The necessary additional right of way has been acquired and construction will start in the very near future. CI,Q OF SAN BERNARDI.:b -' REQUEOr FOR COUNCIL AC-hbN STAFF REPORT It is necessary that the inspectors have offices at the site of construction of Tippecanoe bridge or as close as possible to the construction site. The contractor for the bridge will not have a "field office" at the site which usually means that the inspectors would also have a trailer or field office on location. There is not enough room presently, with necessary furniture, in the Engineering Department for two temporary inspectors. Because of thi s fact, there was a survey of the area for a temporary office near the construction site, and the offices were available on East Mill Street near the site with what we believe is a fair monthly rent. I o Q o A G R E E MEN T (Business Office) THIS AGREEMENT is made and entered into this day f . 1985, by and between the Leonard Lindberg hereafter called Landlord, and The City of San Bernardino. a municipal corporation. hereinafter called "Tenants". WIT N E SSE T H WHEREAS. Landlord is the Owner of certa in rea 1 property which has situated thereon business and office buflding. and said roperty is located at 880 East Mill Street. Suite 203, San ernardino, California; and WHEREAS, while said office space 15 vacant, and WHEREAS, Tenants desire to occupy and rent said office pace in accordance with said terms and conditions. NOWTHEREFORE. in consideration of the mutual terms, ovenants, provisions and detrimonts herein contained, it is greed as follows: 1. Property - Landlord hereby rents to Tenants the ffice space situated upon real property described as located at 80 East Mill Street, Suite 203. in San Bernardino. California. 2. Term The term of this agreement shall be on a onth-to-month basis, commencing February 18, 1985 , rovided, that the maximum term shall not exceed 18 months. unless here is a written request from tenant to extend this agreement. Pu!:.J!..!!.~!.~ Tenants shall use the premises xclusively for a field office by the City Engineering Department during the construction of the Tippecanoe Avenue Bridge, at the Santa Ana River. 4. Utilities ------ landlord agrees to pay before elinquent all charges for water, electricity, gas or other utilities provided or furnished or used on the premises during the term of this agreement and the period of time that Tenants are in possession of the premises. Tenant agrees to bear the cost for telephone service. 5. Access to premi ses landlord shall have access to said premises at any and all reasonable times to inspect same to etermine compliance with this agreement by Tenants. 6. Maintenance landlord shall be responsible for aintaining the premises in a secure condftion during the period f this agreement and shall protect the premises from all damage rom vandalism, malicious mischief, and the like. Custodial ervices shall be provided daily by the landlord. 7. Tenants shall not make any improvements to the premises without the prior written consent of landlord first ob ta i ned. 9. liens Tenants agree to keep the premises free and clear of all mechanic's liens that might arise out of making repairs or improvements on said premises. 10. Tenants shall comply with all sanitary laws, ordinances and rules and all orders of the Board of Health or other authorities affecting the cleanliness, occupancy and preservation of the premises and the sidewalk connected thereto during the term of this agreement. 11. landlord shall keep the fixtures in the buildings or on or about the premises in good order and repair; keep the faucets in repair; keep the premises clean; keep any electrical valves in order; and, at their own expense, shall make all re- quired repairs to the plumbing, range, heating and cooling apparatus and electrical and gas fixtures. Tenants also agree that no signs shall be placed or painting done on or about the premises without the prior written consent of landlord. 12. At all times hereunder landlord, or its agent, shall have the privilege of placing "for sale" signs on the premises and of Showing the property to prospective purchasers. 13. In the event the premi ses or any part thereof are damaged by fire or other casualty, then Landlord's responsibility to Tenants under this agreement is terminated forthwith. 14. Should Tenants default in any of their obligations hereunder or in the performance of any other covenants and agreements herein contained, this agreement. and the relation of landlord and Tenants, at the option of Landlord shall wholly cease and terminate and Landlord may re-enter the premises and remove all persons and property therefrom. 15. Either party may terminate this month-to-month agreement at any time by giving written notices of termination to the other party at least thirty (30) days prior to the desired termination date. 16. All improvements and fixtures which may be placed on the property by Tenan ts sha 11 be removed wi thi n fi ve (5) days after termination of Tenants' occupancy under this agreement as provided for elsewhere herein.
