I wish to, appeal the decision made by the San Bernardino
City Planning Conunission on January 22, 1985, Tract No. 12896
and Conditional Use Permit No. 84-66, with the basis for appeal
referenced to the approved density bonus for 25% increase over
the current zoning designation.
The Council has expressed its concern over the increased
requests for density bonuses and the effect of these on de-
velopment within the City. Therefore, I request the Council
negotiate the density bonus request and reconunend bond financ-
ing be applied in lieu of granting a density bonus.
I would like to have this item placed on the agenda for
the next City Council meeting, or as soon as possible.

Dear Mayor and Common Council:
I wish to appeal the decision made by the San Bernardino City Planning
Commission on January 22, 1985 reg~rding Tract No. 12896 and conditional use
permit No, 84-66 and Tract No. 8991 and conditional use permit No. 84-71 on the
basis of lack of school facilities,
The local elementary and Junior High schools in the area are at or near capacity
and there is no property and money allocation in the immediate area (i.e"
tracts referenced above) for future schools, There is currently a lot of
building being done and already approved for this area. Furthermore, the San
Bernardino Unified City School district,is currently working out a school
requirement plan.
I request a delay of any additional building approvals on area properties until
the school plan has been completed and reviewed. Additionally, I request a
traffic study be performed with regard to crosswalks and child safety,
I would like to have this item placed On the agenda for the next City Council
meeting, or as soon as possible.

At the meeting of the Planning Commission on January 22, 1985, the
following action was taken:
The applications for Tentative Tract No. 12896 and Conditional Use Permit
No. 84-66, to establish a one-lot, 312 unit planned residential development
in the PRD-14U Planned Residential Development zone at 14 units per acre
on property consisting of approximately 18:1 acres located at the northeast
corner of College Avenue and University Parkway and 'having a frontage of
approximately 507 feet on the north side of College Avenue and a frontage
of 1,847 feet on the east side of University Parkway, were approved based ,
upon findings of fact contained in the staff report dated January 22, 1985 \
and subject to the conditions and standard requirements .listed therein.
According to the San Bernardino Municipal Code, Chapter 18.20.130., the
following applies to the filing of a tentative tract map: (This provision
would also apply to the'filing of a conditional use permit.)
liThe decision of the Commission shall be final unless appealed to the Mayor
and Common Council in writing. The written appeal shall be submitted to the
office of the City Clerk within ten days from the date of the meeting."
If no appeal is filed pursuant to the above provisions of the San Bernardino
Municipal Code, the action of the Commission shall be final.

1. The applicant is requesting a one-lot subdivision from two existing
lots of 3.69 acres and l4.55 acres in order to construct a 312 unit
apartment complex in the PRD-14 u/ac zone. In conjunction wi th the
above requests, the applicant is requesting a 23% density bonus for
low and moderate income housing per State Law resulting in 59 addi-
tional units above the maxium density of the existing PRD zone and
General Plan designation of residential 8 to l4 units per acre.
2. The property is located on 18.1 acres on University Parkway between
State Street and College Avenue which surround the parcel. Access is
achieved via a 32-foot dirve with landscaped medians to both College
Avenue and State Street ~th two 24-foot wide loops for site cir-
culation. The following is the unit breakdown of the proposed
project:

The units meet the minimum floor area requirements as established by
Department policy and upcoming R-3 ordinance amendments. They are
formed in thirty, two-story buildings of four types ranging from eight
to twelve attached units per building.
3. The subject property is currently vacant and zoned PRD-14 u/ac. The
property to the south is also vacant and zoned R-3-3000. Abutting the
site to the east is a 6.l acre site owned by Southern California
Edison for powerline purposes. This property is zoned R-3-3000 but is
undevelopable due to its current use. Further easterly across State
Street are single-family residences zoned R-1-7200. Properties to the
west across University Parkway are also zoned and developed for
R-1-7200, Single-Family Residential land use.

4. Previous site approvals include Conditional Development Permit No. 983
and six Tentative Tracts 1150l through l1506 approved by the Mayor and
Common Council on August 18, 1980. The tracts proposed a 192-unit
condominium project at approximately II units per acre. The tracts
expired on April 18, 1984. Change of Zone No. 84-18, recently
approved by the Mayor and Common Council on August 20, 1984, per the
recommendation of the Planning Commission changed the zoning on the
property from PRD-11 to PRD-14 which is consistent with the
surrounding densities southerly and easterly.

5. The subject request for a density bonus would permit,a density of
approximately l7.2 acres or 4 units per acre in excess of the per-
mitted 14 units per acre. State Law permits a density bonus of 25% if
it can be indicated and guaranteed that at least 25% of the units will
be utilized for housing for low and moderate income housing. The
applicant submitted a Developers Agreement indicating this involvement
with a Mortgate Revenue Bond Program with the City Redevelopment
Agency. Due to th ei r i nvo 1 vement in th i s program, th e maxi mum
allowable rents for at least 25% of their units are controlled. These
maximum allowable rents would fall within the low and moderate income
rental categories. However, the City Attorney's office has advised
the City Council and Planning Department that the financial advantages
to a developer participating in a Mortgage Revenue Bond Program which
.permits a write-down of long-term interest satisfies the spirit and
intent of the Density Bonus provisions of the State Law with regard to
other bonus incentives. Therefore, the City by providing a density
bonus in addition to the Special Bond Financing would exceed the
requirements of State'Law relative to providing low and moderate
income housing. In addition, the Mayor and Common Council are in the
process of establishing policy concerning density bonuses.
6. In addition to the provi sion of low and moderate income housing, the
applicant is in the process of requesting a license for improving and
maintaining the adjacent Southern California right-of-way. Edison Co.
has indicated that it has no objection to the granting of the license
request subject to certain conditions which guarantee that no activity
'or development will interfere with the use of the property as a
powerline right-of-way. They also indicated that the agreement should
be ready for formal execution in February. Attached is a letter dated
December 18, 1984 to that effect. The provision of landscaping in
this right-of-way would provide a visual buffer between the density
proposed by this development and single-family residential uses across
State Street, an existing 60 to 70 foot right-of-way. Landscaping
will also provide an additional 6 acres of passive open space which
can be utilized by the residents of the subject development as well as
surrounding existing and future developments.
7. The development provides 624 parking spaces, one covered space per
unit, as required by the provisions of the PRO zone. Open spaces abut
the landscaped Edison right-of-way, College Avenue and University
Parkway for the most desirable visual image from the exterior of the
project. A bermed parkway will be provided on both College Avenue and
Uni versity Parkway whi ch wi 11 i nc lude meanderi ng si dewa 1 k s, extensi ve
landscaping to match adjacent developments, and combination decorative
block wall and wrought iron fencing. The site coverage of 22.4% for
,buildings and structures is well within the 40% maxi~um of the PRO

zones. The total open space provided is 45%, but only approximately
32% can be included as functional open space as defined by the provi-
sions of the PRO zone. This percentage still exceeds the minimum
required 25%. The applicant has provided three recreational areas on
the submitted site plan which include a tot lot, pool/spa, and a spa.
It is the policy of the Planning Department to require more major
'active recreational areas for projects of this size. Therefore, a
condition has been added which would require the spa area in the
southerly part of the development to be expanded to also include a
major recreational facility.
8. On December 26, 1984, the Environmental Review Committee determined
that the project would not have a significant effect upon the environ-
ment. The Committee noted that the property was within a High Fire
Zone and above the High Wind Line which can be mitigated upon develop-
ment. A traffic report prepared for the project concluded that the
t ri ps generated by the proposal wi 11 be si gnifi cant1 y greater than
those generated by the previous development due to the higher genera-
tion factors associated with the increased number of units. The
report recommended that the interchange ramps at State College Parkway
and 1-215 be revised. The report also indicates that a traffic signal
will be needed at University Parkway at College Avenue. Therefore,
the City Engineer will require a fee for the proportionate share of
the cost of the signal.

Prior to the approval of final plans or recordation of the tract, the
applicant shall obtain from the Planning Department approval of a
fencing plan to include a combination decorative masnonry and wrought
iron fence to a height not to exceed 6 feet on the perimeter property
lines adjacent to College Avenue and University Parkway.
2. Prior to approval of final plans, the applicant shall submit a revised
site plan which indicates an additional major recreational area to
include a major recreational amenity such as a pool in that phase of
the project closest to College Avenue.
3. All sidewalks, public and private shall be designed to meander and be
integrated with 1 andscapi ng and earth moundi ng as shown on the
approved Master Landscape Plan.
4. All refuse storage areas shall have wooden gates.
5. Prior to recordation of the final map, an Assessment District shall be
formed to address the installation and maintenance of the landscaped
parkway area, or provision for such installation and maintenance shall
be included in the C.C.&R.'s,
6. Prior to recordation of the final map, the applicant shall submit to
the Planning Department, a copy of the formal executed agreement bet-
ween the owner and Southern California Edison Co. regarding the
installation and maintenance of landscaping. Maintenance for the
landscaped Edison property shall be provided for in the C.C.&R.'s.
7. The applicant shall provide a minimum of five (5) landscaped parking
stalls.

RECOMMENDA Tl ON
Staff recommends adoption of the Negative Declaration and approval of
Tentative Tract No. l2896 and Conditional Use Permit No. 84-66 based on the
observations and findings contained herein.
In view of the applicant's request for both a density bonus and low
interest bond financing through the City's Redevelopment Agency, the
Planning Commission may wish to consider approving only one of the two
above requests since either of the two requests by itself would satisfy
State Law in regards to the City providing for low and moderate income
housing. A third option would be to continue the item until the Mayor and

RESIDENTIAL DEVELOPMENT
Tentative Tract 12896
shall be in effect for a period of 24months from the
date of approval by the Planning Commission and/or Planning Department.
However, if no development has been i ni ti ated at the end of the 24 -month
time period the approval shall expire. Additional time may be approved
by the Planning Commission upon request of the applicant prior to ~~ira-
tion of the 24-month time period. Expiration Date: January 22, 19l:1/.

COVENANTS, CONDITIONS AND RESTRICTIONS FOR P.R.D.
a. The Covenants, Conditions and Restrictions (CC&R's) shall be reviewed
and approved by the Planning Department prior to final approval of the
tract maps. The CC & R's shall include liability insurance and methods
of maintaining the open space, recreation areas, parking areas, private
roads, and exterior of all buildings. The CC&R's shall also include
a statement that no radio frequency antenna shall be included within
the complex except for central antenna systems.
b. No lot or dwelling unit in the development shall be sold unless a cor-
poration, association, property owner's group, or similar entity has
been formed with the right to assess all properties individually owned
or jointly owned which have any rights or interest in the use of the
common areas and common facilities in the development, such assessment
power to be sufficient to meet the expenses of such entity, and with
authority to control, and the duty to maintain, all of said mutually
available features of the development. Such entity shall operate under
recorded CC&R's which shall include compulsory membership of all
owners of lots and/or dwelling units and flexibility of assessments to
meet changing costs of maintenance, repairs, and services. Recorded
CC&R's shall permit enforcement by the City of provisions required by
the City as conditions to approval. The developer shall submit evi-
dence of compliance with this requirement to, and receive approval of,
the Commission prior to making any such sale. This condition shall not
apply to land dedicated to the City for public purposes.
c. Every owner of a dwelling unit or lot shall own as an appurtenance to
such dwelling unit or lot, either (1) an undivided interest in the com-
mon areas and facilities, or (2) a share in the corporation, or voting
membership in an association, owning the common areas and facilities.
d. Maintenance for all landscaped and open areas, including parkways,
shall be provided for in the'CC&R's.

The CC&R's shall contain wording prohibiting the storage or parking
of trailers, boats, campers, motor homes, and similar vehicles outside

All parking and driving aisles shall be surfaced with two inches of AC
over a suitable base or equivalent as approved by the City Engineer.
Parking spaces shall be striped and have wheel stops installed at least
three feet from any building, wall, fence, property line, or walkway.
Whenever an off-street parking area is adjacent to or across an alley
from property zoned residential, a solid decorative wall six feet in
height shall be erected and maintained along the property line so as to
separate the parking area physically from the residentially zoned pro-
perty, provided such wall shall be three feet in height when located
within the required front or street side yard setback. Where no front
or street side yard is required, such wall shall be three feet in
height when located within ten feet of the street line. Said wall
shall be located on the north X ,south X ,east , west X or

Whenever an off-street parking area is located across the street from
property zoned for residential uses, a solid decorative wall or equiva-
lent landscaped berm not less than three feet in height shall be

obscure the required front setback landscaping. Said wall shall be

All parking areas and vehicle storage areas shall be lighted during hours
of darkness for security and protection.

Recreational vehicle storage areas'shalI be screened by at least a six-foot

There shall be provided for each unit, within the garage or carport, or
other specifically designated area, a loft or other usable storage area
with a minimum of 150 cubic feet in addition to standard utility storage.
Traffic bumps provided on the interior private roads shall be subject to
the City Traffic Engineer's approval.
A commercial-type drive approach, as shown on Standard Drawing No. 204 or
equivalent, shall be constructed at each entrance to the development.
Location and design shall be subject to approval of the Engineering
Oivision.

Prior to issuance of any building permit, access rights shall be granted to
the City for the purpose of allowing access over the private drives within
the project for all necessary City vehicles including fire, police, and
refuse disposal vehicles, and any other emergency vehicles. The documents
covering this matter shall be prepared by the owner and approved by the
Planning Oepartment.
All refuse storage areas are to be enclosed with a decorative wall.
location, size, type and design of wall are subject to the approval of the
Planning Department and Division of Public Services Superintendent.
Energy and noise insulation shall comply with all state and local require-
ments.

lANOSCAPING:
a. Three copies of a master landscape plan shall be submitted to the
Planning Department/ Park and Recreation Department for review and
approval. The plan shall include, but not be limited to, the
followi ng:
1) Size, type, and location of plant material proposed.
2) Irrigation plan,
3) Such other alternate plants, materials and design concepts as may
be proposed.
4) Erosion control plans.
b. Tree varieties and exact locations will be determined prior to planting
by the Directcr of the Park and Recreation Department or his/her
designee. A minimum number of one-inch caliper/l5 gallon,
multibranched trees shall be planted within the parkway for each of the
following types of lots, as per the City's specifications:
1) Cul-de-sac lot -- one tree;
2) Interior lot -- two trees;
3) Corner lot -- three trees.
c.
To protect against damage by erosion and negative visual impact, sur-
faces of all cut slopes ~re than five feet in height and fill slopes
more than three feet in height shall be protected by planting with
grass or ground cover plants. Slopes exceeding 15 feet in vertical

The developer shall obtain Planning Department approval of the visual or
engineering design of the proposed wall.
When graded slopes occur within or between individual lots, the slope face
shall be a part of the downhill lot. Exceptions to this requirement must
be approved by the City Engineer.
Grading and revegetation shall be staged as required by the City Engineer
in order to reduce the amount of bare soil exposed to precipitation.
Compliance with all recommendations of the Geology Report shall be required
(if applicable).
Any clubhouse, swimming pool, spa, putting green, picnic areas or other
amenities shall be installed in the manner indicated on the approved site
pl an.
During construction the City Engineer may require a fence around all or a
portion of the periphery of the tract site to minimize wind and debris
damage to adjacent properties. The type of fencing shall be approved by
the City Engineer to assure adequate project site maintenance, clean-up and
dust control.
No roof-mounted equipment shall be placed on any building unless screened
as specifically approved by, the Planning Department (except for solar
collection panels).
Within 75 feet of any single-family residential district, the maximum
height of any building shall not exceed one-story or 20 feet unless the
Commission determines that due to unusual topographical or other features,
such restrictive height is not practical.
All utility lines shall be installed underground subject to exceptions
approved by the Planning Department and the City Engineer.
No certificate of occupancy shall be issued prior to compliance with these
Standard Requirements as well as all provisions of the San Bernardino
Muni ci pal Code.

Provide an access roadway to each building for fire apparatus. Access

The names of any new streets (public or private) shall be submitted to the

The area around the private fire hydrant shall be designated as a no
parking zone by painting an 8-inch-wide red stripe for 15 feet in each
direction in front of the fire hydrant in such a manner that the hydrant
wi 11 not be blocked by parked vehicles. ' Suitable no parking signs shall be
installed.
The developer shall provide for adequate fire flow as computed by the Fire
Prevention Bureau. Fire flow shall be based on square footage, construc-
tion features, and exposure information as supplied by the developer.

Drainage and Flood Control:
All necessary drainage and flood control measures shall be
subject to the requirements of the City Engineer, which may be
based in part on the recommendations of the San Bernardino
County Flood Control District. The developer's Engineer shall
furnish all necessary data relating to drainage and flood
control.
Proper facilities for disposing of spring water from known
sources or if discovered during construction shall be provided
to protect proposed building foundations.
All drainage from the development shall be directed to a
public dedicated street, alley, or drainage facility. If this
is not feasible, proper drainage facilities and easements
shall be provided to the satisfaction of the City Engineer.

The portions of the following City Storm Drain Master Plan
facilities, located adjacent to or within the development,
along with the necessary off-site improvements required to

and appurtenances as required by the City Engineer.
All entrances to private streets from public streets shall be
identified by a private street name sign, textured pavements,
driveway approaches, or as approved by the City Engineer.
The structural section for all streets shall be designed and
submitted to the City Engineer for approval using a TI

subgrade after rough grading by a recognized soils testing
lab. All streets shall have a minimum AC thickness of 2-1/2
inches.

Curb returns and corresponding property line returns shall be

Grading:
All grading shall be done in compliance with Title 15 of the
Municipal Code and the requirements of the City Engineer.
The site/plot/grading plan submitted for a building permit
shall contain sufficient ground elevations (both existing and
proposed), building pad and finished floor elevations, graded
slopes, and gradients to define the amount of grading to be
done and the means of draining the site.
Each parcel shall be graded to drain to a public dedicated
street, alley, or drainage facility. If this is not feasible,
proper drainage facilities and easements shall be provided to
the satisfaction of the City Engineer.
All slopes shall be contained within the lower parcels
affected by the Slope. In some instances, this requirement

1. Adequate access to all structures must be provided and at no time is
there to be any interference with the free movement of Edison Company
equipment and materials.
2. All equipment working on the right of way must maintain a minimum
clearance of 25 feet from all structures and 13 feet from all overhead
conductors.
3. Construction area must be watered down periodically so as to prevent
dust contamination of Edison Company insulators. Any maintenance
required by Edison on its facilities over and above normal, and
resulting frOm this operation, shall be paid for by Pacer Homes, Inc..
4., The licensed area shall be cleared of all encroachments at licensee's
expense upon 30-days written notice.
5. Any earth disturbed within the right of way and/or backfilling shall
be compacted to 90 percent.
6. Commercial type driveways 16 feet wide with curb depressions capable
of supporting 40 tons on a three-axle truck shall be installed as
shown on the attached print.
7. Underground facilitles installed on the right of way must be capable
of withstanding a gross load of 40 tons on a three-axle truck.
8. Parking of vehicles on the right of way will not be permitted.

9. ,Any trees or plants within the area shall be maintained by the licensee
and shall not exceed a heigh~ of 15 feet.
10. Kite flying and model airplane activities must be prohiblted on the
licensed area.
11. Final plans, including grading plans, must be submitted to '
R. C. Warren, Eastern- Transmission/Substation Division; for his
approval at least 60 days prior to the commencement of any
construction.
