ORDIIlANCF. OF THE CITY OF SAN BERNARDINO gSTABLJSIIING NINETY DAY ~10RATORIUM UPON DEVELOPMENT, CONSTRUCTION OR OCCUPANCY IN THE STATE COLLEGE AND VERDEMONT AREAS, AND DECLARING THE URGENCY THEREOF. THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO DO ORDAIN AS FOLLOWS: SECTION 1. Findings: The following findings are made: A. A series of neighborhood meetings has recently taken place in, those areas designated as the State College and Verdemont Areas of the City of San Bernardino. During these meetings the residents of the areas expressed their concerns as to the pace and amount of housing and commercial development presently taking place in these areas. B. Through these meetings, the Mayor and Common Council of the City of San Bernardino have been made aware of the immediate, serious, and previously unanticipated, negative impacts that the present pace and amount of development is having on local schools, traffic patterns, storm drain systems, and police services in the affected areas. C. The Mayor and Common Council of the City of San Bernardino have directed that s1lch measures as are necessary or desirable to mitigate the negative impacts associated with the present pace and amount of development be prepared, processed, and presented for their consideration. D. Further construction, development or occupancy ~ay occur in the State College and Verdemont areas before the Mayor and Common Council have the opportunity to consider and enact appropriate mitigating measures. E. In order to preserve the status quo pending the <) 1 2 3 4 5 6 7 8 9 10 11 12 13 14 t 15 16 17 18 19 20 21 22 23 24 25 26 27 28 o o o consideration of appropriate planning mea:mres, and to protect the public safety, health and \'lelf~re, i.t is necessary to adopt an urgency measure to prevent development of property for a reasonable time while reviews and studies are conducted. SECTION 2. State College and Verdemont Areas Define~: The areas affected by this ordinance are described as: The extreme northwesterly portion of the City lying easterly of the 1-215 freeway, generally described as that portion west of Electric Avenue and north of 35th Street extended westerly to the 1-215 freeway and northeasterly of the 1-215 Freeway to the' northerly city limits. SECTION 3. Development Moratorium. So long as this ordinance is in effect, including any period of extension, no application for a building permit, grading permit, subdivision map, parcel map, or other authorization for construction upon or development or subdivision of any property located within the State College and Verdemont areas shall be accepted, and no such permi t or authorization shall be issued. Nothing herein shall preclude construction for which building permits have been issued and are still valid. SECTION 4. Expiration of Ordinance. This ordinance shall expire and be of no further effect on the 91st day after the date of its adopti.on unless it is continued in effect by appropriate action of the Mayor and Common Council. SECTION 5. Home Rule Powers. This ordinance is adopted pursuant to the home rule charter powers of the City of San Bernardino, granted hy the Constitution of the State of Cal Hornia. SECTION 6. Urgency. This ordinance is an urgency measure for the immediate preservation of the public peace, health or safety. Provided that it is adopted by a 5/7ths vote of the Council, this ordinance shall go into effect immediately upon its adoption and approval. The facts constituting the urgency are set forth in Section 1.
