STAFF REPORT
This action is the result of a petition from 100% of the adjoining
property owners to improve the street.
The purpose of the action is to preliminarily determine that the
public convenience and necessity require the formation of an improve-
ment district; declaring the intention to proceed to order work within
the district to be known as the "Lassen Street Improvement District".
It is proposed that the City up-front the money for this project and
recoupe through assessments on the tax rollover a period of 10 years
at 10% interest per annum ~n the unpaid balance. The Engineer's
estimate of cost is $91,780.00.
Pursuant to Ordinance MC-349, notice and hearing will not be required
as 100% of the owners of the property to be assessed have requested
the district.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO PRELIMINARILY
DETERMINING THAT PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE
FORMATION OF A STREET IMPROVEMENT ASSESSMENT DISTRICT; DECLARING
ITS INTENTION TO PROCEED TO ORDER WORK WITHIN THE DISTRICT, TO BE
KNOWN AS "ASSESSMENT DISTRICT NO. 965, AND WAIVING NOTICE AND
HEARING, AND DIRECTING RECORDING OF THIS RESOLUTION, THE AGREEMENT
INCORPORATED HEREIN, TOGETHER WITH THE ASSESSMENT DISTRICT MAP OF
ASSESSMENT DISTRICT NO. 965.
WHEREAS, the City of San Bernardino hereafter called
("City") as an exercise of its municipal affairs powers has
enacted an Assessment District Ordinance (Municipal Code Chapter
12.90) to provide for the procedure for the formation of
assessment districts within the City; and
WHEREAS, it has now become necessary to consi der the
formation of a street improvement assessment district within the
City, to be known as "Assessment District No. 965";
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR ANO COMMON
OUNCIL OF THE CITY OF SAN BERNARDINO THAT:
SECTION 1.
Pursuant to Chapter 12.90 of the San
Bernardino Municipal Code, the Mayor and Common Council of said
ity, hereby preliminary find and determine that the public
onvenience and necessity require and it is the intention of the
[Mayor and Common Council to form Assessment District No. 965, the
I oundaries of which are generally, as follows: generally bounded

Reference is hereby made to the Engineer's Report on file in the
office of the City Clerk of said City for a map of the
boundaries of said district, a description of the type of
improvement, an estimated cost of the improvement and a proposed
assessment roll which Report and Assessment District Map are
hereby approved.
SECTION 2.
It is the intention of said Mayor and Common
Council
to order improvements within the district
which
improvements
consist of,
but are not limited
to,
the
construction and installation of portland cement concrete curbs,
gutters, asphalt concrete paving, dikes, water lines, street
lights,
culverts, drainage facilities and all appurtenant
facilities in Lassen Street, North of Baseline Street and in
Baseline Street between a point approximately 5S0 feet East of
Lassen Street and a point approximately 800 feet West of Lassen
Street.
The estimated cost of said construction, including inci-
dental costs is $91,780.00.
SECTION 3. Said contemplated work and improvements is of
more than local or ordinary public benefit, and that said Mayor
and Common Council do hereby make the expense of such work and
improvement chargeable upon the district, which district is
hereby declared to be the district benefited by said proposed
work and improvement, and to be assessed to pay the cost and
expense thereof.
All public streets or alleys, or portions
thereof, hereby are excepted from said assessment.

lowed and the amount to be assessed against each particular
parcel will be assessed against the owners of the property at
the rate of 25t of the total cost of the assessment resulting
from said proceedings and construction of improvements, which
25t is to be levied against the properties owned by said owners
lying within the boundaries of the assessment district pursuant
to the Agreement attached hereto as Exhibit "A" and made a part
hereof as though fully set forth at length herein. Reference is
hereby made to said Engineer's Report on file in the office of
the City Clerk for a detailed estimated individual assessment.
SECTION 5.
The assessment financing alternative to be
followed shall be as follows, to-wit:
The cost of the construction shall be pre-funded by the
City and the assessment levied, collected and enforced in the
same manner, at the same time, and with the same penalties and
interest as in the case of taxes levied for the City for the
repayment to the City of said pre-funding.
The assessment for said district shall be made and
collected as follows:
The cost of the improvement will be
collected over a period of ten (10) fiscal years and will bear
interest at the rate of ten percent (lOt) per annum on the
unpaid ha1ance on all assessments which remain unpaid for thirty
(30) days from the date of the first pUblication of the Notice
of Assessment.

SECTION 7.
A copy of this resolution and a map showing
he exterior boundaries of the proposed improvement district with
elation to the territory immediately contiguous thereto and to
the proposed improvement will be on file with the City Clerk and
ill be available for
inspection by any person or persons
nterested. This map shall govern for all details as to the
xtent of the proposed improvement district.
SECTION 8.
The City Clerk is directed to record a copy
ff this resolution and the agreement incorporated herein, together
ith the Assessment District Map of Assessment District No. 965.

establishing the method of assessment relative to an Assessment
District to be known as Assessment District No. 965.

We, the undersigned, owners of property fronting on Lassen
Street, North of Baseline Street in the City of San Bernardino,
County of San Bernardino, State of California, have heretofore
requested that the City of San Bernardino initiate proceedings to
establish an assessment district for the improvement of said
Lassen Street under th~ provisions of Chapter 12.90 of the San
Bernardino Municipal Code. The undersigned comprise all the
owners of property within the district to be established. Each
owner represents and agrees that the allocation of costs herein
assesses the total sum upon the several parcels benefited in
proportion to the benefits to be received by said parcel.
Each of the respective OImcrs I.ho have signed this agreement
hereby requests and agrees to pay 25%.of the total cost of the
assessment resulting from said proceedings and construction of
improvements, which 25% is to be levied against the properties
