A RESOLUTION OF THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AMENDING RESOLUTION NO. 10584 ENTITLED IN PART "A RESOLUTION... ESTABLISHING... EMPLOYER -EMPLOYEE RELATIONS"; ESTABLISHING THE NUMBER OF REPRESENTATIVES TO MEET AND CONFER IN GOOD FAITH: FIXING THE DATE FOR FILING DECERTIFICATION CHALLENGES; AND CLARIFYING THE RIGHTS OF CONFIDENTIAL EMPLOYEES, AND REPEALING SECTION 17.5 THEREOF. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. Resolution No. 10584 Section 6 Subsection (F) is hereby i amended to read as follows: "(F) The formally recognized employee organization may be represented at scheduled meet and confer sessions with City representatives by not more than five (5) City employees, consisting of one (1) employee member of the Water Department, one (1) from the Library Department, and three (3) from all other City departments; and three (3) non -employee members of the recognized employee organization with an equal number for management. The recorder shall not be considered a representative hereunder." SECTION 2. Resolution No. 10584 Section 6 is hereby amended by adding thereto Subsection (G) to read as follows: "(G) The employee organization shall, whenever practical, submit the names of the employee members to the Designated City Representative at least two (2) working days prior to such meetings. No employee representative shall leave his or her -duty or work station or assignment for scheduled meeting and conferring without specific approval of the Department Head or Designated City Representative." SECTION 3. Resolution No. 10584 Section 6 is hereby amended by adding thereto Subsection (H) to read as follows: 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 "(H) Meeting and conferring will be scheduled consistent with operating needs and work schedules. City employees author- ized to attend such meetings during work hours shall suffer no loss in compensation. Nothing provided herein, however, shall restrict the City from scheduling such meetings before or after regular work hours under appropriate circumstances, by mutual agreement." SECTION 4. Resolution No. 10584 Section 11 Subsection (B) is hereby amended to read as follows: "(B) The recognition rights of the majority representative designated in accordance with this Section shall not be subject to challenge for a period of twelve (12) months following the date of such recognition. Such challenge shall be filed only during the first week of October after the expiration of the twelve month period." SECTION 5. Resolution No. 10584 Section 17.2 Subsection (B) is hereby amended to read as follows: "(B) Confidential employees are excluded from representa- tion by the formally recognized employee organizations represent- ing non -confidential employees and are restricted from represent- ing non -confidential employees of the City of San Bernardino on matters within the scope of representation." SECTION 6. Resolution No. 10584 Section 17.5 is hereby repealed.
