STAFF REPORT
Since January 7, 1974 the City has had an agreement with Mr. Padilla, a park
employee, which allowed him to live in the residence located at 2477 East
Pacific. The conditions of the agreement included a stipulation that Mr.
Padilla would not commit, allow to be committed any waste on the premises,
or nuisance, nor would he use or allow to be used such premises for unlawful
purposes.
During this past year this Department has received numerous complaints regarding
the excessive noise generating from said residence and the constant gathering
of people. Mr. Padilla has been warned several times to curtail any and all
such activity, however to no avail.
A point has been reached now where the City can no longer allow the annoying
activity generating from said residence.
In addition, Mr. Padilla is required by the agreement to perform 8 man hours of
labor per week on the City property in lieu of rental payments. Mr. Padilla has
to be continually reminded to perform his 8 hours of duty as required in the
agreement. His performance in this area has deteriorated with very little work
being performed even after reminding him of his contractual obligation.
With the improvements that have taken place on the property, maintenance crews
already assigned to maintain the nearby areas can absorb the areas for which
Mr. Padilla is responsible.
Therefore, it is recommended that the lease with Mr. Padilla be terminated in
accordance with the provisions of the agreement.
JUSTIFICATION FOR PLACEMENT ON THE SUPPLEMENTAL AGENDA
Since 45 days notice to lessee is required, and because of the number of complaints
received, it is believed to be in the best interest of the City to begin the lease
termination process as soon as possible. Therefore, it is requested that this
item be placed on the Agenda for the May 13, 1985 meeting.

BE IT RESOLVED BV TUE MAYOR AND COMMON COUNCIL OF THE CITY
OF SAN BERNARDINO AS FOLLOWS:
SECTION 1. The 11ayor of the City of San Bern"lrdino is
hereby authori~ed and directed to execute on behalf of said City
a Notice of Termination of a.!'. agreement with Guadalupe S. Padilla
relating to the tenancy of the residence on property owned by the
City located at 2477 East Pacific, Uighland, California, a copy
of which is attached hereto, marked Exhibit "A" and incorporated
herein by reference as fully as though set forth at length.
