Y .11 ,,' .. .1\1 '85 11,'R -8 All :35 7 March 1985 To the Mayor and Comrrlon Council, On YOUr March 7 meeting you denied my appeal of the decision of the Board of Building Commissioners. I would like to ask for a reconcideration of that denial based on the following reasons: First of all we are within two to three weeKs of a total approval of a VA insured loan to completely reconstruct our home. I guess the only defense I have to convince YOU that I have not been dragging my feet on this loan, is the red tape history of obtaining this loan. When YOU granted us the time to secure a loan for rebuilding, it was a Very welcome suprise. However I wasn't , prepared for presenting a val id complete package to a lender at that time. With I itigations still going on with E.F. Hutton most of my paper worK for tax preperation was with the attorney. I obtained copies of these papers as so to complete my 82 and 83 tax returns. These were needed, to be submitted with the loan pacKage along with my cost breaKdown for construction that was completed at about the same time. On December 3rd 1984 I submitted a loan package to Secure Savings Bank in Fontana. After a two weeK period had gone by I was informed that they did not do VA loans. So the search started for a lender that would deal with VA and allow my first lender to subordinate. I finally found First Interstate Bank who had just purchased Investors Mortagage Service to do the take out loan with VA approval. Although they do not do any short term loans, they worK with Upland National BanK for construction loans. Both of these banKs have found no fault with the loan package that I submitted to them. However, they can not go any further until approval from the VA is obtained. Investors Mortagage Service is now called First Interstate Mortagage Service. Along with its new name came new personnel, and inexperience as far as I am concerned. I had indicated to the loan officer that the city Mayor and Common Council's pressure for completion of reconstruction would not allow for any delays. And did my loan package meet all of the VA requirements before submission. She (loan officer) assured me that she understood my situation and that the loan package looKed complete to her. ~7 , , o o o o This was in January of 1985. This was also the end of the 90 day p~rjod that yOU had granted me for securing this loan. At your second meeting in January, I reported back to YOU this u~r/ information. That both the take out and new construction lenders were awaiting VA approval. At that meeting YOU extended my time to the first meeting in March for my loan progress report. One week after your second meeting in January my loan package was returned to me from the VA asking for additional information. It was a request for my contractor to fill out VA forms to be put into their records as all contractors must be recorded with the VA to be in compliance with their procedures. Second my Discription of Materials form was returned for the contractors' signature and a better discription of the carpet I had listed with the name of the Certified Products Directory from which the discription came from. Also exact make, model and location of built-in equipment. And last 4 complete sets of plans in addition to the one I had already submitted. It tooK me about four days to meet these requests. Before 1 returned the pacKage to the VA. I called them and talked to the investigator, Mr. A. A. DOOley, personally and asked at that time if that was all he required for my package to be complete and not returned again for anything that might be missing. He assured me that that was all he needed to approve the package. So I confirmed this with the loan offIcer at First Interstate Mortagage Services and promptly mailed the complete loan package back to the VA. On February 14, 1985 I received my Discription of Materials and another request for more information back from the VA via First Interstate Mortagage Services. This time they asked for 4 sets of heat plans and 4 sets of heat calculations along with a Title report with a plot map and a plot plan including elevations. I immediately called Mr. Dooley at the VA and asked WHY he had told me that all was correct and complete when 1 last had talked to him in January. He indicated his regrets and that he had over looked these items, but that it ~houldn.t be a problem since the city had already aproved my plans and this information should be on record with the city. 1 called the Building and Safety Dept. directly after talking to the VA and talked to Dean Pagle and George. They said that this information was not required by the city and none of these items were in my file. Being upset I called First Interstate Mortagage Services again asking my loan officer why she was not aware of all that was needed for a complete loan package before submitting to the VA. Her responce was unacceptable to me. After investigating procedures for completing these new requests from the VA I found that my March dead line was very near, so 1 called Mr. Rosenbaugh to let him know what I o o o o was up against in such a short time frame. He seemed unconcerned and offered no help or suggestions. The progress that I have made on these last set of requests from the VA are as follows: I went to Commonwealth Land Title Company and paid a $150.00 fee for a title report which I received bacK dated Feb. 15, 1985 at 7:30 A.M. showing all I expected and more. Before the fire I had a second mortagage with Associates Financial Services Co. of Cal ifornia Inc. which I have a paid receipt dated 1-28-81. In talking to Associates Finance Co. asKing why a reconveyance was never filed at the time I satisfied the note. Their reply was that since the office the loan was originated from was no longer at that location and because I paid the note off at the San Bernardino office it must have been over looked. First Interstate Mortagage Services informs me that the VA requires a reconveyance to be submitted for all satisfied leins. So I have sent $40.00 to Dove Escrow Co. in Tustin, Ca. $35.00 for the reconveyance and $5.00 to record it in the San Bernardino County Hall of Records which will then be sent to my address in San Bernardino. The Plot Map of coarse came with the title report. I have a transit and my wife and I shot the property on Feb., 24 1985. So I have a complete Plot Plan with elevations included. I have drawn a completely detailed heat plan for the first and second floors. I will have DiLine make 4 copies for the VA. I contacted the American Society of Heating, Refrigerating and Air Conditioning Engineers, Inc. and prepaid $35.00 for their Cool ing and Heating Load Calculation Manual. I received it on the 4th of March 1985. I've worked all week on the calculations and it should be completed after this weekend of the 9th and 10th of March. To sum this all up I am inches away from having a complete and valid loan package for the VA and now YOU have brought this all to a disaster with your decision today. Please read this request carefully and grant me the time to complete what we all really want, our home completed and part of our community again. I can't see how your decision today will benefit the city, the neighborhood or us.
