At the Regular Meeting of the Board of Directors of the San Bernardin69 i~
Valley Municipal Water District held on March 4, the Board took actiou:;: ...
to form a Senate Bill 148 Legislative Advisory Committee. This Commitree
will study the proposed legislation relating to the management of the
Bunker Hill Grotmdwater Basin and make recommendations to both the SBVM\'D
Board of Directors and the High GrolDldwater Task Force.

The Advisory Committee will include representatives from each of the'
water agencies and districts as shown on the attached sheet. At this
time I would invite your organization to designate a representative to
serve on this Committee. Your representative will be serving in a dual
role as both a member of the Senate Bill 148 Legislative Advisory
Committee to this Board and of the Basin Management Legislative Sub-
Committee to the High Groundwater Task Force.
The first meeting of the newly-formed Legislative Advisory Committee will
be held on Thursday, March 14, at 9:00 a.m. in the offices of the San
Bem.ardino Valley Mlmicipal Water District. At that time the Committee
will select a neutral moderator to serve at future meetings. I would
appreciate having the name of your designated representative prior to
that meeting. (You may use the enclosed form and envelope for your
convenience.) Due to the legislative calendar time is of the essence.
We suggest that your agency and representative give this matter your
immediate attention.

TO: MEMBERS OF THE BASIN MANAGEMENT LEGISLATIVE SUBCOMMITTEE

Senator Ayala has rescheduled the Senate Water and
Agriculture Committee hearing on SB 148 for March 19, 1985. In
order to prov ide the Senator with local comment regarding this
bill, the Basin Management Task Force is requesting you to review
and comment on SB 148 by section and line number or add sections
as you feel appropriate. Please provide the Task Force with your
comments on or before March 8, 1985. All comments should be
delivered to the East Valley Water District, 1155 Del Rosa
Avenue, San Bernardino, CA. 92410 marked for my attention.
Your comments will be consolidated with comments of the
other agencies by the legislative subcommittee and presented to
the full Task Force on March 15, 1985.
In order to provide Senator Ayala with input prior to the
hearing the following schedule was agreed upon at the Task Force
meeting held on February 28, 1985:

Presentation of legislative subcommittee recommendations

The Task Force has selected a legislative subcommittee
comprised of the agencies as shown on the attached sheet. The
San Bernardino Valley Municipal Water District Board of Directors
will consider constituting the Task Force Legislative
Subcommittee as a special advisory committee which will report to
the San Bernardino Valley Municipal Water District Board of
Directors. It is envisioned that this approach will provide a
co-ordinated approach to the issues raised in SB 14. .and reduce
potential confusion.

SAN BERNARDINO - In a unanimous vale, the dlreclors of
the San Bernardino Valley Municipal Water Distrlcl said Monday

The question of whelher Ihe Valley DiSlrlcl should adoptlhal
role arose during a discussion of Senale Bill 148, legislation pro-
posed by Sen. Ruben S. Ayala, D-Chino, 10 eslabllsh such a man-

neath San Bernardino,
" Ayala Inlroduced the legislation lasl year. The senator, had
been threatentng to sponsor such legislation for several years
, because he felt local water agencies were taking too long,tc)' find
solutions to a high groundwater problem tbal bas been causing
flooding in soutb,San Bernardino for alleasllhe past four years.,
Director George Aguilar first raised the question of the Val-
ley District laking on tbe management responsibility, saying the
directors should deCide Whether they want that role before debat-
Ing otber aspects of tbe proposed legislation.
, Board President Henry Van Mouwerlk said the'dlstrlctsbould
be tbe managing agency because it already bas some of tbe nec.
essary resources, including researcb data on the area's under-
ground water storage basins and a mecbanlsm for financing.
Director Patrick Milligan added that the Valley District Is the
only one in tbe area wllh a state contract to bring In supplemental
water, It Is also tbe only agency that encompasses all of the af.

Direclor Bill Katona made the motion, which said the dlrec.
tors suggest thai the proposed legislation name their district as
the managing agency for groundwater within its boundaries. It
was seconded by Milligan.
Director Margaret Wright said she was concerned that others

In related business, the directors unanimously approved hir-
ing John Mann Jr" a consulting geologlsl and hydrOlogist from La
Habra, to help them drafl a groundwater management bill thai
can be submilled to Ayala as a substitute for the legislalion he has
already Inlroduced,
MllIlgan said Ills his understanding that although a draft of
the bill has been Introduced, Ihe purpose of II was to hold a
position open for a rewrlllen bill that would be acceptable to local
water agencies.
On a 4-1 vote, the dlreclors also agreed to form a Senate Bill
148 Leglslalive Advisory Committee to sludy the legislation and
make recommendations to the Valley District directors and the,
High Groundwater Task Force. The committee will consist of one
representative from each of 16 valley waler agencies and a neu-
tral moderator. '
Kalona, who seconded the motion, vOled against II because he
objected to the neutral moderator. lie sald 'committee members
should select a moderator from amungsl lhelll::ielv~s. A separate
moderalor would be 100 expensive, he said,
Valley Dlslrict General Manage" G, Louis Flelcher said the
neutral moderator Is necessary becaul;ic there are contracts, be-
tween many of the member agencies, resulting in conflicts of
Interest,

. The latter comment was a reference to criticism leveled
against the Valley Dlstrlcl board allls last regular meeliug by San
Bernardino Mayor W.R, Holcomb, Holcomb accused Ihe dlreclora
of stalllng'an agreementlhal would allow Ihe saie of some of Ihe
Bunker HUI Basin's surplus water to the Orangc County Water
District. '
"The mayor came here and accused us of being non.func~
tioning and obstructionists. He was very vociferous in his com-
ments," Van Mouwerik said.
The agreement has since been approved by all five agencies
involved excepl for San Bernardino, he said, The San Bernardino

Van Mouwerlk said he was surprised Holcomb had not called
a special couneH session to get the agreement signed as soon as
possible, ralher Ihan waltlllg for the Thursday meeting,
"Apparently we are not the obstructionists, we are not non-
functioning. we are nOllhe inactive ones, Brother Bob (Holcomb)
is the non.functioning one, The ball i; in his court and has been
for some time," Van Mouwerik said,
During Ibe earlier meeting, Holcomb called Ihe process by
which the agreement to sell water to Orange County was devel-
oped a charade,
