Appeal of Planning Commission Decision
of February 19, 1985
OONORABLE MAYOR AND 1liE COM/oDN COUNCIL:
We respectfully appeal the split-decision of the Planning
. Commission on the above-referenced item.
We are in agreement with all the conditions imposed by the
E.R.C. and the Planning Commission except for the requirement
of having only one' (1) driveway into our project.
We believe that having only one (1) driveway along our 200 foot
frontage will be more hazardous than having two (2)---particularly
with the type of bUsinesses that may locate in these particular
facilities. These types of businesses cater to the small storagel
supply businesses that may operate several small truck~ or vehicles..

There are other developments along Waterman.. Avenue which were
allowed to install two (2) driveways which are even closer to-
. gether than the ones'we propose.

At the meeting of the Planning Commission on February ~9,
1985, the following action was taken:
The appeal of condition of approval 12 for previously approv-
ed Review of Plans No. 84-138 (Amendment 11), which permitted
construction of a multi-tenant, industrial building on
property located on the east side of Waterman Avenue and
approximately 230 feet south of the centerline of Valley
Street, was denied.
The decision of the Commission shall be.final unless appealed
to the Mayor and Council in writing. The written appeal
shall be submitted to the office of the City Clerk within ten
days fr?m the date of the meeting.'

The applicant has submitted an appeal of the Development Review Committee's
decision to approve Review of Plans No. 84-138 Amended #1 and the associated
Condition of Approval #2.
Review of Plans #84-138 proposes construction of a 37,333 square foot contrac-
tors office, storage and supply facility located on the west side of Waterman
Avenue, southerly of Valley Street. The property is currently vacant and encom-
passes 1.9 acres within the Commercial-Manufacturing and Light Industrial zones.
,( The origina~ plot plan submitted by the applicant proposed two drive-ways on
Waterman Avenue. The two drive-ways would be separated by 22 feet and provide
one-way ingress and egress only. 8ased upon the recommendation of the
Engineering Department, Traffic Engineer and Planning Department, the applicant
amended the site plan to delete the two drive-ways and include only one drive-
way to provide ingress and egress to the property. The applicant submtted an
amended site plan which reflected the requests of the Committee. The
Development Review Committee subsequently approved Review of Plans 84-138
Amended #1 on January 24, 1985.
The applicant later indicated, however, that they did not propose to develop the
site with only one drive-way and instead requested approval of the original site
plan with the two drive-ways. The Development Review Committee reviewed the
request and determined that the requirement for one drive-way only was justified
and reaffirmed their decision. The applicant proceeqed to appeal the decision
of the Development Review Committee to the Planning Commission stating the
following reasons as justification:
1. One drive-way to serve the proposed facility with 200 feet of
frontage on Waterman Avenue would be more hazardous than two,
due to the types of businesses that may locate in the facility.
Presumably, the applicant is referring to a conflict that may
arise between the truck traffic utilizing the proposed facility.

2. The existing ornamental street light would require relocation
if only one drive-way were installed, however, if two drive-
ways were installed, the street light would not need reloca-
ti on.
3. Finally, the applicant indicated that other developments
along Waterman Avenue were allowed to install two drive-ways
which are even closer together than the ones they propose.
These other properties are located on the east side of Waterman
Avenue between 4th and 5th and on the east side of Waterman
north of Mill Street.

In response to the concerns expressed by the applicant, the Traffic Engineer and
Planning Department justify their determination to allow only one drive-way with
the following information:
1. Waterman Avenue is master planned as a Major street and in
order to maintain the integrity of any Major street, the
number of driveways must be limited. As development con-
tinues to occur on Waterman Avenue, the street will become
more and more congested, a greater number of drive-ways will
only serve to worsen the problem. Driveways impede the flow
of traffic and the only control is through limitation of the
number of drive-ways permitted. Further, the possibility of
conflicts between trucks using the facility is out weighted
by the importance of maintaining a free flow of traffic on
Waterman Avenue.
2. The Engineering Department has indicated that the cost of
relocating the existing street light is not excessive and
does not justify deviation from the objectives of the
Master Plan for Major streets.
3. Finally, even though there are properties in the vicinity
which were allowed to construct multiple drive-ways in pre-
vious times, there is no justification for the City to con-
tinue to allow multiple drive-ways which are contrary to the
objectives of the Master Plan for Major streets and proper
Planning principals.
RECOMMENDATION
Staff recommends denial of the appeal and approval of Review of Plans No. 84-138
Amended #1 to permit one drive-way to serve the proposed development.

street light that will have to be relocated if we have only one
large driveway in the center of our property.
There are other locations along Waterman Avenue where the distance
between the adjacent driveways is closer than we propose: for.
