STAFF REPORT
Bids for this project were opened at 2:00 p.m, on Wednesday, 11-7-84,
A total of 5 bids were received, ranging from $524,302.00 to
$574,272.80. The low bid of $524,302.00 is 12.6% under the Engineer's Esti-
mate of $599,658.00.
Listed below is an estimate of the total project cost, based upon the
actual low bid price.

Construction Engineering
An amount of $684,450.00 has been allocated in the Street Construction
Fund under Account No. 42-510-428, to finance the costs that will be incurred
for this project.
Federal-Aid Urban Funds will be used to finance a portion of the
project cost. Because of this fact, the bids have to be reviewed by Caltrans
and authorization granted to award a contract. Caltrans has granted authori-
zation to award a contract to the low bidder.
Addendum No One was issued during the bidding process to make a
minor correction in the special provisions. A clause was included on this
document that all bidders shall indicate receipt of Addendum No. One in their
bid. A copy of Addendum No. One is attached.
The low bidder inadvertently failed to acknowledge receipt of the
addendum, A letter, dated 11-7-84, was delivered to our office after the bid
opening acknowledging receipt of the addendum. A copy of this letter is
attached,
A formal protest was received from the second low bidder, by letter
dated 11-8-84, prior to awarding a contract to the low bidder, due to their
failure to acknowledge receipt of Addendum No. One. This letter from Matich
Corporation was referred to the City Attorney's Office to determine if this
protest was valid and the low bid should be rejected. No such determination
has been made. A copy of this letter is also attached for reference.
We recommend that a contract be awarded to the low bidder.

The Special Provisions for this prOject are hereby amended as follows:
,
1. The second page of the "Notice Inviting Bids", the third paragraph
shall be changed to read as follows:
"The City of San Bernardino has establ ished a flinority
Business Enterprise (MBE) participation goal for this
project of fifteen (15) percent MBE's owned and con-
trolled by minorities and two (2) percent owned and
controlled by women."

RESOLUTION NO.
RESOLUTION OF THE CITY OF SAN BERNARDINO AWARDING A CONTRACT
TO BLAIR PAVING, INC. FOR PAVEMENT REHABILITATION ON ELEVEN
PORTIONS OF VARIOUS STREETS.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. Blair Paving, Inc. is determined to be the lowest
responsible bidder for construction of a public project, to wit:
rehabilitation of pavement on eleven portions of various streets,
in accordance with Plan No. 6519, for the total amount of
$524,302.00.
SECTION 2. The low bidder failed to include in its bid
package an acknowledgement that it had received a copy of Addendum
No. One. Such acknowledgement was filed one day later, after bid
opening.
SECTION 3. It is further determined that the Addendum in
question was provided to all bidders with the original bid
package, so no question exists as to whether the Addendum had in
fact been received by the apparent low bidder.
SECTION 4. The Mayor and Common Council hereby determine
that the failure of the apparent low bidder to include in its bid
package an aCknowledgement of receipt of Addendum No. One
constitutes a minor irregularity, particularly in light of the
knowledge that the Addendum was distributed as part of the bid
package to all prospective bidders, and no issue exists as to
whether in fact the apparent low bidder received the Addendum
prior to submitting its bid. This slight irregularity gives no
advantage to one bidder over another. This slight irregularity is,
hereby waived.

SECTION 5. A contract is awarded to said bidder, Blair
2 Paving, Inc., in accordance herewith, but such award shall be
3 effective only upon the contract being fully executed by both
4 parties. All other bids on this project are hereby rejected, and
5
the Mayor is hereby authorized and directed to execute said
~contract on behalf of the City. A copy of the contract is
attached hereto, marked Exhibit "A" and incorporated herein by

SECTION 6. The City of San Bernardino shall not be Obligatedi
