This district was requested by 100% of the property owners liable to be assessed for the improvements. A RESOLUTION OF THE CITY OF SAN BERNARDINO FINDING AN DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE TH PROPOSED CONSTRUCTION OF STREET IMPROVEMENTS IN THE AREA OF LASSE STREET, NORTH OF BASELINE STREET, CREATING AN ASSESSMENT DISTRIC TO COVER THE COSTS OF SAID CONSTRUCTION, KNOWN AS ASSESSMEN DISTRICT NO. 965, ORDERING THE WORK AND THAT THE SPECIAL ASSESS- MENT, INVESTIGATION AND LIMITATION ACT OF 1931 SHALL NOT APPLY. WHEREAS, the Mayor and Common Council of the City of San Bernardino have preliminarily found that the public interest, con venience and necessity require the construction of street improve ments in a portion of the City. as more fully hereinafte described, the appurtenances and appurtenant work and and incidental costs and expenses in connection therewith, that the project is feasible, and that the lands to be assessed will be able to carry the burden of the proposed assessments to pay the costs and expenses thereof; and WHEREAS, the Mayor and Common Council of the City of San Bernardino have, on the 7th day of March, 1985, passed and adopted Resolution No. 85-98 entitled: RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY DETERMINING THAT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE FORMATION OF A STREET IMPROVEMENT ASSESS- MENT DISTRICT: DECLARING ITS INTENTION TO PROCEED TO ORDER WORK WITHIN THE DISTRICT. TO BE KNOWN AS ASSESSMENT DISTRICT NO. 965 AND WAIVING NOTICE AND HEARING AND DIRECTING RECORDING OF THIS RESOLUTION. THE AGREEMENT JNCORPORATED HEREIN, TOGETHER WITH THE ASSESSMENT DISTRICT MAP OF ASSESSMENT OISTRICT NO. 965. hich said resolution indicated that the City elected to proceed ithout Notice and Hearing pursuant to Section 12.90.040C(5) of the unicipal Code. 1 NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON OUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. That the pUblic convenience and necessity re- uire, and the Mayor and Common Council of the City of San ernardino hereby declare by not less that a 4/5th vote as defined n Section 12.90.0400 of the San Bernardino Municipal Code, that he public interest, convenience and necessity requires and hereby rder, the formation of Assessment District No. 965; the work escribed in said Resolution No. 85-98 to be done in portions of assen Street, North of Baseline Street and in portions of Baseline treet between a point approximately 550 feet East of Lassen Street nd a point approximately 800 feet West of Lassen Street as pro- ided in said Resolution and that the Special Assessment, 'Investi- ation and Limitation Act of 1931 shall not apply. SECTION 2. The City Clerk hereby is directed to post a otice for five days on or near the door of the Council Chambers of he City Hall inviting sealed proposals or bids when necessary for oing the work ordered and referring to the specifications on file nd to publish a Notice Inviting such proposals for at least two ays in the San Bernardino Sun, a newspaper published and circu- ated in said City. SECTION 3.
