FOR COUNCIL AC~N STAFF REPORT A recent court case (Garcia v. San Transit Authority) held that the Federal Act (FLSA) applies to all cities, which from same. Antonio Metropolitan Fair Labor Standards were formerly exempt The FLSA sets minimums for the payment of overtime wages and sets the minimum wage. The FLSA takes precedence over Resolutions, Memorandums of Understanding (MOU's) and City Charter provisions. Research is currently being conducted as to how the FLSA affects each bargaining unit's current entitlement to overtime pay. Recommendations on changes regarding the payment of overtime will be brought to Council in the near future. The minimum wage portion of the FLSA needs to be implemented now. Three part-time classifications are currently receiving $3.10 per hour, which is $.25 less per hour than the current minimum wage of $3.35. These classes are Locker Attendent, Senior Services Aide and Crossing Guard. The 1985/86 FY impact (12 months) will be approximately $19,500. The 1984/85 FY impact (1 month) will be approximately $1,800. The increase in minimum wage will affect eighty (80) Cross- ing Guards and five (5) Senior Service Aides. The class of Locker Attendant has no incumbents at the present time. AND CHANGING THE HOURLY RATE FROM $3.1000 TO $3.3500 FOR THE PART TIME CLASSES OF LOCKER ATTENDENT, SENIOR SERVICES AIDE, AND CROSSING GUARD EFFECTIVE JUNE 10, 1985, TO CONFORM TO THE FEDERAL MINIMUM WAGE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Resolution No. 6413, Section Nine is amended to read as follows: SECTION NINE: General, Middle-Management, Management/- Confidential Employees: Classes of employment shall be compensated in accordance with Section Eight hereof as set forth in the following Sections 10,11,12, and l~. Classes of employment, which are included in the unclassified service pursuant to the City Charter or other action of the City Council, are designated with the letter (U).
