STAFF REPORT
An employee assistance program is designed to help employees solve problems which
can have a direct effect' on their employment, such as:
Stress/DepressionlTension
Substance Addiction (Smoking, Drugs, Alcohol)
Marital/Family Situations
Since such a program is completely confidential, employees who think they have a
problem, or know they have a problem, or just want to talk to a counselor, may do
so without fear of the problem or counselor contact being known to the employer.
As we all know, realization and identification of a problem, and then taking ini-
tial action toward resolution is the major step toward solving the problem itself.
Benefits to the employer who installs an employee assistance program are varied,
The economic costs not having an employee assistance program consist of the im-
pact to the illness/sick leave rate, accidents in the work force, job related dis-
ability, employment turnover and insurance increases.
One (1) stress related disability claim of a police officer can have the following
costs to the City:

The $55,000 amount does not include any impact on our retirement system payment,
attorney's fees and possible rehabilitation vendor charges. Conservativelyesti-
mating the last two items at $3,000 and $5,000 respectively, the cost becomes
$63,000 even without retirement system ramifications. The City experienced a
claim as described above in 1984.*
If this single claim's ~~verity could have been lessened by 12% via an employee
assistance program, the savings would have paid for one years' cost of the pro-
posed program itself. If the claim had been completely averted, the $63,000
cost would have provided for eight (8) years of the employee assistance program
proposed for police officers. In addition, the City would not have lost a valu-
able, trained employee and would not have had to bear the costs of replacing him/
her.
The San Bernardino County Sheriff's Department, prior to the implementation of
their Employee Assistance Program three (3) years ago, averaged six (6) to nine
(g) stress related disability retirements per year out of an officer population
of 865. Since the implementation of the Employee Assistance Program, no stress
related disability retirements have occurred.**

Most jobs have some degree of stress. There is no doubt that the job of police
officer carries one of the highest stress factors possible. It is appropriate
that the City of San Bernardino have an Employee Assistance Program for Police
Officers, designed to help those officers deal with their jobs, It is fully ex-
pected that the results will be a favorable impact in the areas of illness/dis-
ability rate, work force accident rate and turnover,

an Enployee Assistance Program to the City of San Bernardino Police IEpart-

of $650.00 per rronth, to be paid to The Counseling Team by San Bernardino City
A reporting of services will be provided to the City of San Bernardino Police
IEpartment by The Counseling Team for audit purposes. Confidentiality, however,
must be naintained.

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH "THE COUNSELING TEAM" FOR PROVIDING AN EMPLOYEE ASSISTANCE PRO-
GRAM FOR SWORN POLICE OFFICERS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN
BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor of the City of San Bernardino is hereby authorized
ar.d directed to execute on behalf of said City an Agreement with "The Coun-
seling Team" for providing employee assistance program services to sworn
Police Officers of the City (P 1 - P 7), a copy of which is attached hereto,
marked Exhibit "A" and incorporated herein by reference as fully as though
set forth at length.

CONSULTING AGREEMENT
1. PARTIES TO AGREEMENI'. This agreenent is made on January 21, 1985, between
'!be City of San Bernardino and '!be Counseling Team, 370 W. 6th St., Suite
215, San Bernardino, CA 92401.
2. SCOPE OF WORK. '!be Counseling Team henceforth to be known as the Con-
sultant, hereby agrees to perform the following services:
a. Preliminary evaluation and counseling for all sworn police departrrent
officers (PI-P7), and their :iImediate family rrerri:.lers, and referral to
cormnmity treatrrent resources.
b. Follow-up of said officers (and/or family rrerri:.lers) under treatrrent.
c. Consultation with supervisors regarding problem ercployees and/or any
aspect of the Eirployee Assistance Program.
d. Provide supervisory training relative to Enployee Assistance Program
referral procedures.
e. Conduct education seminars and briefings for all levels of managerrent
concerning services provided by the Enployee Assistance Program.
f. Assist labor and managerrent in developrent of policies and procedures
for Enployee Assistance Program.
g. Assist labor and managerrent introducing the Eirployee Assistance Pro-
gram to aforenenti -,ned ercployees.
3. INDEPENDENr CONI'RACTOR STATUS. Consultant shall have control over the
details of and means of performing the services required, and shall be
subject to the City of San Bernardino City Police ~partment only with
respect to the scope of work and the general results required. Nothing
in this agreenent shall be construed to make Consultant or any of its
ercployees or agents to be ercployees or agents of the San Bernardino City
Police ~partment.
4. FEES AND CHARGES. '!be cost to the City of San Bernardino for these ser-
vices will be Six Hundred Fifty IXlllars and no/lOO ($650.00) per m:mth.
On consunrnation of agreenent, pre-treatment and referral services are
available at no cost to aforenentioned ercployees. If The Counseling Team
in turn needs to refer covered individuals to another professional indi-
vidual/agency outside '!be Counseling Team, then the cost incurred for sarre
beCOlreS the individual responsibility of the employee. Every effort will
be made to refer ercployees to free, insurance-covered agencies, or those
agencies which operate on an ability-to-pay basis.

5. LENGI'H OF SERVICE AGREEMENI'. This agreenent will beCOlre effective on
March 1, 1985, and remain effective until March 1, 1986.
6. PERFORMANCE OF SERVICES. Consultant will render its services at 370 W.
Sixth Street, Suite 215, San Bernardino, CA., until further notice.
REPORTS SUBMITTED BY CONSULTANT WILL:
a. Accurately des=ibe services performed during the contract period,
for audit purposes.
b. Make reference to this Agreenent or otherwise identify the report (s )
in such manner as the City of San Bernardino/Police ~partment may
reasonably require.
c. Provide feedback annually to the City of San Bernardino/Police ~pt.
for the purpose of evaluating the effectiveness of the EAP.
7. SUBCONTRACTING. '!be services under the Agreement shall be performed by
Consultant and no services shall be subcontracted to any other party
except with the written =nsent of the City of San Bernardino.
8. RESPONSIBILITY. Consultant assumes all liability for the services to
be performed and for "JOrker's cOll'pensation law. Consultant agrees to
hold the City of San Bernardino harmless from, and to indemnify it against
any loss, injury, damage or legal liability arising out of Consultant's
work or omission. '!be cost of the City of San Bernardino defending
against a claim for any alleged loss, damage, injury, or legal liability
arising out of Consultant's work or omission shall be paid by Consultant.
Consultant shall comply with applicable legal requirements.
