective and appointive boards, coromissions,
officers, agents and employees from any suits or actions
at law or in equity for dall1ages caused, or alleged to
have been caused, by reason of any of Doctor's operations
and activities hereunder.
9. The term of this agreement shall be for a period
of time not to exceed 90 days cOll1mencing June 18, 1985
and ending September 18, 1985.
IN WITNESS WHEREOF, the parties hereto have executed
this Agreement on the date first hereinabove written.
