Conference with legal counsel – existing litigation – pursuant to Government Code Section 54956.9(a). All public and non-public hearings will be opened at one time. Any item may be discussed separately, upon request of a member of the Planning Commission or member of the public. 1. Minutes of January 21, 2015. Staff recommends approval of these minutes. 2. CONDITIONAL USE PERMIT 14-14 - A request to demolish an existing 3,600- square foot drive-thru restaurant and construct a new 2,999-square foot drive-thru restaurant. Address: 524 Inland Center Drive Zone: Commercial General (CG-1) Zone Environmental Determination: Exempt from CEQA – 15332 – Infill Development Applicant: Lyons Warren Engineers and Architects APN: 0141-071-73 Ward: 3 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit 14-14 based on the Findings of Fact contained in the Staff Report and subject to the Conditions of Approval. 3. CONDITIONAL USE PERMIT 14-23 - A request to remove an existing 54-foot monopole and construct and operate a new wireless telecommunications facility consisting of a 75-foot tall tower, camouflaged as a eucalyptus tree, and associated equipment located within two 8-foot tall block enclosures. Address: 1510 S. Mountain View Avenue Zone: Residential Urban (RU) Environmental Determination: Exempt from CEQA – 15303 – New Construction of Small Structures Applicant: Brett Smirl APN: 0281-211-18 & 20 Ward: 3 Recommended Motion: Staff recommends that the Planning Commission approve Conditional Use Permit 14-23 based on the Findings of Fact contained in this Staff Report and subject to the Conditions of Approval. PUBLIC HEARING ITEMS 02/18/2015 Page 3 of 4 The Planning Commission will first hear a report from staff and then the public hearing will be opened. The applicant will have an opportunity to speak. Next, members of the public will be allowed three minutes to speak. Anyone in the audience wishing to speak must be sworn in and also fill out a request to speak form. The forms are located on the table near the door. When your name is called, come forward and speak into the microphone, say and spell your name and give your address for the taped record. After all have spoken, the applicant will be allowed to respond. The public hearing will then be closed and the Planning Commission will begin deliberations and make a decision. All actions except General Plan Amendments and amendments to the Municipal (Development) Code are final action unless an appeal is filed and fee paid within 15 days to the Community Development Department. If you challenge the resultant action of the Planning Commission in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this agenda, or in written correspondence delivered to the Community Development Department at, or prior to, the public hearing. 4. APPEAL 15-01 - Appeal of the Community Development Director’s approval of Minor Modification 14-34 to Tentative Tract Map 15731 dated Nov. 21, 2014 and the North Plan for the "Highland Hills Project" dated November 10, 2014. Address: East of the City Creek and North of Highland Avenue in the Highland Hills Specific Plan. Zone: Highland Hills Specific Plan Environmental Determination: Ministerial Act exempt from the California Environmental Quality Act (CEQA) per Public Resources Code Section 21080 (b) (1) and the CEDQA Guidelines Section 15268 Applicant: Jim Nunn and Highland Hills Homeowners c/o Briggs Law Corporation. APN: Various Parcels Ward: 4 Recommended Motion: Staff recommends that the Planning Commission uphold the December 30, 2014, decision of the Community Development Director and deny the appeal (15-01).
