CALL TO ORDER FLAG SALUTE ROLL CALL ADMINISTRATION OF OATH CLOSED SESSION (if needed): Recommended Motion: That the Planning Commission recess to closed session for the following: A. Conference with legal counsel – existing litigation – pursuant to Government Code Section 54956.9(a). B. Conference with legal counsel – anticipated litigation – significant exposure to litigation – pursuant to subdivision (b) (1); (2); (3) (A-F) of Government Code Section 54956.9. C. Conference with legal counsel – anticipated litigation – initiation of litigation – pursuant to subdivision (c) of Government Code Section 54956. All public and non-public hearings will be opened at one time. Any item may be discussed separately, upon request of a member of the Planning Commission or member of the public. 1. Proclamations 2. Minutes of August 20, 2014. Staff recommends approval of these minutes. PUBLIC HEARING ITEMS The Planning Commission will first hear a report from staff and then the public hearing will be opened. The applicant will have an opportunity to speak. Next, members of the public will be allowed three minutes to speak. Anyone in the audience wishing to speak must be sworn in and also fill out a request to speak form. The forms are located on the table near the door. When your name is called, come forward and speak into the microphone, say and spell your name and give your address for the taped record. After all have spoken, the applicant will be allowed to respond. The public hearing will then be closed and the Planning Commission will begin deliberations and make a decision. All actions except General Plan Amendments and amendments to the Municipal (Development) Code are final action unless an appeal is filed and fee paid within 15 days to the Community Development Department. If you challenge the resultant action of the Planning Commission in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing. 3. TENTAITVE PARCEL MAP 19534 (SUBDIVISON 14-09) AND DEVELOPMENT PERMIT-D 14-16 - A request for a reversion to acreage to combine seven parcels into one large commercial parcel of approximately 7.2-acre parcel and construct a 3-story, 150,000-square foot medical and educational facility. Address: SW Corner of West Valley Street and South G Street Zone: Central City South (CCS-1) & Transit Overlay District (TOD) Environmental Determination: Proposed Mitigated Negative Declaration with Mitigation Monitoring / Reporting Program Applicant: Ken Breyer APN: 0136-093-21 and 0136-094-16, 17 and 18 Ward: 3 07/16/14 Page 3 of 4 Recommended Motion: Staff recommends that the Planning Commission approve Tentative Parcel Map 19534 (Subdivion 14-09) and Development Permit-D 14-19 and adopt the Mitigated Negative Declaration and Mitigation Monitoring/Reporting Program prepared for the project, based upon the Findings of Fact contained in this staff report and subject to the Conditions of Approval. 4. CONDITIONAL USE PERMIT 13-11 (VARIANCE 14-10) - A proposal for a Conditional Use Permit to convert an existing 1,430-square foot auto service bay facility into a convenience store with a variance to reduce the landscape setback along the south property boundary from 10 feet to 5 feet. Address: 189 West Highland Avenue Zone: Commercial General (CG-1) Environmental Determination: Exempt from CEQA – Section 15301 – Existing Facilities Applicant: DB Oil APN: 0146-013-25 Ward: 2 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit 13-11 and Variance 14-10 based upon the Findings of Fact contained in this staff report and subject to the Conditions of Approval. 5. CONDITIONAL USE PERMIT 14-03 - A request to establish a discount retail store in an existing 10,700-square foot commercial building. Address: 1035 West Highland Avenue Zone: Commercial General (CG-1) Environmental Determination: Exempt from CEQA – Section 15301 – Existing Facilities Applicant: David Glassman APN: 0144-031-12 Ward: 2 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit 14-03 based on the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval. 6. CONDITIONAL USE PERMIT 14-16 - A request to modify an existing 75-foot mono-pine wireless telecommunications facility by installing additional antennas and equipment. APN: 0149-032-07, 24, 25, 62, 64 & 69 Ward: 2 Recommended Motion: Staff recommends that the Planning Commission continue Conditional Use Permit 14-16 to the next scheduled Planning Commission meeting on October 15, 2014.
