AQenda Item No. (r;s) ITII II CI10 OF SAN BERNARDIQo - REQUEOr FOR COUNCIL AcQON STAFF REPORT , By letter dated February 14, 1985, considered by the Mayor and Common Council on February 18, 1985, Robert E. Schaefer alleges that the demolition permit issued for the California Hotel was unlawfully issued to a contractor without the requisite contractor's license, contending that a B license holder cannot have a prime contract on a demolition project even though he subcontracts the actual work to a C-2l license holder. He contends that pursuant to Business & Professions Code Section 7057 and Title 16 Sections 834 and 832.21 a general building contractor, a B license holder, cannot take a prime contract unless it requires three unrelated building trades or crafts or that he must hold a required speciality license which, in this case, is Class C-2l for a building demolition contractor who removes and demolishes structures including their foundations. A building permit for the complete demolition of the California Hotel, store fronts, swimming pool and basement, was issued on January 25, 1985, to Gary Duncan who signed on behalf of the applicant Romana A. Banuelos who, Mr. Duncan indicates, is the President of the Pan American Bank, the present owner of the California Hotel. The permit lists the owner of the California Hotel as Pan American Bank, the contractor as Construction Unlimited, which is the business of Gary Duncan, and Gary Duncan affirms thereon that he is licensed under Chapter 9 of Division 3 of the Business & Professions Code. Kamal Girgis and Gary Duncan advise that the California Hotel is being purchased by Mr. Girgis with Gary Duncan to have an interest in it. The property is in escrow which should close around March 14, 1985 or later. Mr. Duncan states that he has applied for a C-2l speciality license and that he will obtain a C- 21 licensee to currently work on the demolition project. The plans for the proposed 8-story senior citizens building are not finalized. Thus, a construction contract has not been let. Apparently, Mr. Duncan and Mr. Schaefer have both been in contact with the State Contractor's License Board and its enforcement personnel and provide conflicting statements concerning the licensing requirements. The State Contractor's License Board is the proper agency to enforce the licensing requirements and Mr. Duncan is taking action to comply with its requirements. They stated they were in escrow to buy the CalHornia Hotel and their plan was to demolish the hotel and build an eight story home for the retired. They said their escrow instructions gave them ninety days to demolish the building. Mr. DUncan said he was a B-1 'contractor and that he would be in charge of demolition and of building the new project, He stated he planned to hire Pres co Building Materials and Jay's Crane Service for part of the demolition work. He also stated that during this time he would be working with the City's various departments on the rebuilding project. It is not uncommon for the general contractor to want complete control of a project through his sub-contractors. Permit was issued. Due to the nature of possible complaint of our actions. a precaution check was made through the 1 oca 1 State Contractors License Board located i nSan Bernardino to Mr. Moreno, Senior Deputy. He confirmed Gary Duncan had a B-1 license and also confirmed our practice of issuing permits to B-1 contractors who have a proposed project. Mr. Schaefer came to our office protesting our action of issuing permits. I told him I was ,satisfied with our action and he should check with the State Contractors License Board if he was not satisfied. I checked with Mr. Moreno again and he said he would bring a State Contractors License Board interpretation to our office. He said it'was an,old interpretation (1970) but 'itwas still valid (attached). ' This interpretation concurs that a B-1 contractor can do a project. I also talked to Mr. Schneider., Supervising ,Deputy, State Contractors Board. San Bernardino, who said Mr, Schaefer had asked him many questions completely out of context in relation to the California Hotel. Mr. Schneider also confirmed our issuance of a permit to Mr. Duncan.
