APN: 0136-033-18, 19, 23, 24, and 26 Lot Area: 2.42 acres Zone: Industrial Light (IL) Recommendation Staff recommends that the Development and Environmental Review Committee adopt Resolution No. 2023-032 adopting the Categorical Exemption under the California Environmental Quality Act; and approving Development Permit Type-D 23-04, based on the Findings of Fact and subject to the recommended Conditions of Approval. D STREET APNS: 0136-033-18, 19, 23, 24, AND 26, AND ADOPTING THE CATOGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUAILITY ACT. WHEREAS, on February 27, 2023 pursuant to the requirements of Section 19.44.020 (Administrative and Development Permits-Applications) of the City of San Bernardino Development Code, an application for Development Permit Type-D 23-04 was duly submitted by: Property Owner: Five Sac (5 SAC) 207 E. Clarendon Pheonix, AZ 85012 Project Applicant: Thomas Mitchell, MCP 2727 N. Central Avenue Pheonix, AZ 85004 APN: 0136-033-18, 19, 23, 24, and 26 Lot Area: 2.42 acres WHEREAS, pursuant to Section 19.06.20 (Commercial Zones List of Permitted, Development Permitted, and Conditionally Permitted Uses) and Section 19.06.030 (Development Standards) of the City of San Bernardino Development Code Development Permit Type-D 22-22 is a request to allow the development and establishment of a self-storage facility consisting of a 39 foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres, located within the Industrial Light (IL) zone at 109 N. D Street APNs: 0136-033-18, 19, 23, 24, and 26; WHEREAS, the Planning Division of the Community and Economic Development Department of the City of San Bernardino has reviewed Development Permit Type-D 23-04 for consistency with the City of San Bernardino General Plan and compliance with the City of San Bernardino Development Code; RESOLUTION NO. 2023-032-D/ERC 2 WHEREAS, pursuant to requirements of Section 15063 of the California Environmental Quality Act (CEQA), the Planning Division of the Community and Economic Development Department evaluated Development Permit Type-D 23-04 and determined that it is exempt from CEQA pursuant to a categorical exemption (listed in CEQA Guidelines Article 19, commencing with Section 15300) and the application of that categorical exemption is not barred by one of the exceptions set forth in CEQA Guidelines Section 15300.2 (Exceptions); WHEREAS, on September 16, 2023, pursuant to the requirements of Section 19.52.020 (Hearings and Appeals-Application Processing) of the City of San Bernardino Development Code, the City gave public notice by advertising in the San Bernardino Sun, a newspaper of general circulation within the City of San Bernardino, and by mailing notices to the property owners within 1,000 feet of the subject property of the holding of a public hearing at which the Categorical Exemption and Development Permit Type-D 23-04 would be considered; WHEREAS, on September 27, 2023, pursuant to the requirements of Sections 19.52.040 (Hearings and Appeals-Hearing Procedure) of the City of San Bernardino Development Code, the Development and Environmental Review Committee held the duly noticed public hearing at which interested persons had an opportunity to testify in support of, or opposition to Development Permit Type-D 23-04, and at which meeting the Development and Environmental Review Committee considered the Categorical Exemption and Development Permit Type-D 23- 04; WHEREAS, during the said duly noticed hearing, there were no public comments expressed in opposition of Development Permit Type-D 23-04; and WHEREAS, pursuant to the requirements of Chapter 19.44 (Administrative and Development Permits) of the City of San Bernardino Development Code, the Development and Environmental review Committee has the authority to take action on the Categorical Exemption and Development Permit Type-D 23-04. NOW THEREFORE, the Development and Environmental Review Committee of the City of San Bernardino does hereby resolve, determine, find, and order as follows: SECTION 1. ENVIRONMENTAL DETERMINATION: As the decision-making body for the project, the Development and Environmental Review Committee has independently reviewed and considered the entire record before it, including the Environmental Determination prepared for the project, Development Permit Type-D 23-04. In accordance with Section 15060 of the California Environmental Quality Act (CEQA), The Planning Division of the Community and Economic Development Department conducted an Environmental evaluation connected with the proposed Development Permit Type-D 23-04 and is found to be Exempt under Section 15061 (b) (2) of CEQA. Pursuant to Section 15332 (Infill Development Projects) of CEQA, A Class 32 Categorical Exemption consists of projects characterized as in-fill development meeting the conditions contained within Section 15332. Based upon the facts and information contained in the administrative record, including all written and oral evidence presented to the Development and Environmental Review Committee, the Development and Environmental Review Committee finds as follows: RESOLUTION NO. 2023-032-D/ERC 3 (1) The administrative record has been completed in compliance with the California Environmental Quality Act, the State CEQA Guidelines, and the City’s Local CEQA Guidelines, and (2) The proposed project is categorically exempt from the requirements of the California Environmental Quality Act pursuant to Section 15332 (In-fill Development Projects) of the CEQA Guidelines; and (3) The application of the Categorical Exemption is not barred by one of the exceptions set forth in the CEQA Guidelines Section 15300.2; and (4) The determination of CEQA exemption reflects the independent judgment of the Development and Environmental Review Committee. SECTION 2. FINDINGS FOR DEVELOPMENT PERMIT TYPE-D 23-04: Pursuant to Section 19.44.040 (Findings) of the City of San Bernardino Development Code requires that Development Permit applications meet certain findings prior to their approval by the Development and Environmental review Committee. Accordingly, the following findings are provided in support of the approval of Development Permit Type-D 23-04: Finding No. 1: The proposed development is permitted within the subject zoning district and complies with all applicable provisions of the Development Code, including prescribed site development standards and applicable design guidelines. Finding of Fact: The proposed request for the development and establishment of a self- storage facility (UHAUL) consisting of a 39 foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres, is located within the Industrial Light (IL) zone and is a permitted land use subject to the approval of a Development Permit with the appropriate Conditions of Approval and CEQA determination. The project will also be consistent with Section 19.06.030 (Development Standards) of the City of San Bernardino Development Code in that the proposed a self-storage facility consisting of a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres. The project would improve the appearance of the project site- and would be compatible with the surrounding developments. Therefore, the proposal would not impair the integrity and character of the subject zoning district. Finding No. 2: The proposed use is consistent with the General Plan. RESOLUTION NO. 2023-032-D/ERC 4 Finding of Fact: The proposed project consisting of a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres is subject to the approval of a Development Permit with the appropriate Conditions of Approval, and CEQA determination; and is consistent with the commercial land use designation set forth by the General Plan Land Use Map. The project is consistent with Policy 2.4 of the Land Use Element, which requires the City of San Bernardino to “Enhance the quality of life and economic vitality in San Bernardino by strategic infill of new development and revitalization of existing development”. The proposed project is a revitalization of an underutilized property that would aid the public in providing personal storage for community members that live within the Downton area and is conditioned per the Development Code for operations. Finding No. 3 The proposed development is harmonious and compatible with existing and future developments within the land use district and general area, as well as the land uses presently on the subject property. Finding of Fact: The subject site is located within the Industrial Light (IL) zone and is surrounded by like land uses. The proposed development of a39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres would be harmonious and compatible with the land use district and General Plan area, including existing and future land uses surrounding the site. Finding No. 4 The approval of the Administrative or Development Permit for the proposed development is in compliance with the requirements of the California Environmental Quality Act and Section 19.20.030 (6) of the Development Code. Finding of Fact: The proposed development and establishment of a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres is exempt from CEQA pursuant to Section 15332 (In-fill Development Projects) of the CEQA Guidelines. This is due to the fact that the proposed project meets the required criteria to qualify as a “In-fill Development” project by the City of San Bernardino city staff as defined by Section 15332 of the CEQA Guidelines due to the fact that Conditions of Approval will be imposed to alleviate potential impacts and ensure compatibility with surrounding land uses and the site is currently developed and is in existing disturbed conditions. RESOLUTION NO. 2023-032-D/ERC 5 Finding No. 5: There will be no potentially significant negative impacts upon environmental quality and natural resources that could not be properly mitigated and monitored. Finding of Fact: Development Permit Type-D 23-04 has been evaluated pursuant to the CEQA Guidelines. Based upon the fact that the proposed construction of a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres is developed on a parcel that is in existing disturbed conditions, abutting parcels developed with similar land uses, assigned appropriate Conditions of Approval, and has been designed to comply with Development Code standards; it been determined that the project will not create any negative impacts upon the environmental quality or natural resources within the project site or its vicinity. Finding No. 6: The subject site is physically suitable for the type and density/intensity of use being proposed. Finding of Fact: The site is physically suitable for the type and density/intensity of the project being proposed as evidenced by project compliance with all applicable Development Code Standards. There are no physical constraints on the site that would limit the establishment of the land use as proposed. Finding No. 7 There are adequate provisions for public access, water, sanitation, and public utilities and services to ensure that the proposed use would not be detrimental to public health and safety. There are adequate provisions for public access, water, sanitation, public utilities, and services, to ensure that the proposed would not be detrimental to the health, safety, or welfare of the community. Finding of Fact: Establishment of the proposed project subject to a Development Permit Type-D with the applicable Conditions of Approval will not be detrimental to public services or public health and safety. Finding No. 8 The location, size, design, and operating characteristics of the proposed development would not be detrimental to the public interest, health, safety, convenience, or welfare of the city. Finding of Fact: The proposed development and establishment of a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres conforms to all applicable development standards and land use regulations of the Industrial Light (IL) zone. The location, size, design, and character of the proposed development will enhance the neighborhood to the benefit of the public interest and general welfare of the city. RESOLUTION NO. 2023-032-D/ERC 6 SECTION 3. CONDITIONS OF APPROVAL: The approval of Development Permit Type-D 23-04 shall be subject to the following Conditions of Approval: 1. This is an approval to develop and establish a 39-foot high three (3) story building containing a total of approximately 93,264 square feet on a property comprised of five (5) parcels containing a total of approximately 2.42 acres. 2. The site shall be maintained in accordance with the plans stamped September 27, 2023 (EXHIBIT “A”), approved by the City, which includes a complete set of plans, on file in the Planning Division; the conditions contained herein; and the City’s Municipal Code regulations. 3. Within two (2) years of the Development Permit Type-D 23-04 approval, commencement of construction shall have occurred, or the permit/approval shall become null and void. In addition, if after commencement of construction, work is discontinued for a period of one year, then the permit/approval shall become null and void. However, approval of the Development Permit Type-D 23-04 does not authorize commencement of construction. All necessary permits must be obtained prior to commencement of specified construction activities included in the Conditions of Approval. EXPIRATION DATE: September 27, 2025 4. The review authority may, upon application being filed thirty (30) days prior to the expiration date of Development Permit Type-D 23-04 and for good cause, grant a time extension not to exceed twelve (12) months. The review authority shall ensure that the project complies with all current Development Code provisions. 5. In the event this approval is legally challenged, the City will promptly notify the applicant of any claim, action or proceeding and will cooperate fully in the defense of this matter. Once notified, the applicant agrees to defend, indemnify, and hold harmless the City of San Bernardino (City), any departments, agencies, divisions, boards, or commission of the City as well as predecessors, successors, assigns, agents, directors, elected officials, officers, employees, representatives, and attorneys of the City from any claim, action or proceeding against any of the foregoing persons or entities. 6. The applicant further agrees to reimburse the City for any costs and attorneys’ fees which the City may be required by a court to pay because of such action, but such participation shall not relieve applicant of his or her obligation under this condition. The costs, salaries, and expenses of the City Attorney and employees of his office shall be considered as “Attorney’s fees” for the purpose of this condition. As part of the consideration for issuing this Development Permit, this condition shall remain in effect if the Development Permit is rescinded or revoked, whether at the request of applicant or not. 7. Any expansion of proposed services may be subject to review by the Planning Division. RESOLUTION NO. 2023-032-D/ERC 7 8. The property owner(s), facility operator and property management will be responsible for regular maintenance of the site. Vandalism, graffiti, trash, and other debris must be removed within 24 hours of being reported. 9. Signs are not approved as a part of this permit. Prior to establishing signs, the applicant must submit an application for approval by the Planning Division. Banners, flags, pennants, and similar signs are prohibited unless a Temporary Sign Permit is obtained. No pole signs shall be utilized, any remaining pole signage or its base must be demolished. 10. The applicant/owner shall always maintain all existing landscaping in the parking lot and setbacks in a weed and disease-free condition and any dead or missing vegetation must be promptly replaced. 11. Construction-related activities may not occur between the hours of 8:00 pm and 7:00 am. No construction vehicles, equipment, or employees may be delivered to, or arrive at, the construction site before 7:00 am or leave the site after 8:00 pm. Construction activities may only occur Monday through Friday. 12. If the color or architecture of the building is proposed to be modified in the future, the revised color scheme and or architecture shall be submitted to the Planning Division prior to any modification of the building exterior, for evaluation for substantial conformance to the approved plans. 13. Submittal requirements for permit applications with the Building and Safety Division shall include all Conditions of Approval issued with this approval, printed on the plan sheets. 14. Outside storage shall be confined to the rear of the principal structure(s) or the rear two- thirds of the site, whichever is the more restrictive, and screened from public view from any adjoining properties and public rights-of-way by appropriate walls, fencing and landscaping. If there are no buildings present than storage would not be an option. 15. Service and associated truck storage areas shall be completely screened from public view. 16. All vehicles associated with the business shall be parked or stored on-site and not in adjoining streets and alleys. 17. The premises shall always be kept in a neat and orderly condition. 18. Schedule all grading activities to ensure that repeated grading will not be required, and that implementation of the desired land use (e.g. planting, paving or construction) will occur as soon as possible after grading. 19. It shall be unlawful for the driver, owner or operator of any commercial vehicle having a manufacturer’s Gross Vehicle Weight rating (GVWR) exceeding 10,000 pounds to park, or cause to be parked, except for the immediate loading and unloading of goods, any such vehicle upon any public street, or alley, or on any residentially zoned property, within any residential land use district in the City. This prohibition shall not apply to construction sites during the construction process or to recreational vehicles. RESOLUTION NO. 2023-032-D/ERC 8 20. No fence, wall, hedge, sign or other structure, shrubbery, mounds of earth, or other visual obstruction over 36 inches in height above the nearest street curb elevation shall be erected or placed within a Traffic Safety Sight Area. A Traffic Safety Sight Area is a triangular portion of a lot formed by three distances measured along and/or perpendicular to property lines at the intersection of two street rights-of-way or at intersections of driveways, parking entrances, and alleys with a street right-of-way. 21. Any new construction or construction of 2,500 square feet or more of the structure floor area of the primary structure shall require the dedication of public right-of-way for public street purposes. In addition, the property owner shall be required to irrevocably agree to participate in any future assessment district that may be formed to construct public street improvements in accordance with the policies, procedures, and standards of the Director of Public Works/City Engineer. 22. No business activity shall be conducted other than the rental of storage spaces for inactive storage use. 23. All storage shall be located within a fully enclosed structure(s). 24. No flammable or otherwise hazardous materials shall be stored on-site. 25. Residential quarters for a manager or caretaker may be provided in the development. 26. The development shall provide for two parking spaces for the manager or caretaker, and a minimum of five spaces located adjacent or in proximity to the manager's quarters for customer parking. 27. Aisle width shall be a minimum of 25 feet between buildings to provide unobstructed and safe circulation. 28. Every parcel with a structure shall have a trash receptacle on the premises. The trash receptacle shall comply with adopted Public Works Department standards and be of sufficient size to accommodate the trash generated. The receptacle(s) shall be screened from public view on at least three sides by a solid wall six feet in height and on the fourth side by a solid gate not less than five feet in height. The gate shall be maintained in working order and shall remain closed except when in use. The wall and gate shall be architecturally compatible with the surrounding structures. 29. Storage facilities located adjacent to residential districts shall have their hours of operation restricted to 7:00 A.M. to 9:00 P.M., Monday through Saturday, and 9:00 A.M. to 9:00 P.M. on Sundays. 30. All conditions of the Public Works Department shall be met to the satisfaction of the City Engineer. 31. The applicant/property owner must sign and have notarized an affidavit acknowledging acceptance of the conditions of approval and return it to the Planning Division within thirty (30) days of the effective date of this approval. RESOLUTION NO. 2023-032-D/ERC 9 32. The project shall comply with all applicable requirements of the Building and Safety Division, Police Department, Municipal Water Department, Public Works Department, and the City Clerk’s Office/Business Registration Division. 33. This approval shall comply with the requirements of other outside agencies (i.e. Caltrans, San Bernardino County Health Department, Division of Environmental Health Services, San Bernardino County Consolidated Fire District, and California Board of Equalization), as applicable. 34. No final Certificate of Occupancy will be issued until all conditions of approval have been completed. Public Works – Standard Requirements 35. Drainage and Flood Control a. All necessary drainage and flood control measures shall be subject to requirements of the Building Official, which may be based in part on the recommendations of the San Bernardino County Flood Control Department. The developer's Engineer shall furnish all necessary data relating to drainage and flood control. b. A local drainage study will be required for the project. Any drainage improvements, structures or storm drains needed to mitigate downstream impacts or protect the development shall be designed and constructed at the developer's expense, and right-of-way dedicated as necessary. c. The detention basin shall be designed in accordance with “Detention Basin Design Criteria for San Bernardino County.” Retention basins are not acceptable. d. All drainage from the development shall be directed to an approved public drainage facility. If not feasible, proper drainage facilities and easements shall be provided to the satisfaction of the City Engineer. e. If site drainage is to be discharged into the public street, the drainage shall be conveyed through a parkway culvert constructed in accordance with City Standard No. 400. Conveyance of site drainage over the Driveway approaches will not be permitted. f. A Final Full-Categorical Water Quality Management Plan (WQMP) is required for this project. The applicant is directed to the County of San Bernardino’s Flood Control web page for the template and Technical Guidance Document. The Land Development Division, prior to issuance of any permit, shall approve the WQMP. A CD copy of the approved WQMP and Hydrology Study shall be required prior to grading permit issuance. RESOLUTION NO. 2023-032-D/ERC 10 g. A Storm Water Pollution Prevention Plan (SWPPP) will be required. The applicant is directed to State Water Resources Control Board (SWRCB) SMART Login system. The SWPPP shall be approved by the State and a CD copy of the approved SWPPP shall be submitted to City prior to grading permit issuance. h. A "Notice of Intent (NOI)" shall be filed with the State Water Resources Control Board for construction disturbing 1 acre or more of land (including the project area, construction yards, storage areas, etc.). A WDID number issued by the State of California is required prior to the issuance of grading permit. i. The Land Development Division, prior to grading plan approval, shall approve an Erosion Control Plan. The plan shall be designed to control erosion due to water and wind, including blowing dust, during all phases of construction, including graded areas which are not proposed to be immediately built upon. 36. Grading and Landscaping a. The grading and on-site improvement plan shall be signed by a Registered Civil Engineer and a grading permit will be required. The grading plan shall be prepared in strict accordance with the City's "Grading Policies and Procedures" and the City's "Standard Drawings", unless otherwise approved by the Building Official. b. If more than 5 trees are to be removed from the site, a tree removal permit conforming to the requirements of Section 19.28.100 of the Development Code shall be obtained from the Department of Community Development - Planning Division prior to issuance of any grading or site development permits. c. All existing fence and wall shall be shown and detailed on the on-site improvement plan and if gated a Knox box or access by means of gate key, code, or remote shall be provided to the Fire Department. d. If more than 5,000 cubic yards of earthwork is proposed, the grading shall be supervised in accordance with Section 3317.2 of the California Building Code. e. If the grading plan indicates export or import, the source of the import material or the site for the deposition of the export shall be noted on the grading plan. Permit numbers shall be noted if the source or destination is in the City of San Bernardino. f. If more than 50 cubic yards of earth is to be hauled on City Streets then a special hauling permit shall be obtained from the City Engineer. Additional conditions, such as truck route approval, traffic controls, bonding, covering of loads, street cleaning, etc. may be required by the City Engineer. g. Wheel stops are not permitted by the Development Code, except at designated accessible parking spaces. Therefore, continuous 6” high curb shall be used around planter areas and areas where head in parking is adjacent to walkways. RESOLUTION NO. 2023-032-D/ERC 11 The parking spaces may be 16.5’ deep and may overhang the landscaping or walkway by 2.5’. Overhang into the setback area or into an ADA path of travel (minimum 4’ wide) is not permitted. h. The On-site improvement plan shall include details of on-site lighting, including light location, type of poles and fixtures, foundation design, conduit location, material and size, and number and size of conductors in each conduit run. Also, Photometric plot shall be provided which show that the proposed on-site lighting design will provide: • 1 foot-candle of illumination uniformly distributed over the surface of the parking lot during hours of operation, and • 0.25 foot-candles security lighting during all other hours. i. The site shall be paved with either ACC or PCC (Asphalt or Concrete). j. The design of on-site improvements shall also comply with all requirements of The California Building Code, Title 24, relating to accessible parking and accessibility, including retrofitting of existing building access points for accessibility, if applicable. k. An accessible path of travel shall be provided from the public way to the building entrance. All pathways shall be paved and shall provide a minimum clear width of 4 feet. Where parking overhangs the pathway, the minimum paved width shall be 6.5 feet. All accessible parking spaces shall be a minimum of 18 feet by 9 feet net. l. The refuse enclosure(s) shall be constructed in accordance with City Standard Drawing No. 508 with an accessible path of travel. The minimum size of the refuse enclosure shall be 8 feet x 15 feet for bins storage area. Where a refuse enclosure is proposed to be constructed adjacent to spaces for parking passenger vehicles, a 3’ wide by 6 “high concrete planter shall be provided to separate the enclosure from the adjacent parking. The placement of the enclosure and design of the planter shall preclude the enclosure doors from opening into drive aisles or impacting against adjacent parked cars. m. The project Landscape Plan shall be reviewed and approved by the Land Development Division prior to issuance of a grading permit. Submit 3 copies to the Land Development Division for Checking. n. Continuous concrete curbing at least 6 inches high and 6 inches wide shall be provided at least 3 feet from any wall, fence, property line, walkway, or structure where parking and/or drive aisles are located adjacent thereto. Curbing may be left out at structure access points. The space between the curb and wall, fence, property line, walkway or structure shall be landscaped, except as allowed by the Development Review Committee. RESOLUTION NO. 2023-032-D/ERC 12 o. Retaining walls, block walls, and all on-site fencing (wrought iron) shall be designed and detailed on the on-site improvement Plan. This work shall be part of the on-site improvement permit issued by Land Development. All masonry walls shall be constructed of decorative block with architectural features acceptable to the City Planner. p. The public right-of-way, between the property line and top of curb (also known as “parkway”) along adjoining streets shall be landscaped by the developer and maintained in perpetuity by the property owner. Details of the parkway landscaping shall be included in the project’s on-site landscape plan. q. A liquefaction evaluation is required for the site. This evaluation must be submitted and approved prior to issuance of a grading permit. Any grading requirements recommended by the approved liquefaction evaluation shall be incorporated in the grading plan. r. Prior to occupancy of any building, the developer may be required to post a bond to guarantee the maintenance and survival of project landscaping for a period of one year. s. The applicant must post a grading bond prior to issuance of a grading permit. The amount of the bond is to be determined by the Land Development Division. t. The applicant must post a performance bond prior to issuance of the on-site permit. The amount of the bond is to be determined by Land Development u. All electrical transformers located outdoors on the site shall be screened from view with a solid wall or landscaping and shall not be located in any setback/right-of-way area. If the transformer cannot be screened, it shall be located in an underground vault unless approved by the City Engineer pursuant to Section 19.30.110. v. No construction on a site shall begin before a temporary/security fence is in place and approved by the Building Official or his designee. Temporary/security fencing may not be removed until approved by the Building Official or his designee. The owner or owner’s agent shall immediately remove the temporary/security fencing upon the approval of the Building Official or his designee. w. Sites that contain multiple buildings shall maintain the temporary/security fencing around the portion of the site and buildings under construction as determined by the Building Official or his designee. All temporary/security fencing for construction sites shall include screening, emergency identification and safety identification and shall be kept in neat and undamaged condition. RESOLUTION NO. 2023-032-D/ERC 13 37. On-Site Utilities a. Design and construct all public utilities to serve the site in accordance with City Code, City Standards and requirements of the serving utility, including gas, electric, telephone, water, sewer and cable TV (Cable TV optional for commercial, industrial, or institutional uses). b. The project site shall be provided with separate water and sewer facilities so the City or the agency providing such services in the area can serve it. c. Backflow preventers shall be installed for any building with the finished floor elevation below the rim elevation of the nearest upstream manhole. d. The This project is located in the sewer service area maintained by the City of San Bernardino Municipal Water Department. Therefore, any necessary sewer main extension shall be designed and constructed in accordance with the requirements of SBMWD. e. On-site Utility services shall be placed underground, and easements provided as required. f. All existing overhead on-site utilities adjacent to or traversing the site on either side of the street shall be placed underground in accordance with Section 19.20.030 of the Development Code. g. Existing on-site Utilities which interfere with new construction shall be relocated at the Developer's expense as directed by the City Engineer. h. An encroachment permit from Public Works Department shall be required for utility cuts into existing streets or any work within City’s right-of-way. Pavement restoration or trench repair shall be in conformance with City Standard No. 310. Public facilities shall be restored or constructed back to Public Works Department satisfaction. 38. Street Improvements and Dedications a. For the streets listed below, dedication of adequate street right-of-way (R.W.) per the General Plan and Municipal Code shall provide the distance from street centerline to property line and placement of the curb line (C.L.) in relation to the street centerline shall be as follows: Street Name Right-of-Way Dedication shall be from Centerline. With Submittal of improvement plans including but not limited to grading plans, Street improvement plans, storm drain and retention/detention basin plans, and erosion/sediment control plans, The Applicant shall cause to be formed, or shall be annexed into an existing, Community Facilities District(s) (CFD) (2019- Maintinance) for landscaping, lighting, streets, drainage facilities, street sweeping, graffiti removal, or other infrastructure as required by the City to the satisfaction of the City Engineer. RESOLUTION NO. 2023-032-D/ERC 18 d. The Applicant shall initiate the maintenance and benefit assessment district(s) formation, or annexation, by submitting a landowner petition and consent form (provided by the City) and deposited necessary fees concurrent with the application for street and grading plan review and approval; and said maintenance and benefit assessment district(s) shall be established concurrent with the approval of the final map in the case of the subdivision of land, or prior issuance of any certificate of occupancy where there is no subdivision of land, and as approved by the City Engineer. e. If a drainage report is required by Land Development, A second copy of the drainage report will be delivered to public works, if offsite or overflow storm drain systems are identified, all systems shall be identified on the street improvement plans, and public storm drain shall be on a separate set of plans. f. City approved trash screens and filtration devices shall be installed in all catch basins or manhole connections. g. A temporary construction encroachment permit from Public Works Department shall be required for utility cuts into existing streets or any work within City’s right-of-way. Pavement restoration or trench repair shall be in conformance with City Standard No. 310. Public facilities shall be restored or constructed back to Public Works Department satisfaction. h. Any pavement works affecting the traffic loop detectors shall be coordinated and subjected to Public Works Traffic Division requirements. i. The applicant must post a performance bond (insurance deposit) prior to issuance of the off-site permit. The amount of the bond is to be determined by Public Works Department. j. The above conditions shall comply with current codes, policies, and standards at time of construction. k. Prior to Certificate of Occupancy or Completion of Project all As-builts shall be submitted to Public Works. 39. Required Engineering Plans a. A complete submittal for plan checking shall consist of (MC19.30.170, City of San Bernardino Public Works - Improvement Policies): ▪ street improvement plans (include general notes, engineering conditions, city standards, and cross sections in these plans), ▪ if storm drain plans are required then public storm drains must be included on separate sheets with profiles in the street improvement plans, private storm drains shall be shown separate sheets with profiles in the on-site improvement plans, ▪ if traffic signal modifications are required, then traffic signal plans shall be submitted on separate plan sheets included in the street improvement plans, RESOLUTION NO. 2023-032-D/ERC 19 ▪ if signing and striping are required, then the signing and striping plan shall be on separate sheets included in the street improvement plans, ▪ if lighting is required (more than 2) then the lighting for offsite plans shall be on separate sheets included in the street improvement plans, if two (2) or less then they can be included directly on the street improvement sheets, ▪ lighting (on-site lighting may be included in on-site improvement plan or may be on a separate stand-alone plan), ▪ grading (may be incorporated with on-site improvement plan and the demolition plan), ▪ on-site improvement plans and on-site landscaping and irrigation, ▪ water plans (shall be submitted to San Bernardino Municipal Water Department), ▪ CFD’s are required, the CFD Plans shall include Landscaping, Irrigation, Basins, etc. items that are included in the CFD that are not listed in the plans above, shall be on separate sheets included in the street improvement plans. ▪ other plans as required. Piecemeal submittal of various types of plans for the same project will not be allowed. ▪ All required supporting calculations, studies and reports must be included in the initial submittal (including but not limited to drainage studies, soils reports, structural calculations) b. All off-site improvement plans submitted for plan check shall be prepared on the City’s standard 24” x 36” sheets. A signature block (city standard block) satisfactory to the City Engineer or his designee can be found on the City Web Site http://www.sbcity.org/city_hall/public_works/engineering_division/engineering_d evelopment_resources Engineering conditions of the project shall be inserted in the last pages of the plans. c. After completion of plan checking, final mylar drawings with city standard block, stamped and signed by the Registered Civil Engineer in charge, shall be submitted to the City Engineer for approval. d. Electronic files of all improvement plans/drawings shall be submitted to the City Engineer. The files shall be compatible with AutoCAD 2021 and include a .dxf file of the project. Files shall be on CD and shall be submitted at the same time the final mylar drawings are submitted for approval. e. Copies of the City’s policies and procedures and standard drawings are available at the Public Works Counter for the cost of reproduction. They are also available at no charge at the Public Works Web Site at http://www.sbcity.org/city_hall/public_works/engineering_division/design_policy _and_procedure_documents . RESOLUTION NO. 2023-032-D/ERC 20 40. Traffic Requirements a. The applicant submitted a scope of study form and a vehicle Miles Traveled (VMT) assessment. The scope was approved and will not require a traffic impact Analysis study, and the Vehicle Miles Traveled (VMT) screening will not require a detailed screening analysis since the project met the project type screening. b. All Public Works offsite Mitigation Monitoring and Reporting Program items shall be shown with the Conditions of Approval on the last pages of Public Works Offsite Plans. c. All roadway design, traffic signing and striping, traffic signal, street lighting, and traffic control improvements relating to the proposed project should be constructed in accordance with the applicable engineering standards and to the satisfaction of the City of San Bernardino Traffic Engineering Division. d. In conjunction with standard City of San Bernardino development review procedure, on site traffic signing, and striping plans should be prepared in accordance with the applicable State and Federal standards. e. The final grading, landscaping, and street improvement plans should demonstrate that sight distance standards are met in accordance with the applicable City of San Bernardino / California Department of Transportation sight distance standards. f. Payment of the applicable local and regional impact fees shall be paid to the City of San Bernardino. 41. Required Engineering Permits a. On-site improvements construction permit (except buildings - see Development Services-Building Division), including landscaping. b. Off-site improvement construction permits for the sidewalks and drive approaches. 42. Applicable Engineering Fees c. The current fee schedule is available at the Public Works Counter and at http://www.sbcity.org 43. Integrated Solid Waste Management a. During demolition and/or construction, services are to be provided through the City of San Bernardino’s franchised hauler Burrtec Waste Industries, Inc. b. The Site Plan dated 04/20/2023, identifies the development and establishment of a self-storage facility consisting of a three-story building. The project site is located at 109 S. D Street. c. Burrtec Waste Comments: RESOLUTION NO. 2023-032-D/ERC 21 Project Description: Construct a three-story self-storage facility The Site Plan dated 4/20/23 identifies a single trash room designated “Refuse” at the southwest corner of the building. Please provide a detail of the trash room and dimensions for the driveway access to this area. Any changes to the overall project design, enclosure specifications or location, or access may adversely impact Burrtec’s ability to service the project. Any design modifications that could impact Burrtec’s service will be subject to review and approval by Burrtec. Burrtec’s review of this project is limited to determining whether it meets Burrtec’s minimum standards for waste and recycling collection services. Any comments or approvals by Burrtec are limited to these minimum standards as they relate to our equipment and personnel and do not pertain to the project’s compliance with applicable federal, state and local land use and environmental laws, building codes or other applicable government regulations. Any approvals by Burrtec do not warrant or represent that Burrtec accepts any liability relative to the performance of waste and recycling collection services within this project. End of Burrtec Waste Comments. d. The Site Plan identifies a single trash room designated “Refuse” at the southwest corner of the building. e. Provide a revised Site Plan displaying the dimensions for the driveway access to the trash room area. f. Provide a detail (interior and exterior dimensions) of the trash room. g. Refuse enclosures within five (5) feet of combustible construction shall install an automatic fire sprinkler as approved by the Building & Safety Division and the San Bernardino County Fire Department. (See City Standard Plan 508) h. Refuse enclosure roofs shall be a minimum of eight (8) feet high interior at its lowest point, with minimal front protrusions that can be damaged during container servicing and must extend over any open side or the rear of the refuse enclosure by at least six (6) inches or as approved by the City. i. Display clear drive aisle widths on the Site Plan. j. Burrtec Waste Truck Turning Radius – All corners and intersections on streets and driveways leading to refuse enclosures shall have a turning radius adequate for a 35-foot long, three-axle collection truck. The minimum inside curb radius shall be at least 28 feet. The minimum outside curb radius shall be at least 42 feet. All streets and driveways shall comply with applicable City standards. Burrtec Waste’s truck turning template may be obtained from the Public Works Department in PDF and CAD. RESOLUTION NO. 2023-032-D/ERC 22 k. Vertical and Horizontal Clearances – The minimum vertical clearance for collection trucks along the entire route to the refuse enclosure is fifteen (15) feet. The minimum vertical clearance in front of the refuse enclosure where the truck will empty the container shall be twenty-six (26) feet. The clear height shall be free of building overhangs, trees, and utility lines. The minimum horizontal clearance along the entire route to an enclosure is 12 feet. l. Hammerhead Turnarounds shall meet or exceed San Bernardino County Fire Protection District Diagram A-1.12: Hammerhead Turnaround Detail dated July 1, 2021. San Bernardino County Hammerhead detail may be obtained from the City Public Works Department. m. Tenants/Businesses involved in the production, manufacture, distribution, or sale of food products shall participate in a food waste recycling program per Assembly Bill 1826. This will require additional container(s) for food waste. n. If gated, access shall be provided by means of a key, code, or remote. o. Assembly Bill 341 Mandatory Commercial Recycling may apply. p. Assembly Bill 1826 Mandatory Commercial Organics Recycling may apply. q. Senate Bill 1383 Short-Lived Climate Pollutants Reduction Act may apply. r. Upon completion, service is provided through the City of San Bernardino’s franchised hauler Burrtec Waste Industries, Inc. 111 E. Mill Street, San Bernardino, CA 92408 (909) 804-4222. Building and Safety Division – Standard Requirements 44. After the Public Hearing appeal period ends, the applicant shall submit construction plans to the Building and Safety division for plan check to obtain required permits. 36. The project shall conform to California Building Codes as adopted and amended by the City of San Bernardino municipal code title 15. 37. The proposed project/building/structure shall be fully fire sprinklered and comply with all other relevant laws, ordinances and resolutions governing sprinklers as adopted by the City of San Bernardino. 38. A geotechnical investigation prepared by a qualified engineer. 39. Provide all disabled access requirements and complete details on plans prior to plan review submittal and conform to Chapter 11B. 40. There shall be a formal plan submittal prior to the issuance of permits. 41. Refer to Chapter 7 of the California Building Code for Fire/Smoke Protection Requirements. 42. The construction drawings require professional preparation. Submit plans and structural calculations prepared by a California registered engineer or architect. RESOLUTION NO. 2023-032-D/ERC 23 San Bernardino Municipal Water Department 43. If any new domestic landscape, &/or fire services are needed a request for any old services to be abandoned must be received prior to receiving capacity charge credits. 44. For any buildings or expansions being built, sewer connection & capacity fees are due prior to issuance of a building permit. 45. If there are any street improvements associated with the project, then it is the developer/s and/or engineer/s responsibility to submit a copy of the street improvements plans to SBMWD’s engineering section for review. San Bernardino Municipal Water Department Environmental Control Section 46. SBMWD Environmental Control plan check review is required. 47. Contact SBMWD Environmental Control to discuss and review plan check and pretreatment requirements. 48. Submit the appropriate permit application, project plans, additional documents, information, and revisions, as required for review and approval. 49. All SBMWD Environmental Control plan check requirements must be completed prior to issuance of Building Department permits. Fire Department – Standard Requirements 50. The above referenced project is under the jurisdiction of the San Bernardino County Fire Department herein “Fire Department”. Prior to any construction occurring on any parcel, the applicant shall contact the Fire Department for verification of current fire protection requirements. All new construction shall comply with the current California Fire Code requirements and all applicable statutes, codes, ordinances, and standards of the Fire Department. 51. The required fire fees shall be paid to the San Bernardino County Fire Department/Community Safety Division. 52. Fire Condition Letters shall expire on the date determined by the Planning Division or Building and Safety. 53. Construction permits shall automatically expire and become invalid unless the work authorized such permit is commenced within 180 days after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of 180 days after the time the work is commenced. Suspension or abandonment shall mean that no inspection by the Department has occurred within 180 days of any previous inspection. After a construction permit becomes invalid and before such previously approved work recommences, a new permit shall be first obtained and the fee to recommence work shall be one-half the fee for the new permit for such work, provided no changes have been made or will be made in the original construction documents for such work, and provided further that such suspension or abandonment has not exceeded one year. RESOLUTION NO. 2023-032-D/ERC 24 54. A request to extend the permit may be made in writing PRIOR TO the expiration date justifying the reason that the permit should be extended. 55. Permission to occupy or use the building (Certification of Occupancy or Shell Release) will not be granted until the Fire Department inspects, approves, and signs off on the Building and Safety job card for “fire final”. 56. Building Plans shall be submitted to the Fire Department for review and approval. The required fees shall be paid at the time of plan submittal. 57. Fire access roadways shall not exceed a maximum of twelve (12%) percent grade at any point. Fire access roadways or driveways may be increased to fourteen (14%) percent grade for a distance not to exceed five hundred (500) feet. Fire access roadways providing access to no more than two (2) one or two-family dwellings may be increased to a maximum of sixteen (16%) percent grade not to exceed five hundred (500) feet. Grades across the width of a fire access roadway shall not exceed five (5%) percent. In order to accommodate proper angles of approach and departure, gradient shall not exceed five (5%) percent change along any ten (10) foot section. 58. Fire apparatus access roads shall be designed and maintained to support the imposed loads of fire apparatus and shall be surfaced so as to provide all-weather driving capabilities. Road surface shall meet the approval of the Fire Chief prior to installation. All roads shall be designed to 85% compaction and/or paving and hold the weight of Fire apparatus at a minimum of 80K pounds. 59. Prior to building permits being issued to any new structure, the primary access road shall be paved or an all-weather surface and shall be installed as specified in the General Requirement conditions including width, vertical clearance and turnouts. 60. The applicant shall submit a fire lane plan to the Fire Department for review and approval. Fire lane curbs shall be painted red. "No Parking, Fire Lane" signs shall be installed on public/private roads in accordance with the approved plan. 61. Roadways exceeding one hundred fifty (150) feet in length shall be approved by the Fire Department. These shall be extended to within one hundred fifty (150) feet of and shall give reasonable access to all portions of the exterior walls of the first story of any building 62. Where the natural grade between the access road and building is more than thirty percent (30%), an access road shall be provided within one hundred and fifty (150) feet of all buildings. Where such access cannot be provided, a fire protection system shall be installed. Plans shall be submitted to and approved by the Fire Department. 63. In addition to the Fire requirements stated herein, other onsite and offsite improvements may be required which cannot be determined from tentative plans at this time and would have to be reviewed after more complete improvement plans and profiles have been submitted to this office. 64. Building plans shall be submitted to the Fire Department for review and approval. RESOLUTION NO. 2023-032-D/ERC 25 65. Prior to combustibles being placed on the project site an approved all-weather fire apparatus access surface and operable fire hydrants with acceptable fire flow shall be installed. The topcoat of asphalt does not have to be installed until final inspection and occupancy. 66. Combustible vegetation shall be removed as follows: a. Where the average slope of the site is less than 15% -Combustible vegetation shall be removed a minimum distance of thirty (30) feet from all structures or to the property line, whichever is less. b. Where the average slope of the site is 15% or greater - Combustible vegetation shall be removed a minimum one hundred (100) feet from all structures or to the property line, whichever is less. 67. The development shall have a minimum of two points of vehicular access. These are for fire/emergency equipment access and for evacuation routes. a. Single Story Road Access Width. All buildings shall have access provided by approved roads, alleys, and private drives with a minimum twenty-six (26) foot unobstructed width and vertically to fourteen (14) feet six (6) inches in height. Other recognized standards may be more restrictive by requiring wider access provisions. b. Multi-Story Road Access Width. Buildings three (3) stories in height or more shall have a minimum access of thirty (30) feet unobstructed width and vertically to fourteen (14) feet six (6) inches in height. 68. Prior to building permits being issued to any new structure, the secondary access road shall be paved or an all-weather surface and shall be installed as specified in the General Requirements conditions including width, vertical clearance, and turnouts. 69. The applicant shall submit a fire lane plan to the Fire Department for review and approval. Fire lane curbs shall be painted red. "No Parking, Fire Lane" signs shall be installed on public/private roads in accordance with the approved plan. 70. This project requires an approved street sign (temporary or permanent). The street sign shall be installed on the nearest street corner to the project. Installation of the temporary sign shall be prior to any combustible material being placed on the construction site. Prior to final inspection and occupancy of the first structure, the permanent street sign shall be installed. 71. A water system approved and inspected by the Fire Department is required. The system shall be operational, prior to any combustibles being stored on the site. Fire hydrants shall be spaced no more than three hundred (300) feet apart (as measured along vehicular travel-ways) and no more than three hundred (300) feet from any portion of a structure. 72. Prior to any land disturbance, the water systems shall be designed to meet the required fire flow for this development and shall be approved by the Fire Department. The required fire flow shall be determined by using California Fire Code. The Fire Flow for this project shall be: 4,000 GPM for a Two-hour duration at 20 psi residual operating pressure. Fire Flow is based on a 93,624 sqrft. structure. RESOLUTION NO. 2023-032-D/ERC 26 73. A water system approved and inspected by the Fire Department is required. The system shall be operational, prior to any combustibles being stored on the site. Fire hydrants shall be spaced no more than three hundred (300) feet apart (as measured along vehicular travel-ways) and no more than three hundred (300) feet from any portion of a structure. 74. The applicant shall provide the Fire Department with a letter from the serving water company, certifying that the required water improvements have been made or that the existing fire hydrants and water system will meet distance and fire flow requirements. Fire flow water supply shall be in place prior to placing combustible materials on the job site. 75. Blue reflective pavement markers indicating fire hydrant locations shall be installed as specified by the Fire Department. In areas where snow removal occurs, or non-paved roads exist, the blue reflective hydrant marker shall be posted on an approved post along the side of the road, no more than three (3) feet from the hydrant and at least six (6) feet high above the adjacent road. 76. The applicant shall submit a letter to the Fire Department agreeing and committing to installation of a fire protection system prior to the building inspection for drywall and insulation. 77. An automatic fire sprinkler system complying with NFPA Pamphlet #13 and Fire Department standards is required. The applicant shall hire a licensed fire sprinkler contractor. The fire sprinkler contractor shall submit plans with hydraulic calculations, manufacturers specification sheets and a letter from a licensed structural (or truss) engineer with a stamp verifying the roof is capable of accepting the point loads imposed on the building by the fire sprinkler system design to the Fire Department for approval. The contractor shall submit plans showing type of storage and use with the applicable protection system. The required fees shall be paid at the time of plan submittal. 78. A letter from a licensed structural (or truss) engineer shall be submitted with an original wet stamp at time of fire sprinkler plan review, verifying the roof is capable of accepting the point loads imposed on the building by the fire sprinkler system design. 79. A manual, automatic or manual and automatic fire alarm system complying with the California Fire Code, NFPA and all applicable codes is required. The applicant shall hire a licensed fire alarm contractor. The fire alarm contractor shall submit detailed plans to the Fire Department for review and approval. The required fees shall be paid at the time of plan submittal. 80. An automatic smoke removal system complying with the California Fire Code, NFPA and all applicable codes is required. The applicant shall submit detailed smoke removal system plans to the Fire Department for review and approval. The required fees shall be paid at the time of plan submittal. RESOLUTION NO. 2023-032-D/ERC 27 81. The applicant shall submit an application for high-piled storage (internal storage over 12’ in height), detailed plans and a commodity analysis report to the Fire Department for review and approval. The applicant shall submit the approved plan to Building and Safety for review with building plans. If the occupancy classification is designated as S-2, commodities to be stored will be limited to products of light hazard classification only. The required fees shall be paid at the time of plan submittal. 82. Hand portable fire extinguishers are required. The location, type, and cabinet design shall be approved by the Fire Department. 83. Above Ground Storage Tank plans shall be submitted to the San Bernardino County Fire Department for review and approval prior to any installation on-site. The required Fees shall be paid at time of plan submittal. 84. The applicant shall install Fire Department approved material identification placards on the outside of all buildings and/or storage tanks that store or plan to store hazardous or flammable materials in all locations deemed appropriate by the Fire Department. Additional placards shall be required inside the buildings when chemicals are segregated into separate areas. Any business with an N.F.P.A. 704 rating of 2-3-3 or above shall be required to install an approved key box vault on the premises, which shall contain business access keys and a business plan. 85. Commercial and industrial developments of 100,000 sq. ft or less shall have the street address installed on the building with numbers that are a minimum eight (8) inches in height and with a one (1) inch stroke. The street address shall be visible from the street. During the hours of darkness, the numbers shall be electrically illuminated (internal or external). Where the building is two hundred (200) feet or more from the roadway, additional nonilluminated address identification shall be displayed on a monument, sign or other approved means with numbers that are a minimum of six (6) inches in height and three-quarter (¾) inch stroke. 86. An approved Fire Department key box is required. In commercial, industrial and multi- family complexes, all swing gates shall have an approved fire department Lock (Knox ®). 87. Where an automatic electric security gate is used, an approved Fire Department override switch (Knox ®) is required. 88. The applicant shall contact the San Bernardino County Fire Department/Hazardous Materials Division (909) 386- 8401 for review and approval of building plans, where the planned use of such buildings will or may use hazardous materials or generate hazardous waste materials. 89. An approved spark arrestor is required. Every chimney that is used in conjunction with any fireplace or any heating appliance in which solid or liquid fuel are used, shall have an approved spark arrestor visible from the ground that is maintained in conformance with the California Fire Code. RESOLUTION NO. 2023-032-D/ERC 28 90. A submittal of compressed gasses in storage or use including asphyxiant, irritant, and radioactive gasses complying with the California Fie Code, California Mechanical Code, and NFPA is required. The applicant shall hire a licensed contractor to submit plans for review and approval by the fire department. The required fees shall be paid at the time of plan submittal. 91. Rialto Avenue. One 40-foot and the 35-foot driveways would be located on the southwest corner of the Project site along South D Street. Existing concrete walls and chain link fences along W. Rialto Avenue and South D Street would be removed. The existing chain link fence along the stormwater channel on the eastern Project boundary would remain. Additionally, a retaining wall, ranging in height from 2 to 4 feet, would be installed on the eastern portion of the Project site. Landscaping would be installed in accordance with City development standards. The Project would operate consistent with U-Haul’s standard hours of operation. On-Site Improvements The on-site water, sanitary sewer, storm drain, walls and fences, enclosures, building facades, and parking improvements would be considered private and would be the responsibility of the property owner. All landscaping and/or common area maintenance would be the responsibility of the owner or by an appointed professional landscaping consultant. Off-Site Improvements The Project would construct public street improvements including curb and gutter and driveway connections along the Project frontage to W. Rialto Avenue and South D Street. These improvements would be limited to the areas disturbed to necessitate the construction of driveways. Site Access Primary vehicular access to the Project site would include one ingress/egress driveway provided along W. Rialto Avenue and two ingress/egress driveways along South D Street. The driveway along W. Rialto Avenue and one driveway along South D Street would be 40-feet in width. The remaining driveway along South D Street would be 35-feet in width. Emergency vehicle access would be provided via the 40-foot driveways. Parking The City’s required parking spaces are based on the square footage of uses within the proposed building. The City’s parking requirements consist of one (1) stall per 200 SF of general retail square footage. The Categorical Exemption 3 U-Haul San Bernardino D Street Project Project would include a 2,970 SF show room/retail area, and as such would require 15 stalls. Additionally, the mini storage use on site would require 7 stalls for a total of 22 parking stalls. The Project would provide a total of 2 parking spaces to include 2 truck parking stalls, 18 standard parking stalls for automobiles, and 2 accessible parking stalls. The Project would meet the minimum required parking. Open Space The Project Site is characterized as developed and heavily disturbed consisting of native and non-native grasses. The Project site is surrounded by existing commercial/industrial development and high traffic roads. No natural undisturbed habitats occur on-site or on surrounding properties, therefore the Project site does not represent a wildlife movement corridor or route between open space habitats. The Project would plant 42 trees to operate as ornamental landscaping and to screen the Project from adjacent land uses or the public right-of-way; refer to Figure 4: Conceptual Landscape Plan. Additionally, the Project would plant shrubs, flowers, and other groundcover plants. Construction The Project site is currently developed and heavily disturbed. Project construction is anticipated to begin March 2024, and construction is anticipated to continue for approximately ten (10) months. New construction would include: (1) site preparation and demolition, (2) grading, (3) building construction, (4) paving, (5) architectural coating, (6) landscaping, and the applicable off-site improvements conditioned by the City. Environmental Analysis Air Quality The Project is located within the South Coast Air Basin (SCAB), where air quality is determined by topography, meteorology, and climate, in addition to the presence of existing air pollution sources and ambient conditions.1 The Southern California Air Quality Management District (SCAQMD) and the California Air Resources Board (CARB) monitor air quality within the SCAB. The Project will not have construction or operational emissions that exceed SCAQMD thresholds. Emissions from the Project site during construction would be as a result of heavy-duty machinery and from construction worker trips to and from the Project site. Construction is anticipated to occur over 10 months. The Project site gently slopes and would not require a significant amount of grading operations. The Project would be required to comply with all SCAQMD standard conditions that limit idling time, control dust emissions, and limit the horsepower of specific equipment – all of which would reduce air quality impacts during construction. Due to the size of the Project site and the limited duration of construction, when compared to other projects, it is not anticipated that construction would cause significant impacts. Project operational emissions would not exceed SCAQMD Thresholds and would not result in significant concentrations of pollutants at nearby receptors. Operational emissions of air quality pollutants from the Project site would result in mobile source emissions to and from the Project site. As described below, the Project is anticipated to have 126 daily trips, of which a majority would be automobiles. The nearest 1 South Coast Air Quality Management District, CEQA Air Quality Handbook, 1993. Categorical Exemption 4 U-Haul San Bernardino D Street Project sensitive receptors are the San Manuel Stadium, approximately 1,000 feet to the southwest and residential properties approximately 1,600 feet to the northeast. Furthermore, the Project would not be a source of objectional odors because no agriculture, wastewater treatment, food processing, chemical plant, composting, landfills, dairies, or fiberglass molding would exist on the Project site and impacts concerning odors would be less than significant. Biological Resources The Project would not have a substantial adverse effect, either directly or through habitat modifications, on any plant or wildlife species identified as a candidate, sensitive, or special status species in local or regional plans, policies, or regulations, or by the California Department of Fish and Wildlife (CDFW) or the United States Fish and Wildlife Service (USFWS). The Project site consists of approximately 1.66 acres of vacant land with native and non-natives grasses and exposed soils, and approximately 0.76 acres of the Project site is developed with an existing U-Haul facility. Due to the heavily disturbed nature of the Project site, there is very low-quality habitat for animal species. Additionally, due to the disturbed nature of the vacant parcel on the Project site, all previous vegetation had been removed and only native and non-native grasses exist. No special-status plant or animal species are expected on the Project site. Further, the Project site is surrounded by existing high traffic roads and commercial and industrial development, and as such would not be utilized by wildlife as a habitat linkage. Despite there being no value, as habitat, it is still possible for ground nesting birds protected under the Migratory Bird Treaty Act (MBTA) to nest on the Project site. As such, a pre- construction nesting bird survey would be completed by a qualified biologist three days prior to the commencement of ground disturbing activities, consistent with the California Fish and Game Codes 3503 and 3513. Hydrology and Water Quality A Preliminary Water Quality Management Plan (PWQMP) was prepared for the Project and is included in the engineering documents for this Project. This PWQMP is an engineered document produced as part of the Project design. The PWQMP identifies best management practices (BMPs) that would be required to manage and treat the 100-year storm event at the Project site. The source control BMPs to be implemented for Project include BMP maintenance programs; signage for storm drain infrastructure; efficient use irrigation systems; compliance with the National Pollutant Discharge Elimination System (NPDES) permits; and preparation of a spill contingency plan, among others. During construction, the Project would be required to comply with the Statewide Construction General Permit as required under NPDES rules and regulations. As part of this permit, a stormwater pollution prevention plan (SWPPP) would be prepared for the Project which would design and identify temporary BMPs to be installed on the Project site to treat stormwater runoff from the Project site. These BMPs could include silt fence, filter socks, rock check dams, intel protection, and hydroseeding, among others. These BMPs would control the discharge of pollutants from the Project site during construction. Additionally, the SWPPP would identify practices to implement during construction to ensure the efficacy and functionality of these temporary BMPs such as weekly inspections and maintenance practices. Compliance with the SWPPP and NPDES rules would ensure that no impact would occur related to water quality from construction runoff. Categorical Exemption 5 U-Haul San Bernardino D Street Project Operationally, the Project is not a land use that is known to cause a significant discharge of pollutants. The Project proposes the development of a three-story self-storage site. There are no operational activities associated with self-storage sites that would result in the discharge of pollutants that would impact water quality and water resources within the City. As such, no impact would occur. Noise Construction activities for the Project would include site preparation, grading, building construction, paving, and architectural coating. These activities would require the use of graders, scrapers, and tractors during site preparation; graders, dozers, and tractors during grading; cranes, forklifts, generators, tractors, and welders during building construction; pavers, rollers, mixers, tractors, and paving equipment during paving; and air compressors during architectural coating. Noise generated by the above construction equipment can reach high levels. As previously identified, the nearest sensitive receptors are over 1,000 feet away from the Project site. Sounds and vibration attenuate at a rate of 6 dB per doubling of distance from the noise source, this is due to the “inverse square law” in physics. Assuming a peak noise level of 100 dB at 15 feet from the noise source, a receptor 1,000 feet away would experience a relative noise level of 64 dB. This is less than the ambient noise level of 70 decibels experienced at the Project site, described below in the following paragraph. As such, construction impacts would be less than significant. The Project site is located within the 70 decibel (dB) community noise equivalent level (CNEL) contour of Rialto Avenue as identified on Figure N-2 of the City of San Bernardino General Plan, indicating that ambient noise levels are on average around 70 dB during normal operations. This is as a result of vehicle traffic along nearby roadways. The CNEL is used to compare noisiness of an area is identified by the calculated weighted average of noise levels over time. The end use of the Project site is not a use that is known to generate excessive noise, such as a concert venue, raceway, manufacturing, warehousing, or other uses known to have high noise levels. As such, the Project would not have a significant impact on the surrounding properties and environment regarding operational noise. Transportation A traffic impact study scoping agreement was prepared for the Project and is available in Appendix B. This scoping agreement was utilized to screen the project from level of service (LOS) and vehicle miles traveled (VMT) analyses. These screening criteria are provided in the City of San Bernardino’s Traffic Impact Analysis Guidelines. It should be noted that due to Senate Bill 743, LOS is no longer used as a basis for the determination of significance of environmental impacts under CEQA. As such, LOS discussion is provided for informational purposes only. Level of Service Screening The scoping agreement prepared a trip generation table for the Project, and it was determined that the Project would generate 126 daily trips with 8 trips in the morning peak hour and 13 trips in the evening peak hour. According to the City’s TIA Guidelines, a Project that generate trips under 250 daily trips are assumed to have a less than significant impact. As such, the Project would have a less than significant impact regarding LOS. Categorical Exemption 6 U-Haul San Bernardino D Street Project Vehicle Miles Traveled Screening The City’s TIA Guidelines also provide screening criteria for VMT which are the (1) Transit Priority Area (TPA) Screening, (2) Low VMT Area Screening, and (3) Project Type Screening. TPA Screening A project located within a TPA as determined by the San Bernardino Transportation Analysis Model (SBTAM) VMT Screening would be considered to have a less than significant transportation impact. Based on the San Bernardino County Transportation Authority (SBCTA) VMT Screening Tool, the proposed project is located within a TPA. This screening criterion is met by the Project. Low VMT Area Screening A project located within a low VMT generating area as determined by the SBCTA VMT Screening Tool and the City’s TIA guidelines would be considered to have a less-than-significant transportation impact. Based on the SBCTA VMT Screening Tool and the City’s TIA guidelines, the proposed project is located within a low VMT generating area. This screening criterion is met by the Project. Project Type Screening The City’s TIA Guidelines identify that the following project types would be presumed to have a less than significant VMT impact: • Local-serving K-12 schools • Local parks • Day care centers • Local-serving retail uses less than 50,000 square feet, including: ▪ Gas stations ▪ Banks ▪ Restaurants ▪ Shopping Center • Local-serving hotels (e.g., non-destination hotels) • Student housing projects on or adjacent to college campuses • Local-serving assembly uses (places of worship, community organizations) • Community institutions (Public libraries, fire stations, local government) • Local-serving community colleges that are consistent with the assumptions noted in the RTP/SCS Affordable or supportive housing • Assisted living facilities • Senior housing as defined by the U.S. Department of Housing and Urban Development (HUD) • Projects generating less than 110 daily vehicle trips • This generally corresponds to the following “typical” development potentials: ▪ 11 single family housing units ▪ 16 multi-family, condominiums, or townhouse housing units ▪ 10,000 sq. ft. of office ▪ 15,000 sq. ft. of light industrial ▪ 63,000 sq. ft. of warehousing Categorical Exemption 7 U-Haul San Bernardino D Street Project ▪ 79,000 sq. ft. of high cube transload and short-term storage warehouse The Project is estimated to generate approximately 126 net vehicle trips on a daily basis. Therefore, the project would not be screened out based on project type. The Project meets two of the three screening criteria; therefore, it is assumed that the Project would have a less than significant impact regarding VMT and transportation impacts. Reasons Why Project is Exempt The Project is categorically exempt pursuant to State CEQA Guidelines Section Code 15332, Class 32, for the following reasons: A. The Project is consistent with the applicable General Plan Designation and all applicable General Plan policies as well as with the applicable Zoning district and regulations. B. The Project development occurs within City limits on a Project site of no more than 5 acres substantially surrounded by urban uses. C. The Project site has no value as habitat for endangered, rare, or threatened species. D. Approval of the Project would not result in any significant effects related to traffic, noise, air quality, or greenhouse gas emissions. E. The site can be adequately served by all required utilities and public services. The Project is considered an in-fill development. Additionally, the “General Rule” exemption is also applicable to the proposed Project. The General Rules means that CEQA only applies to projects which have the potential for causing a significant impact—if there is no possibility that the activity in question may have a significant impact, the activity is not covered by CEQA. As described above, no significant adverse impacts would occur as a result of the proposed Project.
