Good morning Council,
In light of the special meeting that has been called this evening I wanted to pass along public records that
I have regarding 340 Fourth St. Attached is the code enforcement case information on the property dating
as far back as 2015. What I find disheartening is that the city has been fully aware of the ongoing issues
at this building, including it being used as an illegal cannabis shop along with the living conditions. The
county and city have conducted inspections together and tagged the multiple violations.
On June 22, 2022, the city began fining the owner a $1,000 a day but acted completely surprised and
unaware of what was happening on September 22, (3 months later) when residents were notified, they
had to leave.
In addition to the condition of the building and the lack of enforcement, the owner is a political contributor
of the mayor. I request that he not be allowed to be involved in the close session discussion on this item
given his long and well documented history of pay to play corruption in his tenure as Mayor.

Property shall be free of overgrown or dead vegetation,
including, but not limited to weeds, trees or limbs, bushes and
other planted vegetation. Weeds include sage brush, dry grass,
chaparral, and any other brush or vegetation which attains
extensive growth and becomes a fire menace when dry.

If our information is incorrect and the conditions listed above do not exist, please disregard this notice and accept our
apology.
If the conditions do exist, please consider this notice as a request to correct the conditions or contact our office to
discuss a compliance schedule within 14 days. A Code Enforcement Officer will be sent out to verify that the
conditions have been corrected at the end of the 14-day period. If the violations still exist, an Administrative Citation
may be issued with no further warning and will include a fine.

and were told they were almo t at full capacity Maintenance man walked with
us. He indicated that the owner was in the process of getting a contract with
the county to place people In addition to the violation documented by
Rowland: Two units (first floor east side) were unoccupied and used for storage
becau e the plumbing wa backed up Flooring removed from the corridor on
the first floor east side. Water damaged ceilings observed in the hallways.

Quick update, for a second day in a row, the County has provided housing
resources and various services to tenants residing in the Code Case Building
located at 340 4th Street. The following service providers set up booths at the
Government Center:
• Keys
• Lighthouse
• Step Up and
• Sheriff's Hope Team
• Adult Protective Services
Multiple community partners and the Office of Governor Newsom's Office
contacted me our of concern. I will participate in a community meeting this
Friday to identify and discuss alternative solutions for individuals unable to
connect with a housing provider as some are without income or their income is
too low to afford a place on their own.

I poke to Anna Ulibarri and he will be a i ting CAP with tran itioning the
families out of the building tomorrow. Anna and her team will also try to connect
ingle men and women to tran itional hou ing pon ored by The Way
Outreach Center. The problem is there is a huge scarcity in shelter beds and
hou ing even in neighboring citie that normally have a few bed to pare for
local social service providers. Although I am waiting to receive a proposal from
Searchlight Society, Anna and her team will al o ubmit a general propo al a
soon as tomorrow as she and her team are local and have access to local
ocial ervice provider She al o recognize the need to develop an interim
shelter quickly to get the people out of the 399 N D St building. Based on the
mind et and behavior of ome of the people who live at 399 N D St, Anna
recommends 24-hour supervision/oversight to make sure the interim shelter
doe not turn into bedlam Ju t o you know, thi venture i going to co t more
than what I currently have available in ESG funds.

I just spoke to Xiomara and Charles from Community Action Partnership (CAP)
who are at the code case building right now with their mobile unit. After visiting
the building (399 N St) and getting a better idea of the dynamics they realized
that the relocation of families is going to require a little more strategy and
planning. Xiomara has asked property manager, Jeff, to categorize families
with the most urgent need and those with children. They were informed that
there is approximately 30-40 families. CAP is calling other agencies for
support. The issue is related to liability. CAP recognizes that individuals in the
building are very low income. If CAP places them into a motel for 2 weeks or
30 days, they currently do not have a follow up plan. There is no immediate
low-income rental housing available that the families can afford. The families
would eventually be displaced back onto the streets. CAP is hoping to put the
families into motels after they connect with and confirm other providers can
help with transitional housing. Both Xiomara and Charles will follow up with me
this afternoon. The plan is transport families first thing in the morning.
What is needed:
Marr, CAP is asking for physical help assessing the families tomorrow and
would like for Code Enforcement Officers to be present. Once Xiomara calls
me back, I will let you know the exact time of the rendezvous and approximate
number of staff required.

It is unlawful for any person… to commence or carry on any business, show,
exhibition or game, … without first having procured a registration certificate from
the City and without complying with any and all regulations of such business, show,
exhibition or game… shall constitute a separate violation of this Article for each and
every day that such business, show, exhibition or game is so carried on. – Please

EXPLANATION OF CONSEQUENCES
City of San Bernardino Municipal Code chapter 9.93 provides for the assessment of Administrative Civil Penalties for
Municipal Code Violations. Administrative Civil Penalties for violations of a provision of the Municipal Code shall
be assessed at a daily rate determined by the Enforcement Officer, or by the Administrative Law Officer pursuant to
the criteria listed in section 9.93.040. The maximum rate shall not exceed $100,000 per parcel or structure for any
related series of violations. The Responsible Party has the burden of notifying the City Attorney's Office at (909)
384-5355 once all violations have been corrected in order to stop the daily accrual of penalties.
Administrative Civil Penalties can be issued in addition to criminal citations, administrative citations, or any other
civil action. Issuance of one type of enforcement action does not preclude the use of any other enforcement provided
for under the San Bernardino Municipal Code.
Right to a Hearing:
An Administrative Hearing will be scheduled when the Responsible Party requests a hearing within 15-days from the
date of the Notice and Order, or if the Responsible Party fails to comply with the terms of the Administrative Civil
Penalties. Failure to comply includes failure to pay the assessed Administrative Civil Penalties within 15-days, failure
to commence and complete corrections by the established deadlines or failure to refrain from continuing violations of
the Municipal Code.

Payment should be made by personal check, cashier’s check, or money order, payable to the City of San Bernardino.
Be sure to write the citation number CP-22-000018 on the check or money order, and enclose a copy of the Notice
and Order.
