RESOLUTION NO.
A RESOLUTION OF THE CITY OF SAN BERNARDINO ORDERING THE VACATION
OF A PORTION OF WATERMAN AVENUE NORTH OF INDUSTRIAL ROAD, IN THE CITY
OF SAN BERNARDINO AND RESERVING PUBLIC UTILITY EASEMENTS UPON A PORTION
THEREIN.
BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF
SAN BERNARDINO AS FOLLOWS:
SECTION 1. The Mayor and Common Council of the City of
San Bernardino, having heard the evidence offered in relation to the
proposed vacation of a portion of Waterman Avenue North of Industrial
Road, more particularly described in City Resolution of Intention
No. 80-487, hereby find from all of the evidence submitted that such
portion of Waterman Avenue proposed to be vacated by said resolution
is unnecessary for present or prospective public street purposes.
SECTION 2. The Mayor and Common Council of said City do hereby
order the vacation of a portion of Waterman Avenue North of Industrial
Road, San Bernardino, California, more particularly described as
follows:
That portion of Lot 9, Block 75 Rancho San Bernardino
as per plat thereof recorded in Book 7 of Maps, page 2,
records of the County Recorder of San Bernardino County,
State of California, described as follows:
Beginning at the intersection of the Southerly right
of way line of the Southern Pacific Railroad, and a line
which is parallel with and 92.00 feet East of and measured
a- right angles to the centerline of Waterman Avenue; thence
South along said parallel line to the Westerly prolongation
of the northerly line of Industrial Road as delineated on
the Map of Tract No. 6548 as per plat thereof recorded in
Book 84 of Maps, pages 39 and 40, records of said County;
thence Easterly along said Westerly prolongation to a
point in a line which is parallel with and 125.00 feet
East of and measured_at right angles to the centerline of
said Waterman Avenue, said parallel line being an East
line of the land conveyed to the County of San Bernardino
by deed recorded December 8, 1959 in Book 5002, page 531,
Official Records of said County; thence North along said
East line to an angle point therein; thence east -along the
boundary of said County land a distance of 40.00 feet;
thence North along the boundary of said County land a
distance of 104.26 feet, more or less, to the Southerly

line of said Southern Pacific Railroad right of way; thence
Westerly along said right of way line to the Point of Beginning.
Containing .289 acres, more or less.
And is also described in said Resolution No. 80-487.
SECTION 3. This Resolution shall reserve, and nothing herein
shall in any way affect or disturb each and every existing easement
for sanitary sewer and appurtenant facilities and for public utility
purposes belonging either to the City of San Bernardino or to any
public utility and there is further reserved for present and future
general public utility purposes and for this City an easement reasonably
necessary to locate sanitary sewer, public utility and appurtenant
facilities over, in, under or across the West 33.00 feet, as measured
at right angles to and parallel with the West line of the real property
described 'hereinbefore along with the right to use, install, maintain,
repair, replace or renew such facilities and those reserved by Resolution
of Intention No. 80-487.
SECTION 4. The City Clerk of the City of San Bernardino shall
cause a certified copy of this resolution to be recorded in the office
of the County Recorder of the County of San Bernardino.
I HEREBY CERTIFY that the foregoing resolution was duly adopted
by the Mayor and Common Council of the City of San Bernardino at a
meeting thereof held on the /9xl day
