Sierra Way, for utilization as a Police Community Service Office. Resolution #8495 Recommended motion: That the lease renewal at 4222 N. RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF A LEASE WITH ROBERT WHITESIDE FOR PREMISES LOCATED AT 4222 NORTH SIERRA WAY FOR USE AS A POLICE COMMUNITY SERVICE OFFICE OR OTHER LAWFUL PURPOSE. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City a Lease with Robert Whiteside for premises located at 4222 North Sierra Way for use a a police community service office or other lawful purpose, a copy of which is attached hereto, marked Exhibit "A" and incorporated herein by reference as fully as though set forth at length. Landlord and City agree as follows: 1. Recitals. A. Landlord is the owner of the premises described as 4222 North Sierra Way in the City of San Bernardino and desires to lease said premises to City for use as a community service office by the Police Department of the City of San Bernardino, and for other lawful purposes as determined by the City. B. City desires to lease the premises from Landlord pursuant to the provisions stated herein. 2. Description of Premises. Landlord leases to City, and City lets from Landlord, as herein provided, the premises located at 4222 North Sierra Way, City of San Bernardino, County of San Bernardino, State of California, and appurtenant rights. City shall have full and unimpaired access to the premises at all times and the nonexclusive right to use common areas, including parking areas. 3. Term. The term of this lease is one year, beginning April 1, 1985, and ending March 31, 1986. 4. Rent. The total rent of this lease is the sum of TWO THOUSAND NINE HUNDRED AND FORTY DOLLARS ($2,940.00). City agrees to pay Landlord said amount in installments of Two Hundred and Forty-five Dollars ($245.00) per month. Use of Premises. The premises are leased to be used as and for a community police center or for any other lawful public purposes. 6. Payment of Utilities. City shall pay for all utilities furnished the premises for the term of this lease, including electricity, gas, water, rubbish removal and telephone service. 7. Duty to Maintain and Repair Premises. City shall maintain all internal portions of the premises in good condition and shall keep windows and doors in good repair. The Landlord shall be responsible for the exterior of the building, except windows and doors. City shall be liable for any damage to windows and doors and for any damage above ordinary wear and tear to the interior of the premises resulting from the act or omission of the City or its authorized representatives, but not from other persons. 8. Fixtures. City shall have the right to install such fixtures as are necessary for the proposed use of the premises, and such fixtures shall not become a part of the real property. 9. Alterations of Premises. City may make such repairs and improvements as are required to fit the premises for the proposed use. 10. Option to Renew. Landlord grants City an option to renew this lease for a period of one year after the expiration of its original term, on the same terms as this lease. Landlord agrees to procure and maintain in force during the term of this lease and any extension thereof, at its expense, fire insurance on the real property in an amount sufficient to protect Landlord's interests. 12. Signs. City may erect or display, on the leased premises, any sign or advertising matter depicting the public use of the premises. 13. Office Furniture, etc. All office furniture and equipment, listed on the attached addendum, Exhibit 1 hereto, shall be included in the lease at no additional cost to City. Maintenance of the office furniture and equipment shall be at the expense of the City. 14. Hold Harmless. City shall hold Landlord harmless from all damages arising out of any injury to any person or property occurring in, on or about the premises, except the Landlord shall be liable to City for damage resulting from the acts or omissions of Landlord or his authorized representatives, and Landlord shall hold City harmless from all damages arising out of any damage caused by him or his authorized representatives. 15. Termination. City shall have the right to terminate this lease for any reason by giving two weeks' advance written notice to Landlord, and this lease shall terminate two weeks thereafter. 16. Amendment.
