The project has not been completed as of this date and the continued .closure is necessary to allow completion of thi s project. RESOLUTION OF THE CITY OF SAN BERNARDINO TEMPORARILY CLOSING CUL DE SAC ON FIFTH STREET BETWEEN MERIDIAN AVENUE AND THE PRESENT TERMINUS OF FIFTH STREET 325 FEET TO THE EAST PURSUANT TO, SECTION .21101 OF VEHICLE CODE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF 5 SAN BERNARDINO AS FOLLOWS: 6 SECTION 1. Findings. The Mayor and Common Council of the 7 City of San Bernardino make the following findings: " 8 A. Fifth Street, between Meridian Avenue and the present 9 terminus of Fifth Street approximately 325 feet to the east in the 10 City of San Bernardino, is a cuI de sac providing access only to 11 an apartment complex and is not currently needed for public 12 vehicular traffic. 13 B. The section of street designated in this resolution is L;; .-. ,I 14 frequently used as an access route for illegal activiti~~, . ..,., 15 including burglaries, assaults, and drug trafficking, perpetrated 16 on the adjacent residential community. 17 C. Subsection (a) of the California Vehicle Code Section 18 21101 authorizes local authorities to adopt rules and regulations . 19 by ordinance or resolution to temporarily close any highway to 20 vehicular traffic when the highway is no longer needed for 21 vehicular traffic. 22 D. Closing of said cuI de sac will promote public health, 23 safety, welfare and morals. 24 SECTION 2. Closing. SECTION 3. Barricades. The owner of the adjoining property 1 . is authorized to install appropriate facilities including fencing and guard facilities, to control access to this portion of Fifth Street, in accordance with requirements of the Director of Public Works/City Engineer and at no cost to the City. SECTION 4. Termination. The tempo~ary closing of this portion of Fifth Street shall be in effect for a period of forty- I five days, with extensions of one year thereafter subject to ,!approval by the City, except that the closing can be terminated at I any time upon 15 days written notice by the City or the owner of the adjoining property. This action has effectively alleviated the problem. It is recommended that Mr. A.B. Howells request for a continuance of the closure be granted. This closure does not inhibit resident travel nor does it pose a problem related to Fire Department access. ~~~Jec; ,.
