Proposition 4 became Article XIII B of the State Constitution. This law limits certain State and local government appropriations to prior year amounts plus adjustments for changes in population and cost of living. Article XIII B also requires that revenues received in excess of the calculated limitation be returned to the source. The appropriation limitation factor consists of the percentage change in population from prior year to current year, multiplied by the percentage change in the lesser of the Consumer" Price Index or the California per capita income from prior year to current year. This factor is then multiplied by the prior year's appropriation limit to arrive at the current year's limitation. There are certain appropriations that are not subject to the Appropriation Limitation Law. These are Federal Grants Funds, Debt Service Funds, Enterprises Funds, Internal Service Funds, and other Funds where the uses of revenues received are restricted. Based upon the calculation outlined in Article XIII B, the City of San Bernardino's appropriation limit for fiscal year 1984/85 is $64,244,079. The amount of the 1984/85 approved appropriations subject to limitation is $41,536,711. RESOLUTION OF THE CITY OF SAN BERNARDINO ESTABLISHING THE APPROPRIATIONS LIMIT FOR FISCAL YEAR 1984-1985 FOR THE CITY OF SAN BERNARDINO IN ACCORDANCE WITH THE PROVISIONS OF DIVISION 9 OF TITLE 1 OF THE CALIFORNIA GOVERNMENT CODE. WHEREAS, Article XIII B of the Constitution of the State of California as proposed by the Initiative Measure approved by the people at the special statewide election held on November 6, 1979, provides that the total annual appropriations subject to limitation of each local government shall not exceed the appropriations limit of such entity for the prior year adjusted for changes in the cost of living and population except as otherwise specifically provided for in said Article: and WHEREAS, the State Legislature added Division 9 (commencing with Section 7900) to Title 1 of the Government Code of the State of California to implement Article XIII B of the California Constitution: and WHEREAS, Section 7910 of the Government Code provides that each year the governing body of each local jurisdiction shall, by resolution, establish its appropriations limit for the following fiscal year pursuant to Article XIII B at a regularly scheduled meeting or a noticed special meeting and that fifteen days prior to such meeting, documentation used in the determination of the appropriations limit shall be available to the public: and WHEREAS, Section 7902(b) of the Government Code sets 'forth the method for determining the appropriations limit for each local jurisdiction for the 1981-l982 fiscal year and each year thereafte : and WHEREAS, the Mayor and COmmon Council of the City of San 0 I 2 3 4 5 6 7 8 9 10 II 12 1: J4 J5 16 17 18 19 20 21 22 23 24 25 26 27 28 III o o o Bernardino wish to establish the appropriations limit for fiscal year 1984-l985 for the City of San Bernardino, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION l. It is hereby found and determined that the ! Idocumentation used in the determination of the appropriations limit for the City of San Bernardino for fiscal year 1984-l985 was available to the public in the Finance Department of said City at I least fifteen days prior to the adoption of this resolution. SECTION 2. The appropriations limit for the City of San Bernardino as established in accordance with Section 7902(b) of the California Government Code is $64,244,079.
