a aoncem about the observation 114 of the staff report 00 the above
application with respect to the potential of 25% density bonus for
lCM--rooderate incane family housing under the state law.
I understand that the City's attorneys' will be providing their
opinioo and possible solution to this city-wide issue. As a natter
of fact, we as applicant have not requested such a density bonus
and are hot planning to do so.
Therefore, we, C.C. San Bernardino, Inc. would like to inform you
that we waive our right to seek such a density tonus permitted under
the state law.

1. At the December 4, 1984 Planning Commission Meeting, a request to
change the zoning of 3.3 acres from "0" Open Space to R-1-7200,
Single-Family Residential, was on the agenda, known as Change of Zone
No. 84-26. It was at this meeting, the Commission directed Staff to
analyze the feasibility of changing the zoning classification of the
adjoining open space properties comprised of 21.67 to that of R-1-7200
also.
2. The subject site is land locked from dedicated streets in all direc-
tions. The only access available to the site is via easements to
Valencia Avenue. For any type of residential development to take
place, a 60-foot right-of-way would be required for access to the site.
Bei ng that the maxi mum length for a cul-de-sac is 500 feet for resi de..-
tial developments, a street ~th two full means of ingress-egress would
be required. A primary and secondary means of access cannot be
feasibly developed for the project site without the purchase of adja-
cent properties which abut both the public streets and the subject lot.
However, these adjacent lots are presently developed with single-family
homes.
3. On January g, 1985, Staff met with representatives from the City
Attorney's office and the Traffic Engineering section of the Department
of Public Works. It was the concensus of the meeting that there were
no visible way of supplying dedicated access to the site without the
purchase of land adjoining the site. It is up to the applicant to
demonstrate to the City that two means of dedicated access can and will
be provi ded to the si ',e.
4. Comments from the Advanced Planning Section of the Planning Department
state:

"Single driveway access is insufficient for subject
parcel(s). Also, second means of access is not
available. Pending Highland Area Plan revision
recommends that thi s si te remai n zoned "0", Open
Space until full secondary access is obtained."
5. Comments from the Engineering Department have been stated whereas if a
subdivision of any type were to follow the requested 3.3 acre zoning
site or the City's initiated 21.67 acre zoning area, a full ~dth dedi-
cated street would be re9uired to provide access.
Additional comments from the Fire Department require two means of
access for any subsequent subdivision and that cul-de-sacs would be
required to be 500 feet or less as required by the San Bernardino
Muni ci pa 1 Code.

6. The present General Plan designates the subject site at residential,
4-7 units per acre. The requested zone change would yield approxima-
tely 4.2 units per acre. The requested 3.3 acre site and the remaining
area of the 21.67 acres does comply with the General Plan as required
with State Planning Law and all of the 21.67 acres could carry a
R-1-7200 zone classification. However, any subsequent development pro-
posals would require at least a parcel map proposal opening the sub-
division to new public hearings. It would be at the time of subsequent
subdivisions that the circulation pattern and street alignments would
be determined.
7. As much as the abutting properties are developed with single-family
homes, the feasibility of any short-term development of the property
would be unlikely unless properties that abut the site were purchased
to provide the required 60-foot right-of-way to the site. Proper deve-
lopment of the site is incumbant upon the applicant at the time of a
future development request. If the property were to be approved to a
R-1-7200 zone, the likelihood of it remaining in its present "rural"
state woul d be as if the "Open Space" desi gnati on were sti 11 on the
si te.
RECOMMENDATION
Therefore, Staff recommends adopti on of the Negati ve Decl arati on as recom-
mended by the Environmental Review Committee and to approve the change of
zone for all 21.67 acres.
