CALL TO ORDER FLAG SALUTE ROLL CALL ADMINISTRATION OF OATH CLOSED SESSION (if needed): Recommended Motion: That the Planning Commission recess to closed session for the following: A. Conference with legal counsel – existing litigation – pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel – anticipated litigation – significant exposure to litigation – pursuant to subdivision (b) (1); (2); (3) (A-F) of Government Code Section 54956.9. C. Conference with legal counsel – anticipated litigation – initiation of litigation – pursuant to subdivision (c) of Government Code Section 54956. All public and non-public hearings will be opened at one time. Any item may be discussed separately, upon request of a member of the Planning Commission or member of the public. 1. Minutes of June 18, 2014. Staff recommends approval of these minutes. 2. CONDITIONAL USE PERMIT 11-08 (Extension of Time 14-06) A request for a one-year extension of the previous Mayor and Common Council’s approval of Conditional Use Permit 11-08 to construct a multi-tenant commercial shopping center with a 136,090-square foot home improvement store and approximately 68,630 square feet of retail and restaurant uses. Address: Southwest corner of Highland and Arden Avenues Zone: Commercial General (CG-1) Environmental Determination: Previous EIR – SCH #201106121 Applicant: Home Depot USA, Inc. APNs: Various (72 parcels) Ward: 7 Recommended Motion: Staff recommends that the Planning Commission approve Extension of Time14-06 to extend the approval of Conditional Use Permit 11-08 from June 18, 2014 to June 18, 2015, based on the previously adopted Findings of Fact and subject to the previously approved Conditions of Approval. PUBLIC HEARING ITEMS The Planning Commission will first hear a report from staff and then the public hearing will be opened. The applicant will have an opportunity to speak. Next, members of the public will be allowed three minutes to speak. Anyone in the audience wishing to speak must be sworn in and also fill out a request to speak form. The forms are located on the table near the door. When your name is called, come forward and speak into the microphone, say and spell your name and give your address for the taped record. After all have spoken, the applicant will be allowed to respond. The public hearing will then be closed and the Planning Commission will begin deliberations and make a decision. All actions except General Plan Amendments and amendments to the Municipal (Development) Code are final action unless an appeal is filed and fee paid within 15 days to the Community Development Department. If you challenge the resultant action of the Planning Commission in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing. 07/16/14 Page 3 of 4 3. CONDITIONAL USE PERMIT 14-07 - A request to establish a discount retail store in an existing 30,427-square foot commercial building. Address: 648 W. 4th Street Zone: Commercial Regional - Downtown (CR-2) Environmental Determination: Exempt from CEQA, Section 15301 – Existing Facility Applicant: Chris Post APN: 0134-111-34 Ward: 1 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit No. 14-07 based on the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval. 4. CONDITIONAL USE PERMIT 13-26 - A request to construct a gas station with a 3,050-square foot convenience store with a Type 20 ABC license (Off-sale, Beer & Wine), and a 2,000-square foot restaurant. Address: Southwest corner of Tippecanoe and Central Avenues Zone: Industrial Light (IL) Environmental Determination: Exempt from CEQA, Section 15332 – Infill Development Applicant: Michael Sater APN: 0280-231-10 Ward: 1 Recommended Motion: Staff recommends that the Planning approve Conditional Use Permit 13-26 with the ABC Type 20 License (Off-sale Beer & Wine) based on the Findings of Fact contained in the Staff Report and subject to the Conditions of Approval.
