Rosebraugh, Date: January 8, 1985 Synopsis of Previous Council action: 1. September 17, 1984 appeal hearing set for October 1, 1984. 2. October 1,1984 Mr & Mrs Ted Bair were given 90 days to compile a loan package, obtain a commitment for the construction and time schedule for immediate construction of home. The owners were further instru~ted of immediate disposal of two abandoned vehicles, trailer and out house and that premises be cleaned. 3. October 15, 1984 Mr Bair requested reconsideration of Council action taken at October 1,1984 meeting. This request was denied. Recommended motion: Mayor Holcomb to close appeal hearing, affirm the action of the Board of Building Commissioners by abating nuisance and bringing lot to natural state. . Contact person: ,Jack C. Our inspectors have made many trips to the location trying to get work started and the place cleaned up without success. The neighbors have also gone through the tragedy of a fire, have rebuilt and upgraded the cOlrmunity and don't feel they should have to look at the eyesore that is presently on the site, which includes open footings, 2 old cars and a trailer. Listed is chronicle of events: 1. November 1980, Panorama fire. 2. August 1981, a free permit was issued for construction of residence. 3. By August 1982 rough plumbing and some foundation had been inspected. A solar hot air system was buried in ground to an approximate 14' depth. 4. August 1982 to present, no further inspections of construction. 5. November 1983, received complaint from Council about abandoned work" old cars and trailer on the lot. 6. November 1983 correction notice was sent to Mr. Bair and telephone call in return that he would pour foundation by the end of January 1984. 7. Inspection in December 1983 and February 1984, no work done. 8. May 1984, more complaints from neighbors. 9. May 1984 Order to Show Cause sent, meeting held with City Attorney. City Attorney recOlrmended if no progress started, Building and Safety to take case to the Board of Building Commissioners. 10. Letter sent to Mr. Bair about no work being done. 11. August 1984, letter sent to Mr. Bair for Board of Building Commissioners Hearing. 12. Notice of Pendency filed September 1984. 13. Board of Building Commissioners meeting held. Board of Building Commissioners ordered to abate nuisance and bring back to natural state. 14. September 10, 1984, letter of appeal of the Board of Building Commissioners decision from Mr. Bair. 15. September 17, 1984, appeal hearing set for October 1, 1984. 16. October 1, 1984, Mr. Bair given 90 days to present a loan package and time schedule to complete work. Also ordered to remove 2 cars, travel trailer and out house immediately. 17. October 15, 1984, Mr. Bair requested reconsideration of Council action and it was denied. 18. October 22, 1984, trailers, cars and out house removed. 19. January 2, 1985, inspection of property showed no further work toward cleaning property, open footings, foundation and solar basement and no plans for development had been submitted. 20. January 8, 1985, received a telephone call from Mr. Bair stating he has submitted a building package for a loan but so far has not received it and is waiting for an answer from the lending agency. 75-0264
