CLOSED SESSION
A) CONFERENCE WITH LEGAL COUNSEL - ANTICIPATED LITIGATION
Initiation of litigation (Pursuant to Government Code Section 54956.9(d)(4))
City Attorney Sonia Carvalho announced that there was an item of litigation on Closed
Session and that it was a follow up to an item taken back in June to consider the
potential filing of litigation to recover city funds.
At this time the Mayor and City Council convened into Closed Session.
The Regular Meeting of the Mayor and City Council was called to order at 7:02 p.m.
INVOCATION AND PLEDGE OF ALLEGIANCE
Pastor Ron Esparza from Living Water Community Church led the invocation and
Pledge of Allegiance.
CLOSED SESSION REPORT
City Attorney Sonia Carvalho stated there was no reportable action from Closed
Session.
CITY MANAGER UPDATE
At this time, City Manager Rob Field provided citywide updates.
MAYOR & CITY COUNCIL UPDATES & CONFERENCES/MEETINGS ATTENDED
At this time, the Mayor and City Council spoke on community events they attended and
upcoming community events.
PRESENTATIONS
1. San Bernardino/Redlands Passenger Rail Project Update by San Bernardino
County Transportation Authority (All Wards)
Tim Watkins from the San Bernardino County Transportation Authority gave a
presentation to the Mayor and City Council.
2. National Veterans and Military Families Month (All Wards)
Mayor Valdivia read into the record the proclamation honoring National Veterans and
Military Families.
PUBLIC COMMENTS FOR ITEMS LISTED AND NOT LISTED ON THE AGENDA
At this time public comments were heard.
Public comment was paused at this time to begin the electoral redistricting public
hearing, which was noticed for 8:00 p.m.

Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California take the following actions:
1. Receive the staff report and presentation.
2. Conduct a Public Hearing to obtain public input and provide direction to staff on
recommended changes, if any, to the draft map(s).
3. Approve draft map(s) for circulation to the public for comment.

Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, approve the appointment of Mr. Anthony J. Roberson to the Public Safety
and Human Relations Commission representing Ward 5. Mr. Roberson will replace
Daniel E. Peeden with the term ending December 2024. Council Staff has verified
that appointee is a registered voter within the City.

Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California, approve the appointment of Ms. Venus L. Williams to the Electoral
Redistricting Advisory Committee representing Ward 1. This term will end once the
City’s ward map, based upon the 2020 US Census data, is adopted by the Mayor
and City Council. Council Staff has verified that appointee is a registered voter
within the City.

5. Introduction and First Reading of Ordinance MC-1566 Amending Section
8.24.090 Entitled (Mandatory Residential, Commercial and Multi-Family
Recycling and Organic Recycling) of the San Bernardino Municipal Code; and
Adding Section 8.24.095 Entitled (Mandatory Commercial Edible Food
Recovery), into Chapter 8.24 of the San Bernardino Municipal Code.
Recommendation
Introduce, read by title, and waive further reading of Ordinance MC-1566 of the
Mayor and City Council of the City of San Bernardino, California, amending Section
8.24.090 of Chapter 8.24 of Title 8 of the San Bernardino Municipal Code (“SBMC”)
pertaining to requirements for the proper collection and storage of recyclable
materials and organic waste and adding Section 8.24.095 to Chapter 8.24 of Title 8
of the SBMC reflecting state requirements for commercial edible food generators
and food recovery organizations and services.

Recommendation
It is recommended that the Mayor and City Council of the City of San Bernardino,
California:
1. Hold a Public Hearing;
2. Adopt Resolution No. 2021-258 of the Mayor and City Council of the City of
San Bernardino, California, calling an election to submit to the qualified
electors the question of levying a special tax within the are proposed to be
annexed to Community Facilities District No. 2019-1 (Maintenance Services)
(Annexation No. 9);
3. Hold a special landowner election and canvass the election;
4. Adopt Resolution No. 2021-259 of the Mayor and City Council of the City of
San Bernardino, California, declaring election results for Community Facilities
District No. 2019-1 (Maintenance Services) (Annexation No. 9);
5. Introduce Ordinance No. MC-1564 of the Mayor and City Council of the City
of San Bernardino, California, amending Ordinance No. MC-1522 and levying
special taxes to be collected during Fiscal Year 2021-22 to pay the annual
costs of the maintenance and servicing of landscaping, lighting, streets, street
sweeping, a reserve fund for capital replacement, and administrative
expenses with respect to City of San Bernardino Community Facilities District
No. 2019-1 (Maintenance Services);
6. Schedule the final reading and adoption of Ordinance No MC-1564 for
November 17, 2021.

Bernardino, California, approving the Middle Management Employees
Memorandum of Understanding (MOU), the General Unit Employees Memorandum
of Understanding (MOU), Job Descriptions, and Updating the City-wide Salary
Schedule.
2) Adopt Resolution No. 2021-269 of the Mayor and City Council of the City of San
Bernardino, California, approving the Management/Confidential Employees
Compensation and Benefits Plan.

and issue an Annual Purchase Order to Daniels Tire Service for the purpose of
supplying light and heavy equipment tires and tire related services in an amount not
to exceed $158,000 on an annual basis with four single year renewal options to the
Public Works Department, Fleet Division, for the maintenance of City owned
vehicles and equipment.

Super Cab.

Works Department which was approved for funding through the Fiscal Year 2021/22
Operating Budget Report.

median island and the closure of two turnouts along Kendall Drive from “E” Street
to “H” Street.

1. Authorizing the Director of Finance to appropriate entire amount of $149,713
from the Animal Control Department Fund Balance Account to the Animal
Shelter Electrical Project Account in accordance with Contract Change Order
(CCO) #1 for CIP Project No. 8776 with TSR Construction and Inspection; and
2. Authorizing the Director of Finance to increase the purchase order to reflect
the full, approved project cost.

Wednesday, November 17, 2021, in the Council Chamber located at 201 North “E”
Street, San Bernardino, California 92401. Closed Session will begin at 5:30 p.m. and
Open Session will begin at 7:00 p.m.
