RESOLUTION OF THE CITY OF SAN BERNARDINO AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH FIRST FEDERAL SAVINGS AND LOAN ASSOCIATION OF SAN BERNARDINO RELATING TO THE POSTPONEMENT OF STREET IMPROVEMENTS AT THE INTERSECTION OF SIXTH STREET AND "D" STREET, PURSUANT TO SAN BERNARDINO MUNICIPAL CODE CHAPTER 19.48. BE IT RESOLVED BY THE MAYOR AND COMMON COUNCIL OF THE CITY OF SAN BERNARDINO AS FOLLOWS: SECTION 1. The Mayor of the City of San Bernardino is hereby authorized and directed to execute on behalf of said City an Agreement with First Federal Savings and Loan Association of San Bernardino relating to the postponement of street improvements at the intersection of Sixth Street and "D" Street,a copy of which is attached hereto, marked Exhibit "I" and incorporated herein by reference as fully as though set forth at length. Sincerely, WVAA*W44'0' Conrad Knowles Senior Vice President CK/aw 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 A G R E E M E N T (street improvements - 6th & "D" Streets) THIS AGREEMENT is made and entered into this day of , 1981, by and between the CITY OF SAN BERNARDINO, 3 municipal corporation, ("City"), and FIRST FEDERAL SAVINGS AND GOAN ASSOCIATION OF SAN BERNARDINO, a California corporation, ("Developer"). The parties agree as follows: 1. Recitals: (a) Developer has applied for a building permit for certain construction on the premises owned by Developer, located at the southwest corner of the intersection of Sixth and "D" Streets, in the City of San Bernardino, generally referred to in this agreement as "the premises", and more particularly described as follows: Parcel No. 1 as shown on proposed Parcel Map No. 6461 of the City of San Bernardino currently pending recordation and as depicted on Exhibit "A", attached hereto. (b) As a condition of issuance of a building permit, and pursuant to Chapter 19.48 of the San Bernardino Municipal Code, Developer is required to make certain street improvements. (c) Pursuant to Section 19.48.110 of the San Bernardino Municipal Code, Developer has requested a postponement of the actual installation of the required street improvements. The Mayor and Common Council of City have approved the delay, in accordance with the terms of this agreement, for a period not to exceed 18 months from the date of this agreement. 2. Developer to construct street improvements. Developer 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 agrees that street improvements adjacent to the premises, in accordance with standards and specifications of the City Engineer, shall be completed not later than 18 months after the date of this agreement. Developer further agrees that the construction of said street improvements shall be commenced within 10 days and completed within 90 days after written notice is given to it at any time during said 18 month period by the City Engineer, stating that street improvements are being constructed on an adjacent parcel of land, and requesting that Developer install street improvements. 3. Security. The City Engineer has estimated the cost of the required street improvements to be $68,000, as indicated on Exhibit "B" attached hereto. As security for the performance of Developer's obligations under this agreement and Section 19.48.110 of the San Bernardino Municipal Code, Developer agrees to execute a promissory note payable to City, upon demand, in the amount of $68,000, secured by a legally sufficient deed of trust of the same date on the premises, and Developer agrees to execute and record the deed of trust at its expense. 4. City consents to delay. City agrees that the construction of street improvements by Developer may be delayed in accordance with the terms of this agreement. City agrees not to make demand on Developer's promissory note to City so long as Developer complies with the terms of this agreement. 5. Notices.
