Prince Subject: Access Road Requirement - Ordinance amendment Dept: City Attorney Da~: April 11, 1985 Synopsis of Previous Council action: At the the April 1, 1985 Council meeting, the City Attorney was directed to prepare an amendment to the ordinance requiring a dedicated secondary access roadway on a subdivision. The purpose of the amendment is to allow for unimproved roads as a secondary means of ingress/egress within certain subdivisions. Racommended motion: Waive further first reading of ordinance and layover for final adoption. Said section prohibits the grant of an exemption fr~m the requirement for two separate means of ingress and egress to properties located in the high fire hazard zone. During said discussion the Planning Director commented that since exemptions are being repeatedly granted from the section, that the Mayor and Common Council should repeal the section. ORDINANCE OF TilE CITY OF SAN BERNARDINO AMENDING SECTION 18.40.160 OF TilE SAN BERNARDINO MUNICIPAL CODE TO DELETE THB REOUIREMENT FOR PROVISION OF TWO DIFFERENT ROUTES FOR INGRESS AND EGRESS ON A TENTATIVE MAP, FINAL MAP, TENTATIVE PARCEL MAP OR PARCEL MAP FOR PROPERTY WITHIN THE HIGH FIRE HAZARD AREA. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO .DO ORDAIN AS FOLLOWS: SECTION 1. Section 18.40.160 of the San Bernardino Municipal Code is amended to read: "18.40.160 Provision for ingress and egress. A tentative map, final map, tentative parcel map, or parcel map shall provide for at least two different routes for ingress and egress. Such routes shall be dedicated to the public, shall have a minimum paved width of twenty-four f~et, and shall conform to all standards contained in this section. The purpose of these routes is to permit accessibility of fire fighting and other publi~ equipment and to permit orderly emergency evacuation. Upon a specific finding that the public health, safety, and welfare do not require such access, under the circumstances of that particular application, the Commission or the Mayor and Common Council may approve any such map with only one route when an existing street provides only one route for ingress and egress, not more than 2000 feet of street extension is required, and the parcel map creates not more than two residential lots, one of which the applicant represents will be occupied as his or her primary place of residence."
