STAFF REPORT
On February 4, 1985, the Mayor and CODlOOn Council approved a
grant allocation to the organization "Music for Whistle,
Pipes and Flutes" on the recolIITIendation of the Fine Arts
Commission. Mr. Jerrold E. Pritchard, Associate Vice-President
of Academic Programs at California State University, San Bernardino,
has requested that City documents be revised to reflect the name
of the organization as "The Foundation for California State
University." The revision is requested by the Organization for
accuracy of records as well as tax liability concerns. Staff
recommends approval of the attached resolution which implements
the requested revisions.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE
EXECUTION OF A FIRST AMENDMENT TO AGREEMENT WITH THE FOUNDATION
FOR CALIFORNIA STATE UNIVERSITY (FORMERLY REFERRED TO AS MUSIC
FOR WHISTLE, PIPES AND FLUTES) TO CORRECTLY STATE THE NAME OF THE
ORGANIZATION.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby
authorized and directed to execute on behalf of said City a First
Amendment to Agreement with the Foundation for California State
University to correctly state the name of the organization, a copy
of which is attached hereto, marked Exhibit "An and incorporated
herein by reference as fully as though set forth at length.
I HEREBY CERTIFY that the foregoing resolution was duly
adopted by the Mayor and Common Council of the City of San

(Community Organization)
THIS FIRST AMENDMENT TO AGREEMENT is made and entered into
between the CITY OF SAN BERNARDINO, a municipal corporation,
refen-ed to as "City", and TH.E FOUNDATION FOR CALIFORNIA STATE
UNIVERSITY, (formerly referred to as Music for Whistle, Pipes and
Flutes) a California nonprofit organization, referred to as
"Organization".
The parties agree as follows:
1. Recitals.
A. City and Organization entered into an agreement on
February 13, 1985, relating to funding to assist in defraying the
expense of certain concerts, shows, festivals or events or
activities sponsored by Organization.
B. The parties now desire to amend the agreement to
state the correct name of the organization, The Foundation for
California State University, rather than Music for Whistle, Pipes
and Flutes.
2. Amendment. The agreement entered into on February 13,
11985 between City and Organization is amended to reflect the
correct name of the organization as The Foundation for California
!State University.
