CALL TO ORDER FLAG SALUTE ROLL CALL ADMINISTRATION OF OATH CLOSED SESSION (if needed): Recommended Motion: That the Planning Commission recess to closed session for the following: A. Conference with legal counsel – existing litigation – pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel – anticipated litigation – significant exposure to litigation – pursuant to subdivision (b) (1); (2); (3) (A-F) of Government Code Section 54956.9. C. Conference with legal counsel – anticipated litigation – initiation of litigation – pursuant to subdivision (c) of Government Code Section 54956. All public and non-public hearings will be opened at one time. Any item may be discussed separately, upon request of a member of the Planning Commission or member of the public. 1. Minutes of May 21, 2014. Staff recommends approval of these minutes. PUBLIC HEARING ITEMS The Planning Commission will first hear a report from staff and then the public hearing will be opened. The applicant will have an opportunity to speak. Next, members of th e public will be allowed three minutes to speak. Anyone in the audience wishing to speak must be sworn in and also fill out a request to speak form. The forms are located on the table near the door. When your name is called, come forward and speak into the microphone, say and spell your name and give your address for the taped record. After all have spoken, the applicant will be allowed to respond. The public hearing will then be closed and the Planning Commission will begin deliberations and make a decision. All actions except General Plan Amendments and amendments to the Municipal (Development) Code are final action unless an appeal is filed and fee paid within 15 days to the Community Development Department. If you challenge the resultant action of the Planning Commission in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing. 2. CONDITIONAL USE PERMIT 13-22 (A continued public hearing from May 21, 2014) The applicant requests approval of a Conditional Use Permit to provide an Alcoholic Beverage (ABC) Type 20 License (Off-sale Beer & Wine) for an existing 9,026-square foot retail store (Dollar General), located at 180 North Waterman Avenue, in the Commercial General (CG-1) zone. Environmental Determination: Exempt from CEQA, Section 15301 – Existing Facility Applicant: Dolgen California, LLC APNs: 0135-301-41 Ward: 1 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit 13-22, based upon the Findings of Fact contained in this Interoffice Memorandum and subject to the Conditions of Approval. 06/18/14 Page 3 of 4 3. ADMINISTRATIVE DEVELOPMENT PERMIT 14-08 - A request of an approval of an Administrative Development Permit to provide an Alcoholic Beverage (ABC) Type 21 License (Off-sale General) for an existing 104,275-square foot retail store (Target), located at 2380 North Sterling Avenue, in the Commercial General (CG-1) zone. Environmental Determination: Exempt from CEQA, Section 15301 – Existing Facility Applicant: Target Corporation APNs: 0150-442-11 Ward: 7 Recommended Motion: Staff recommends that the Planning Commission approve Administrative Development Permit No. 14-08 based on the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval. 4. DEVELOPMENT CODE AMENDMENT/ZONING MAP AMENDMENT 14 - 12 - A request to amend Development Code Chapter 19.04.030 (2) (V), Student Housing Complex, to add 10.16 acres on the west side of Northpark Boulevard, northwest of the intersection of University Parkway and Northpark Boulevard in Tract 17703-2, Lot 1 and Tract 17703-3 Lots, 1, 2, and 3 in the Residential Student Housing Zone and to add certain development standards to the Residential Student Housing Zone Environmental Determination: Exempt from CEQA, Section 15061 (b)(3) Applicant: James R. Watson APNs: 0151-342-22, 0151-361-41, 0151-372-22, 0151-372- 23 and 0151-372-24 Ward: 5 Recommended Motion: Staff recommends that the Planning Commission recommend approval of Development Code Amendment/Zoning Map Amendment 14-12 to the Mayor and Common Council, based upon the Findings of Fact contained in the staff report.
