Streets," approved for City's share of the cost for landscaping the
median in Waterman Avenue, from the Santa Ana River to Dumas Street.

Resolution No. 84-170 adopted authorizing execution of an Agreement
with the County and Park Centre Properties relating to landscaping
the median in Waterman Avenue, from Santa Ana River to Dumas Street.
Recommended motion:
That the expenditure of the $25,000, filed pursuant to
conditions of approval for Parcel Map No. 8734, for land-
scaping for median in Waterman Avenue, from Route 1-10
Freeway to Santa Ana River, be approved.

STAFF REPORT
Tentative Tract No. 12034 was approved at the Planning Commission
meeting of 3-2-82, for the Park Centre Properties. Condition of approval
No. 24(a) required the developer to install traffic signals at Waterman
Avenue and Vanderbilt Way. The condition also went on to state that the
developer will be reimbursed the traffic signal fees, collected from
adjacent developments, for a portion of the cost of the signal.
Parcel Map No. 8734 was approved at the Planning Commission meeting
of 10-2-84. This action was to divide the parcel on the west side of
Waterman Avenue, opposite Vanderbilt Way, into 3 parcels. Condition of
approval No. 8(a) stated that the Developer shall be assessed a proportionate
share for the traffic signal at this intersection.
The Developer paid an amount of $25,000 on 3-25-85 (Reference:
Miscellaneous Cash Receipt No. 71723) as the proportionate share.
Assessment District No. 961 has been created to finance the cost of
acquiring the improvements installed by Tract No. 12034, including the signal
at this intersection. Therefore, it does not appear appropriate to reimburse
this amount to the Developer.
One possible course of action could be to deposit the funds in the
account for Assessment District No. 961 to help payoff the bonded indebted-
ness. Another option, provided that it would not create legal problems, is
to expend the funds to landscape the median. This would improve the appearance
of a major entrance into our City, and benefit the two developments.
We recommend that approval be given to use the funds to landscape the
median.

Public Works recommends that $25,000 received for a
proportionate share of cost of installing a traffic signal at
Vanderbilt and Waterman be used for landscaping the median in
Waterman Avenue. The traffic light is being paid for by
assessment district 961 bond proceeds. The $25,000 for the
traffic light was received as a condition of approval of
Parcel Map No. 8734.
Condition 8 A of pareel Map 8734 provides that "Developer
shall be assessed a proportionate share for traffic signal on
Waterman and Vanderbilt." '
Since bond proceeds are for acquiring public improvements,
including the subject traffic signal, the $25,000 should be
deposited in the account for Assessment District 961 to help
payoff bonded indebtedness and not used for a purpose not
prescribed under conditions of approval for Parcel Map 8734.
